MEETING DATE: November 18, 2002
APPLICANT: Mrs. Lisa Lucero, McDonald's Corporation, 5251 D.T.C. Parkway,
Suite 30, Englewood, CO. 80111.
LAND USE DATA: Request to demolish the existing restaurant and rebuild a new restaurant
featuring a drive-thru lane with dual entrances and dual menu boards. The new restaurant would
be shifted to the south and feature an outdoor patio located between the street and building.
COMMENTS:
The site was originally developed and approved as a Planned Unit Development (P.U.D.)
under the Land Development Guidance System. In March of 1997, a new zoning code
was adopted referred to as the Land Use Code. The new zone is C-C, Community
Commercial which does not allow drive -through restaurants. The demolition and rebuild
would be permitted, however, as a Minor Amendment only so long as the new
development plan complies with the Land Use Code, at least to the extent of its original
compliance (so as to preclude any greater deviation from the standards of the Land Use
Code). There are no minimum parking requirements but maximum limitations so no
additional parking can be added over what is currently provided.
2. The build -to line standard requires that the building along W. Elizabeth be setback
between ten and 25 feet from property line. This means the building cannot be shifted
any further back from West Elizabeth than the current location as this would be a greater
deviation from the standard. There must be a direct connecting walkway linking the
public walk on to the building entrance without crossing a parking lot drive. The parking
lot must be landscaped, especially along the property lines. If any Modifications of
Standards are needed, then the request must be forwarded to the Planning and Zoning
Board either as a stand-alone Modification or in conjunction with the Project
Development Plan (P.D.P). Modifications cannot be processed as part of a Minor
Amendment.
Two menu boards are not allowed. The only way a second menu board would be
pemutted would be if the board is not visible from a public street or property line. If this
cannot be accomplished, then the second board is permitted only by a variance granted

In response the various comments, suggestions, and recommendations provided by Planning and Zoning,
Transportation Planning, Water and Wastewater, Stormwater, and Engineering, the following is offered:
PLANNING & ZONING (Ted Shepard);
1 A note was added to the Architectural Elevations (reference: Minor Amendment Plans, Drawings AE-1 & AE-2,
"Architectural Elevations") stating: "Signage shown on these drawings is shown for graphic representation only.
All proposed signage is subject to separate review and approval by the City of Fort Collins and may change in
size and/or appearance per the requirements of the necessary signage permit."
2 The McDonald's logo was removed from the "Gateway" sign (reference: Engineering Construction Plans,
Drawing CD-4, "Construction Details").
3 The proposed six-foot wood fence along the west property line is now shown on the landscape plan and the
multiple rows of planned shrubs were adjusted accordingly (reference: Minor Amendment Plans and
Engineering Construction Plans, Drawing L-1, "Landscape Plan").
4 One (1) two-inch caliper deciduous shade tree (an Imperial Honeylocust) was added along the west property
line (reference: Minor Amendment Plans and Engineering Construction Plans, Drawing L-1, "Landscape Plan").
5 The Key -Note legend regarding the Trash Enclosure was modified to note that the enclosure materials are
"cultured stone and E.I.F.S. to match main building" (reference: Minor Amendment Plans, Drawing SP-1, "Site
Plan" and Engineering Construction Plans, Drawing C-1, "Site Plan").
6 The "ghosted existing parking lot" (items that will be "removed" with this minor amendment) was eliminated from
the plans for clarity (reference: Minor Amendment Plans, Utility Construction Plans, and Engineering
Construction Plans, all impacted drawings).
7 The lighting consultant has reviewed the Site Lighting analysis and determined that they used a "higher
wattage" lamp in their analysis than what is proposed. The analysis was revised to reflect the fixtures
proposed. It is the intent that all of the existing site lighting fixtures, unless specifically noted to remain, will be
removed and replaced with those shown on the Site Lighting Plan (reference: Minor Amendment Plans,
Drawing SP-2, "Lighting Plan" and Engineering Construction Plans, Drawing C-4, "Lighting Plan").

TRANSPORTATION PLANNING (Thomas Reiff):
1 The construction within the W. Elizabeth Street right-of-way is limited to the removal of the existing sidewalk,
construction of the new detached sidewalk (with handicap accessible ramps at its intersection with the
driveways) and the western driveway curb on the east (reference: Minor Amendment Plans, Drawing SP-1,
"Site Plan" and Engineering Construction Plans, Drawing C-1, "Site Plan"),
2 A paved "temporary connection to the existing sidewalk" is shown on the western edge of the property
(reference: Minor Amendment Plans, Drawing SP-1, "Site Plan" and Engineering Construction Plans, Drawing
C-1, "Site Plan").
3 The key note legend #3 was revised to note: "Caution Watch for Bikes and Pedestrians" (reference: Minor

The proposed benches were relocated to be on top of the 10-foot concrete entry work (on the east side),
resulting in a total entry walk clear space of approximately eight -feet (reference: Minor Amendment Plans,
Drawing SP-1,'"Site Plan" and Engineering Construction Plans, Drawing C-1, "Site Plan").
WATER AND WASTEWATER (Jeff Hill):
1 The underground utility information shown on the Existing Conditions Map regarding an incorrectly labeled
sanitary sewer line (actually a storm line) was corrected (reference: Minor Amendment Plans, Utility
Construction Plan, and Engineering Construction Plans, Drawing ECM-1, "Existing Conditions Map").
2 The existing grease trap on the west side of the existing building within the existing drive-thru lane will be
removed (reference: Utility Construction Plans and Engineering Construction Plans, Drawing C-3, "Utility
Plan").
3 Comment was deleted from "Project Comment Sheet".
4 The water service was revised to remain perpendicular to the water main, and to provide the required minimum
10-foot separation from the sanitary sewer service line (reference: Utility Construction Plans and Engineering
Construction Plans, Drawing C-3, "Utility Plan").
5 The "non-standard" details for water and sewer were eliminated from the plan sets and replaced with City
Standard details (reference: Utility Construction Plans and Engineering Construction Plans, Drawing CD-2,
"Construction Details" and Drawing CSD-1, "City Standard Construction Details").
6 The proposed water service and sanitary sewer service lines are shown on the landscape plan and the "utility
separation note' was revised to state: "maintain a 10-foot separation between trees and water/sewer lines and
a 4-foot separation between shrubs and water/sewer lines" (reference: Minor Amendment Plans and
Engineering Conistruction Plans, Drawing L-3, "Landscape Plan").
7 The sanitary sewer service ceanouts are all labeled as "Traffic Rated Cleanouts (TRCO)" and a City Standard
Traffic Rated Cleanout detail (as provided) was included (reference: Utility Construction Plans and Engineering
Construction Plans, Drawing C-3, "Utility Plan" and Drawing CSD-1, "City Standard Construction Details").
8 The Construction Specifications regarding "Section 02600 Piped Utilities" was eliminated and a note stating:
"Refer to the City of Fort Collins Utilities Construction Specifications for Construction Requirements" as added
(reference: Engineering Construction Plans, Drawing CS-2, "Construction Specifications").
9 A Draft "Deed of Dedication for Easement" is attached for review. Once the location of the water service and
meter pit is approved by Fort Collins Utilities, the easement exhibit will be drafted by the project surveyor (ESC)
and provided for review.
10 The Utility Legend and line types used were modified to coincide. The note regarding the termination of the
existing water service connection was revised to state: "Existing water service to be abandoned...." The Utility
Notes were expanded to include information regarding the minimum/maximum bury depth of water service lines
and extension of the water service into the building's mechanical room (reference: Utility Construction Plans
and Engineering Construction Plans Drawing C-3, "Utility Plan").
STORMWATER (B. Haydl):
1 The existing storm manholes (that we previously incorrectly labeled as sanitary sewer manholes) are properly
called out and the key for storm lines in the legend matches the line -type used on the plans (reference: Minor
Amendment Plans, Utility Construction Plan, and Engineering Construction Plans, Drawing ECM-1, "Existing
Conditions Map').
2 The existing Canal Importation Floodplain, as delineated on the City of Fort Collins G.I.S. system (reference:
attached 8%2'xl1" printout) shown on the plans (reference: Minor Amendment Plans, Utility Construction Plans,
and Engineering Construction Plans, all impacted drawings). There is minimal work occurring within this
Floodplain, primarily concerning the installation of the new detached sidewalk along W. Elizabeth Street.
3 The "playground equipment" (which is actually the outdoor picnic table seating area) was removed from the
Grading Plans (reference: Utility Construction Plans and Engineering Construction Plans, Drawing C-2,
"Grading Plan").

4 As shown on the Grading Plan, there is actually a reduction in the amount of impervious area and an increase
in the amount of landscape area that will be realized by this minor amendment (reference: Utility Construction
Plans and Engineering Construction Plans, Drawing C-2, "Grading Plan"). Accordingly, no additional
stormwater mitigation is required.
5 This project is considered a minor amendment, not a redevelopment. Water quality will be improved since, as
noted previously, there is a reduction in the amount of impervious area and an increase in the amount of
landscape area that will be realized during this minor amendment.
6 City of Fort Collins Standard Details are provided (reference: Utility Construction Plans and Engineering
Construction Plans, Drawing CSD-1, "City Standard Construction Details").
ENGINEERING (Katie Moore):
1
Nine -feet of Right -of -Way dedication is planned for the W. Elizabeth Street Frontage, providing 49-feet of total
half -section right-of-way from the centerline of W. Elizabeth Street (reference: Minor Amendment Plans, Utility
Construction Plans, and Engineering Construction Plans, all impacted drawings). A Draft "Deed of Dedication
for Right -of -Way" is attached for format review. Once the formatting of this Draft is found acceptable, we will
have the project surveyor (ESC) prepare the necessary deed exhibits and submit for review and approval.

We have note heard from Ms. Moore regarding her research with the various utilities organization regarding the
need (or not, as we've discussed) for the 15-foot utility easement along W. Elizabeth Street. Currently, no
easement is proposed in this area.

The Reception Number for Parcel 1 (as shown on Drawing ECM-1, "Existing Conditions Map') was always
provided in the text of the description; however, we have moved the note to beginning of the legal description of
ease of review (reference: Minor Amendment Plans, Utility Construction Plans, and Engineering Construction
Plans, Drawing ECM-1, "Existing Conditions Map").

Two (2) City of Fort Collins Benchmarks (as researched by the project surveyor) are provided (reference: Minor
Amendment Plans, Utility Construction Plans, and Engineering Construction Plans, all impacted drawings).

The current month and year are provided below the legal description on the cover sheet. The site and building
data, the architect / lighting consultant / landscape designer's information was removed from the cover sheet.
The PE statement and indemnification statement was added to the cover sheet (reference: Utility Construction
Plans, Drawing U-TO1, "Cover Sheet").

The Site Plan, Landscaping Plan, Construction Specifications, and several of the Construction Detail Sheets
were eliminated from the Utility Construction Plans.

As you know, this project was recently presented to the Fort Collins Zoning Board of Appeals regarding the
quantity and size of the proposed menu boards (two boards versus the one allowed; 43 sf per sign versus the 38 sf
allowed). Although the ZBA did vote (unanimously) to approve the use of two menu boards, they did not (by a vote
of 3:2) allow an increase in the sign area. Mr. Wayne Bishop (Project Manager, McDonald's), working with
McDonald's marketing group, was internally authorized (by McDonald's) to proceed with a three -panel menu
board (instead of the corporate standard four -panel menu board), which reduces the square -footage per sign to an
amount less than the maximum allowed (reference: Engineering Construction Plans, Drawing CD-5, "Construction
Details"). We have discussed this, as you know, with Mr. Peter Barnes (Zoning Administrator, Fort
Collins.ZONING). No further action (or appeals) are being sought regarding this issue.
We trust these revised plans and the "explanation of modifications made" provided above are acceptable, and look
forward to receiving your approval to proceed with the construction of this minor amendment soon. As you know,
we have already submitted the Building Permit Application (and fee) to the Mr. Rick Lee (Commercial Plans
Reviewer, Ft. Collins.BLDG DPT) for his review as well as the Engineering Construction Drawings to Poudre Valley
Fire Department for their review. As you know, McDonald's is anxious to proceed with this minor amendment
while the Colorado State University students are on their summer holiday, allowing them to finish construction and
reopen for business close to the beginning of the University's fall term. Any assistance you can provide in helping
to expedite this approval would be rg eaq appreciated. Thanks!

The following is offered in response to the comments, suggestions, and recommendations presented in your July
28, 2003 "Minor Amendment Comment Sheet":
The completed (signed, notarized, and certified by McDonald's Corporation) DEED OF DEDICATION FOR
RIGHT-OF-WAY documents are enclosed dedicating the requisite nine -feet of right-of-way along W. Elizabeth
Street. With this dedication, a minimum of 49-feet of right-of-way from the centerline of Elizabeth Street is
provided along this frontage. The area of dedication is clearly shown and labeled on the utility plans.
It does not appear the you have received any additional information from your utilities group regarding the need
for an additional 15-foot utility easement along the W. Elizabeth Street frontage. Accordingly, this easement is
not provided.
Per our discussions with the Mr. Dennis Striegal (Survey Manager, Engineering Services Corporation), it
appears from review of the Title Commitment that the parking and utility easement along this site's eastern
boundary was prepared during the platting of this lot from within the Town Square. As such, the reception

number, as noted, is the same as the "Parcel 1" reception number noted in the legal description provided on
drawing ECM-1, "Existing Conditions Map'.
• A signature line for the owner of the property to the north (Mr. Oliver McBryan) is provided since minor changes
within the existing "utility, drainage, and access easement" are planned. Further, as you know, we have
coordinated with Mr. McBryan to provide him with drawings of this area. We will coordinate again with Mr.
McBryan once we are authorized (by you) to prepare the requisite mylar reproducibles of enclosed drawings to
obtain his "acknowledgment" sign -off.
• The "PE Statement", as detailed in the appendices of the Larimer County Urban Area Street Standards is
included on the Cover Sheet.
• The new right-of-way is clearly shown, labeled, and dimensioned on the Utility Plans.
• We apologize for the previous printing of the plans that tended to "blend" the various "pen weights" used. We
trust the enclosed documents distinguish between proposed and existing elements in a clearer fashion.
• The existing sidewalk and driveway radius within the dedicated right-of-way, which will be removed as part of
this redevelopment, are shown and labeled as "to be removed."
• The width of the proposed detached sidewalk is labeled on the Utility Plans.
• The proposed temporary driveway radius (for the eastern driveway) will be 15-feet. It is our understanding from
Transportation Engineering that this curbline may be removed during the City's W. Elizabeth Street
reconstruction project. The radius is labeled on the Utility Plans.
• Although currently shown on the Site Plan, the additional concrete between the new and existing sidewalks on
the west edge of the property (to provide a connection between the two) is now also shown on the Utility Plans.
• The information shown on the Plat for The Lofts at Campus West was utilized to update the "background"
easement, etc.. information for the area north of the project site.
• The "detached sidewalk and vertical curb & gutter' detail (Larimer County Drawing 1602) was included on
Drawing CSD-1, "City Standard Construction Details". The former "attached sidewalk" detail was eliminated.
• Detail #4, "General Notes" on drawing CD-1, "Construction Details" was eliminated.
• A note was added to Drawing CD-3 & CD-6, "Construction Details" that states: "The details provided on this
sheet are for on -site use only and are not to be used within the R.O.W. of West Elizabeth Street. Refer to
Sheet CSD-1, 'City Standard Details' for details to be used within the R.O.W. of West Elizabeth Street."

maximum extent feasible.) For further information regarding the variance procedure,

4. The source for electrical power is an existing underground oval vault. If this vault is
relocated, then it would be at the developer's expense. The vault must be protected
during construction. If the existing is transformer is to be relocated, then this too will be
at the developer's expense. Be sure that the transformer is within ten feet of hard surface
for emergency change out. If the existing panel size is insufficient, then the net
incremental increase is subject to all normal development charges. A Commercial One
("C-1") Form must be completed by a licensed electrical contractor. Please refer to the
hand-out, available from Light and Power, describing the development fees and charges.
Street trees in the parkway strip must be kept 40 feet from streetlights. Ornamental trees
must be kept 15 feet from streetlights. For further information, please contact Bruce
Vogel, 221-6700.
5. This site is in the Spring Creek drainage basin where the new development fee is
$2,175/acre which would be applicable if there is an increase in imperviousness greater
than 350 square feet. The drainage and erosion control report will need to address the
imperviousness and drainage patterns. They need to be maintained unless there is a
problem that needs to be corrected. The report and grading plan must be prepared by a
professional engineer registered in Colorado.
6. Redevelopment is required to treat the runoff. Extended detention is the recommended
method. Please contact -Kevin McBride at 224-6023 for other possible methods.
7. The site is on Stormwater inventory map #5I. A copy of the map can be obtained from
the Utilities office at 700 Wood Street. No onsite water quantity detention is required as
long as there is no increase in imperviousness greater than 350 square feet. Elizabeth
Street is a floodplain and moving the building towards the street could be problematic.
The building needs to be 18 inches above the 100-year floodplain elevation. Floodplain
encroachment cannot cause a rise in water surface elevation. For further information,

8. Parking lot detention is limited to a maximum of 12 inches of depth. Water quality
extended detention is required to treat the runoff. This detention must be in a pervious
area, not the parking lot. For further information, please contact Glen Schlueter, 221-

9. There is an existing 8-inch water main and an existing 8-inch sanitary sewer main in
Elizabeth. In addition, there is an 8-inch sanitary sewer in the private access drive north
and east of the building. If there is an increase in tap size, then the plant investment fees
will be for the net increase over what is existing. A grease interceptor is required. For

10. The site will be served by the Poudre Fire Authority. The address must be clearly visible
from West Elizabeth Street. A fire protection system is required for the hood and duct
system. All portions of the exterior of the building must be within 150 feet of West
Elizabeth Street. If this cannot be accomplished, then an automatic fire extinguishing
system must be installed. If fire lanes are provided, then they must be dedicated as public
emergency access easements. For further information, please contact Ron Gonzales, 221-

11. Please contact Matt Baker, 221-6605, to determine whether or not the Street Oversizing
Fee and the Latimer County Road Fee will apply. Since these fees are based on building
square footage, the fee would only apply to the net increase over existing
12. A Transportation Impact Study will be required which will address all modes. Check
with Eric Bracke, 221-6630, to determine the scope of the study, or if the study is even
required.
13. The right-of-way for Elizabeth Street is 98 feet. McDonald's is responsible for
dedicating a sufficient amount of land so that there is 49 feet of half -width as measured
from the centerline of the street to the property line. In addition, a 15-foot wide utility
easement is required beyond property line. Please be cautioned that any construction
activity off -site will require an easement from the property owner.
14. Public improvements shall comply with Latimer County Urban Area Street Standards.
One of these requirements is that the first parking stall must be setback from Elizabeth
Street by 100 feet as measured from face of curb. This engineering standard may be
varied in accordance with the administrative procedures. As such, this type of variance is
processed at the Staff level and does not go to the Zoning Board of Appeals or the
Planning and Zoning Board.
15. West Elizabeth is scheduled for design and construction of a number of improvements to
address pedestrian safety and convenience. This will include improvements to the
sidewalks, landscape and amenities (such as street furniture). The consulting firms will
be B.H.A. Design and Sear Brown which will start design work in a few weeks. Staff
will suggest that the firms prioritize the area along McDonald's to accommodate the
schedule. Public improvements are expected to be constructed in 2004. The City's
project manager is Tom Reiff, 416-2040.
16. Close coordination will be required among the City, the consulting firms and
McDonald's. At this time, the City is undecided as to whether the walk will be attached
or detached. The driveway radius has yet to be determined. Work in the public right-of-
way should be designed to the ultimate so re -work is not required. Public improvements
that are installed ahead of the City's schedule will be eligible for reimbursement. Or, the
value of the work may be paid into an escrow. These issues will need to be discussed and
then codified in the Development Agreement.

17. Utility Plans will be needed at the time of submittal. A Development Agreement will be
required prior to recording final documents. A Development Construction Permit will be
required prior to beginning site work. For further information, please contact Katy
Moore, 221-6605.
18. Be sure to provide bike parking near the customer entrance.
19. There are existing trees on the site. Please contact Tim Buchanan, City Forester, 221-
6351, to determine the value of these trees. Some trees may be worth preserving. For
those trees with value that are removed for construction, there shall be mitigation based
on the findings of the City Forester in accordance with Section 3.2.1(F) of the Land Use
Code. For those trees that are to be preserved, there will need to be protective barriers
during construction and appropriate buffer for after construction. In addition, tree
protection notes must be placed on the Landscape Plan and Utility Plans.
20. The construction phase will require a Fugitive Dust Permit from the Latimer County
Health Department if the property is under construction for over a certain period . Also,
trash enclosures should be sized to accommodate various containers for recycling. A
single trash hauler should be used. An Ecological Characterization Study will not be
needed. For further information on natural resource issues, please contact Doug Moore,
at 221-6750.
21. Be sure to apply for a Demolition Permit prior to removal of the existing structure.
22. For an estimate of the Capital Improvement Expansion Fee, payable at the time of
building permit issuance, please contact the Building Inspection Division, 221-6760.
This fee is adjusted annually.
23. The architectural character of the building must conform to the standards in Section 3.5.1
and 3.5.3 of the Land Use Code. We look forward to working with McDonald's on the
design and appearance of the new structure.

The above mentioned drawings address the City of Fort Collins previous submittal comments dated

4. A sign reading "Caution Watch for Bikes and Pedestrians" has been added to the west driveway.
