w w WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the
w Planning and Zoning Board to vacate certain easements, by resolution or by approval of

WHEREAS, the Owner of Lot 30 of Brittany Knolls P.U.D., 2nd Filing has requested
E' that the City vacate an eight (8) foot utility easement that runs along the north property line

U WHEREAS, the vacation request has been reviewed and approved by the pertinent

o NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City
of Fort Collins, that the eight (8) foot utility easement that runs along the north property line
of Lot 30 of Brittany Knolls P.U.D., 2nd Filing, which easement is more particularly

Lot 30 which bears S 89' 01' 02" E 6.00 feet from the Northwest comer of said Lot 30 and run
thence along the said North lime, S 89' 0 P 02" E 79.27 feet and again along the arc of a 15.00

VACATING PORTIONS OF THE UTILITY
EASEMENT ON TRACT "A" OF BRITTANY KNOLLS PUD, FILING NO. 2
WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the
Planning and Zoning Board to vacate certain easements, by resolution or by approval of
replats containing notation of such vacation; and
WHEREAS, the Owner has requested that the City vacate portions of the utility
easement on Tract A of Brittany Knolls PUD, Filing No. 2, which proposed vacation is
more particularly described on Exhibit "A", and
WHEREAS, the vacation request has been reviewed and approved by the pertinent
City and private utilities, and they report no objections.
NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City
of Fort Collins that certain portions of the utility easement on Tract A of Brittany Knolls
PUD, Filing No. 2, which portions of the easement are more particularly described on
Exhibit "A", attached hereto and incorporated herein by this reference, are hereby
vacated.
Passed and adopted at a regular meeting of the Planning and Zoning Board of the
City of Fort Collins Iheld this 30th day of October A.D. 2003.
