OF THE PLANNING AND ZONING BOARD
OF THE CITY OF FORT COLLINS
VACATING A PORTION OF A FIFTEEN (15) FOOT UTILITY AND
DRAINAGE EASEMENT DEDICATED AT THE NORTHEAST CORNER
OF LOT 5 OF THE CENTRE FOR ADVANCED TECHNOLOGY
P.U.D., SECOND FILING
WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the
Planning and Zoning Board to vacate certain rights -of -way, by resolution or by approval
of replats containing notation of such vacation; and
WHEREAS, the Owner of Lot 5 of the Centre for Advanced Technology has
requested that the City vacate a portion of a fifteen (15) foot utility and drainage easement
dedicated on Lot 5 of the Centre for Advanced Technology or more particularly described
below; and
WHEREAS, the vacation request has been reviewed and approved by the pertinent
City and private utilities, and they report no objections.
NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City
of Fort Collins, that a portion of the fifteen (15) foot utility and drainage easement dedicated
on Lot 5 of the Centre for Advanced Technology more particularly described on Exhibit "A",
attached hereto and incorporated herein by its reference, be and hereby is vacated.
Passed and adopted at a regular meeting of the Planning and Zoning Board of the
City of Fort Collins held this 19th day of November A.D. 1998.

DESCRIPTION FOR A PORTION OF A 15' DRAINAGE AND UTILITY EASEMENT
TO BE VACATED:
A portion of a 15' Drainage and Utility Easement to be vacated in Lot 5, Centre for
Advanced Technology P.U.D., Second Filing Replat, Section 23, Township 7 North,
Range 69 West of the 6th Principal Meridian, City of Fort Collins, County of Larimer,
State of Colorado, being more particularly described as follows:
Considering the East line of Lot 5, Centre for Advanced Technology P.U.D., Second
Filing Replat as bearing South 00'15'22" West and with all bearings contained herein
relative thereto:
Commencing at the Northeast Comer of said Lot 5, thence along said East line, South
00°15'22" West, 60.00 feet; thence departing said East line, North 89°44'38" West, 6.00
feet to the POINT OF BEGINTN NTG; Thence, North 89°44'38" West, 9.00 feet; thence,
North 00°15'22" East, 38.14 feet; thence, South 89°44'38" East, 6.13 feet; thence, South
00°15'22" West, 7.99 feet; thence, South 89°44'38" East, 2.87 feet; thence, South
0095'22" West, 30.15 feet to the Point of Beginning.
The above described tract of land contains 320 square feet more or less and is subject to
all easements and rights -of -way now on record or existing.
