ORDINANCE NO. 11E 1991
OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING A PORTION OF THE SOUTH COLLEGE AVENUE FRONTAGE ROAD
RIGHT-OF-WAY ON THE COLLEGE MOTORS P.U.D.
WHEREAS, the Planning and Zoning Board of the City of Fort Collins has
approved the Foothills Auto Plaza P.U.D. and the accompanying plat entitled
"Moreland Subdivision Being a Replat of Lot 1, Moreland P.U.D. and a Part of
College Motors P.U.D."; and
WHEREAS, approval of said replat has made it necessary and desirable that
the City vacate a portion of the South College Avenue Frontage Road right-of-
way previously dedicated by the plat of the College Motors P.U.D. and more
particularly described below; and
WHEREAS, City agencies, the Colorado State Highway Department and private
utility companies have been contacted and report no objection to the proposed
vacation; and
WHEREAS, there will be no cost to the City in making the proposed vacation;
and
WHEREAS, the rights of the residents of the City of Fort Collins will not
be prejudiced or injured by the vacation of said street right-of-way.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that a portion of the frontage road right-of-way on the College Motors P.U.D.,
more particularly described as follows to wit:
A frontage road situate in College Motors P.U.D., City of Fort Collins,
County of Larimer, State of Colorado, which begins at the Northeast corner
of College Motors P.U.D. and runs thence S 00' 05' 00" E 300.00 feet along
the East line of said P.U.D.; thence N 89' 55' 45" W 50.00 feet; thence
N 00° 05' 00" W 300.00 feet; thence S 89' 55' 45" E 50.00 feet to the
point of beginning, containing 15,000 square feet more or less
be, and the same hereby is, vacated, abated, and abolished, subject to the
following reservations of easements and rights -of -way:
1) A right-of-way for sidewalk and parkway purposes described as
follows, to wit:
A tract of land located in the northeast one quarter of
Section 35, Township 7 North, Range 69 West of the Sixth
Principal Meridian, City of Fort Collins, Larimer County,
Colorado, also being located in the Frontage Road situate in
the Plat of College Motors P.U.D., a plat of record with the
Clerk and Recorder of the said Larimer County, more
particularly described as follows;
Considering the east line of the above described plat as
bearing South 00 degrees 05 minutes 00 seconds East and with
all bearings contained herein relative thereto;

Commencing at the northeast corner of the said plat, also
being the TRUE POINT OF BEGINNING of this description;
THENCE along the said east line, South 00 degrees 05
minutes 00 seconds East for a distance of 300.00 feet to the
south line of the said plat;
THENCE along the said south line, North 89 degrees 55
minutes 45 seconds West for a distance of 14.00 feet to a line
which is 14.00 feet (measured at right angles) west of and
parallel with the said east line;
THENCE along the said parallel line, North 00 degrees
05 minutes 00 seconds West for a distance of 300.00 feet to
the north line of the said plat;
THENCE along the said north line, South 89 degrees 55
minutes 45 seconds East for a distance of 14.00 feet to the
point of beginning.
The above described tract contains 4200 square feet and is
together with and subject to covenants, easements, and
restrictions of record.
2) An easement for utility purposes described as follows, to wit:
A tract of land located in the northeast one quarter of
Section 35, Township 7 North, Range 69 West of the Sixth
Principal Meridian, City of Fort Collins, Larimer County,
Colorado, also being located in the Frontage Road situate in
the Plat of College Motors P.U.D., a plat of record with the
Clerk and Recorder of the said Larimer County, more
particularly described as follows;

all bearings contained herein relative thereto;

THENCE along the north line of the said plat, North 89

west of and parallel with the said east line and to the TRUE
POINT OF BEGINNING of this description;
THENCE along the said parallel line, South 00 degrees
05 minutes 00 seconds East for a distance of 300.00 feet to
the south line of the said plat;
THENCE along the said south line, North 89 degrees 55
minutes 45 seconds West for a distance of 12.00 feet to a line
which is 26.00 feet (measured at right angles) west of and
parallel with the said east line of the plat;

05 minutes 00 seconds West for a distance of 198.00 feet;
THENCE North 89 degrees 55 minutes 45 seconds West for
a distance of 24.00 feet to the west line of the said frontage
road;
THENCE along the said west line, North 00 degrees 05
minutes 00 seconds West for a distance of 10.00 feet;
THENCE South 89 degrees 55 minutes 45 seconds East for
a distance of 24.00 feet to the said line being 26.00 feet
west of and parallel with the said east line of the Frontage
Road;
THENCE along the said parallel line, North 00 degrees
05 minutes 00 seconds West for a distance of 92.00 feet to the
north line of the said plat;
THENCE along the said north line, South 89 degrees 55
minutes 45 seconds East for a distance of 12.00 feet to the
point of beginning.
The above described tract contains 3840 square feet and is
together with and subject to covenants, easements, and
restrictions of record.
3) An easement for general public access described as follows, to
wit:
Two tracts of land located in the northeast one quarter of
Section 35, Township 7 North, Range 69 West of the Sixth
Principal Meridian, City of Fort Collins, Larimer County,
Colorado, also being located in the Frontage Road situate in
the Plat of College Motors P.U.D., a plat of record with the
Clerk and Recorder of the said Larimer County, more
particularly described as follows;
Considering the east line of the above described plat as
bearing South 00 degrees 05 minutes 00 seconds East and with
all bearings contained herein relative thereto;
Commencing at the northeast corner of the said plat;
THENCE along the north line of the said plat, North 89
degrees 55 minutes 45 seconds West for a distance of 26.00
feet to a line which is 26.00 feet (measured at right angles)
west of and parallel with the said east line, and to the TRUE
POINT OF BEGINNING of this description;
THENCE along the said parallel line, South 00 degrees
05 minutes 00 seconds East 2.00 feet;
THENCE along a curve to the right having a radius of
74.00 feet an arc length of 56.85 feet, and a central angle
of 44 degrees 01 minutes 00 seconds being subtended by a chord
of South 21 degrees 55 minutes 30 seconds West for a distance
of 55.46 feet;
THENCE along a curve to the left having a radius of
50.00 feet an arc length of 4.88 feet, and a central angle of
05 degrees 35 minutes 43 seconds being subtended by a chord
of South 41 degrees 08 minutes 08 seconds West for a distance
of 4.88 feet to the west line of the said Frontage Road;
THENCE along the said west line, North 00 degrees 05
minutes 00 seconds West for a distance of 57.16 feet to the
said north line of the plat;
THENCE along the said north line, South 89 degrees 55
minutes 45 seconds East 24.00 feet to the point of beginning.
Containing 955 square feet.

the above described basis of bearings;

feet to a line which is 14.00 feet (measured at right angles)

TRUE POINT OF BEGINNING of this description;
THENCE continuing along the said parallel line, North

a distance of 36.00 feet to the said west line of the Frontage
Road;
