OF THE DIRECTOR OF COMMUNITY PLANNING AND ENVIROMENTAL
SERVICES OF THE CITY OF FORT COLLINS
ACCEPTING THE ASSIGNMENT OF AN ACCESS EASEMENT ON
CENTERPOINT, SECOND FILING
WHEREAS, Section 2.1.5 of the Land Use Code of the City of Fort Collins
authorizes the Director of Community Planning and Environmental Services to accept
dedication of certain easements by resolution or by approval of replats containing notation
of such dedication, and
WHEREAS, Gypro Properties LLC has presented to the City a deed of assignment
for an access easement located on the real property known as Centerpoint, Second Filing,
which easement is more particularly described below; and
WHEREAS, the assignment has been reviewed and approved by the pertinent City
Departments, which departments report no objections to the assignment.
NOW, THEREFORE, be it resolved by the Director of Planning and Environmental
Services of the City of Fort Collins, that the "Assignment of Access Easement' assigning
and conveying an access easement to the City on Centerpoint, Second Filing, which
assignment is attached hereto and incorporated herein by this reference, is hereby
accepted.
Passed and adopted by the Director of Community Planning and Environmental

ASSIGNMENT OF PERMANENT ACCESS EASEMENT
The undersigned Gypro Properties LLC, whose principal business address is 1400 E. 62nd
Avenue, Denver, Colorado, 30216 ("Grantor"), in consideration of Ten Dollars (S10.00)
in hand paid, receipt of which is hereby acknowledged, and other good and valuable
consideration, does hereby assign all of its rights, title and interest in that Permanent
Access Easement over and through Centerpoint, Second Filing, City of Fort Collins,
County of Larimer, State of Colorado, recorded on July 7, 2003 at Reception No.
20030035306 of the records of the Larimer County Clerk and Recorder, to the CITY OF
FORT COLLINS. COLORADO, a municipal corporation ("Grantee") for the purpose of
establishing a public right-of-way provided that the obligations of maintenance of the
Permanent Access Easement within such easement shall be with the owner of record of
Lot 2, Centerpoint Plaza, Fort Collins. Larimer County Colorado.

This Easement is granted to Epicenter Development, Inc., whose address is 1625 Pelican
Lakes Point, #201, Windsor, Colorado 80550.'Dv Larimer County, Colorado; apolitical
subdivision of the State of Colc.-ado ('Owner") for the purposes and upon the conditions stated
below.

1. Description of Easement- The easement granted by these presents is attached
hereto as Exh-ibit "A".
Term of Easement. This easement shall be pe-,maaeat and non-exclusive.
3. Purpose of Easement. Improvement, maintenance and use of the subject proper,
for access.
4. Consideration. Ten do'lars (S10.00) and other good and valuable consideration.
5. _Warranty. The Owner warrants that it is the owner in fee simple of the easement
premises and will defend title thereto against all claims adverse to this easement.
6. Reservation of Rights. The Owner reserves all rights in and to the subject
Property including the right of rossession except for those necessary to carry out this easement.
