V m WHEREAS, Section 2- 353 (4) of the Code of the City of Fort Collins r-1 authorizes the Planning and Zoning Board to vacate certain easements by $ m resolution or by approval of replats containing notation of such vacation; and WMm Waw WHEREAS, the Owner has requested that the City vacate portions of a ten foot utility easement adjacent to lot 36 in the Pinnacle Townhomes Replat, which �w m m easement vacation is more particularly described on Exhibits "A" and "B"; and �rc a N o a w w WHEREAS, the vacation has been reviewed and approved by the m LL pertinent utility service providers, which providers report no objection to the m " vacation. Y m -O N O 1 Z w NOW, THEREFORE, be it resolved by the Planning and Zoning Board of N a the City of Fort Collins, that the portions of the ten foot utility easement adjacent to lot 36 of the Pinnacle Townhomes, Replat, located South of East Prospect Road and West of South Lemay Avenue, and more particularly described on Exhibits "A" and "B", attached hereto and incorporated herein by this reference, are hereby vacated. Passed and adopted at a regular meeting of the Planning and Zoning Board this 20'h day of February, A.
