HomeMy WebLinkAboutSQUARE AT KENSINGTON SOUTH - Filed EV-EASEMENT VACATION - 2003-12-08RESOLUTION 83- 97 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE MAYOR TO EXECUTE A QUIT CLAIM DEED FOR LOT 58, THE SQUARE AT KENSINGTON SOUTH, WHICH HAD BEEN RESERVED FOR PUBLIC ACCESS AND IS NO LONGER NEEDED WHEREAS, the Square at Kensington South, a subdivision in the City of Fort Collins, was approved by the City Council on March 27, 1979, contain- ing sixty-two single family lots, one of which (Lot 58) was reserved for future access to vacant property to the east thereof; and WHEREAS, the Council of the City of Fort Collins has determined that the City has no need for future access over and across Lot 58 of the Square at Kensington South and has further determined that any interest that the City may have in said Lot 58 is not used nor intended to be used for municipal purposes, nor secured for the purpose of being used for municipal purposes, and that it is in the best interest of the City of Fort Collins that the cloud) created on the title of said property as a result of said reservation be cleared by the execution by the Mayor of a quit claim deed therefor. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Mayor be and he hereby is authorized to execute a quit claim deed to Rex S. Miller, quit claiming any rights that the City may have to Lot 58, the Square at Kensington South, a subdivision in the City of Fort Collins, for the purpose of clearing the cloud that may exist upon the title of said property as a result of the aforesaid reservation. Passed and adopted at a regular meeting of the City Council held this 7th day of June, A.D. 1983. ATTEST: Citrk
