OF THE COUNCIL OF THE CITY OF FORT COLLINS
BEING AN ORDINANCE VACATING ALL STREETS AND
EASEMENTS DEDICATED ON THE PLAT OF NORTH LEMAY
SUBDIVISION, SECOND FILING
WHEREAS, the City Council has been petitioned to vacate all streets
and easements dedicated on the plat of North Lemay Subdivision, Second
Filing, as recorded in Book 1627 at Page 961 of the Larimer County Clerk
and Recorder's Office; and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be prejudiced or injured by the vacation of said streets and
easements provided that the petitioner have new streets and easements
dedicated and recorded as set forth on the North Lemay Second Filing
Replat.
NOW, THERFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that those certain streets and easements dedicated on the plat of
North Lemay Subdivision, Second Filing, as recorded in Book 1627 at Page
961 of the Larimer County Clerk and Recorder's Office be, and the same
hereby are, vacated, abated and abolished provided that the petitioner
dedicate and have recorded new streets and easements as are set out on the
North Lemay Second Filing Replat.
Introduced, considered favorably on first reading, and ordered pub-
lished this 3rd day of November 1981, and to be presented for final
passage on the 17th day of November 1981.

ORDINANCE NO. 108, 1993
OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING THE RIGHT-OF-WAY FOR LOGAN COURT AS SHOWN ON
THE REPLAT OF THE NORTH LEMAY SUBDIVISION, SECOND FILING
AND RETAINING A PORTION FOR UTILITY EASEMENT PURPOSES
WHEREAS, the Replat of the North Lemay Subdivision Second Filing was
approved by the Planning and Zoning Board of the City of Fort Collins on April
30, 1981, and included a dedication to the public of a right-of-way for Logan
Court; and
WHEREAS, the owners of the parcels in the Replat of the North Lemay
Subdivision, Second Filing abutting the right-of-way for Logan Court have
requested vacation of said right-of-way since it is no longer necessary for
access to said parcels; and
WHEREAS, on September 14, 1993, the Planning Director approved a Minor
Subdivision entitled "The Second Replat of North Lemay Subdivision, Second
Filing," which replats a portion of the Logan Court right-of-way; and
WHEREAS, the owner of the parcels abutting the remainder of said right-of-
way has agreed to the vacation and has requested the vacation in conjunction with
the approval of "The Second Replat of North Lemay Subdivision, Second Filing";
and
WHEREAS, Logan Court has never been constructed, and it is no longer
necessary or desirable to retain the right-of-way for said street; and
WHEREAS, pertinent City agencies and private utility companies have been
contacted and report no objection to the proposed vacation; and
WHEREAS, the rights of the residents of the City of Fort Collins will not
be prejudiced or injured by the vacation of said right-of-way.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that the street right-of-way for Logan Court as dedicated and described on the
plat entitled "Replat of North Lemay Subdivision, Second Filing" be, and the same
hereby is, vacated, abated, and abolished; EXCEPTING AND RESERVING, however, as
a utility easement, that portion of said right-of-way which intersects the
existing 20 (twenty) foot wide utility easement dedicated with the Replat of
North Lemay Subdivision, Second Filing, as illustrated on Exhibit "A," attached
hereto and incorporated herein by this reference.
Introduced, considered favorably on First Reading, and ordered published
this 21st day of September, A.D. 1993, and to be presented fo final pass e-� n
