ORDINANCE NO. 155, 1987
OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING ALL EASEMENTS PLATTED WITH THE BELAIR P.U.D.
WHEREAS, the Council of the City of Fort Collins has been petitioned
by the Developer of Regency P.U.D. to vacate all utility, access and
drainage easements on Lots 1 through 14 as platted within the Belair P.U.D.
more particularly described below; and
WHEREAS, the Developer has replatted a portion of the Belair P.U.D.
property, which portion is now known as Regency P.U.D., which was approved
by the Planning and Zoning Board on July 22, 1987; and
WHEREAS, all necessary utility easements and rights -of -way have been
dedicated with the Regency P.U.D. Replat to serve this property; and
WHEREAS, City agencies and utility companies have been contacted and
report no problems with the blanket vacation; and
WHEREAS, there will be no cost to the City in making the proposed
change in the easements and the rights -of -way; and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be prejudiced or injured by said vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that all utility, access and drainage easements platted within Lots
1 through 14, Belair P.U.D., recorded with the Larimer County Clerk and
Recorder more particularly described as follows, to wit:
BELAIR P.U.D., being a replat of Harmony West P.U.D. First
Filing, located in the Southeast Quarter of Section 34, Township
7 North, Range 69 West of the 6th P.M., City of Fort Collins,
Larimer County, State of Colorado.
be, and the same hereby are vacated, abated and abolished.
Introduced, considered favorably on first reading, and ordered
published this 6th day of October, A.D. 1987, and to be/presented for final
passage on the 20th day of October, A.D. 1987.
