RE: Revised Street Section on Willox Lane at College Avenue
Dear Don:
Attached are two copies of the revised street plan for Willox
Lane. The changes reflect a five foot shift in the south flow
line from College Avenue to the first entrance into the
shopping center. Also the island for the traffic signal is
shown.
These changes were requested by Joe Rice and Roy Bingman. The
change was made necessary by the possible problem of obtaining
the required right of way on the north side of the street.
Also note the addition of the three driveway entrances into the
shopping center.
These prints also reflect a field change in the pipe location at
the intersection of Blue Spruce Drive and Willox Lane. The
change was required due to conflict with the sewer line at the
intersection. The sewer had to be raised one foot vertically
to clear the 27" diameter Greeley water line.
I also am submitting the revised drawings of Redwood Street
reflecting the changes your department requested to our original
drawing. The drawing now reflects 2-36" pipes to carry Dry
Creek under Redwood Street and 2 catch basins to pick up the
storm runoff in the low point in Redwood Street.
If you have any questions, please call me. I would appreciate
your returning one copy with your approval.

Park Development
Dear Don:
Evergreen Park, a joint venture, has asked VTN to advise
you that some temporary grading of Dry Creek will be done
along that portion of the property adjacent to Dry Creek
and under the ownership of Evergreen Park. This grading
will be done to accommodate flow from the storm sewer
outflow at Blue Spruce Drive and Conifer Street.
The land adjacent to Dry Creek is presently unplatted.
At such time as this land is platted half of the required
drainage easement for Dry Creek will be granted by Evergreen
Park. The property to the south of Dry Creek is also
unplatted to our knowledge at this time. It is our
understanding that since Dry Creek is approximately the
boundary fo-r the two parcels that both property owners
will contribute half of the required easement.
This letter is to advise of our planned grading on our
property but that it is not an intent to accommodate
the total drainage easement on our property.

RE: Box culvert at Lake Canal and Redwood Street.
Dear Larry:
Upon review of the proposed box culvert to carry the Lake Canal irrigation
under Redwood Street, it is recommended that the culvert be shortened
2'-6" on each side, and the sidewalk be 6'-0" wide from the back of
the curb to the headwall.
It .is our feeling that any backfill material on the bridge deck, as
suggested, would most probably erode away. Also this leaves a prime
entrance for water to get between the sidewalk and bridge deck to cause
probable frost heave, whereas with a full width sidewalk these probab-
ilities are greatly reduced.
Once the revision has been made on the originals we suggest that John D.
Hartman, Lake Canal Ditch president sign the plans. They should then
be submitted for the Fort Collins City Engineer's signature.

Dear Mr. Lusche:
In response to your request for information, construction work on the
following improvements must be completed before the City of Fort Collins can
issue any building permits on the Evergreen Park Subdivision:
1. Sanitary Sewer - The entire sewer system must be installed as
shown on utility plans and must be inspected and approved.
2. Water Mains, Fire Hydrants - With regard to the water main in
general, it will not be possible to activate only that section which would serve
the areas on Willox and the north end of Blue Spruce. The whole of North College
Avenue is served by a six-inch water main. It would place too great a burden
on this small main if it were to feed the twelve -inch main on Willox in Evergreen
Park. Therefore„ the only possible source of water to Evergreen Park is from
Vine Street at the south end of the project. This means that the entire Evergreen
Park water system will have to be tested and approved.
At present this would include lowering that portion of the main on Conifer
roughly between sanitary sewer manholes #12 and #13. Also to be lowered is the
section of main on Blue Spruce from Conifer to a point roughly adjacent to
manhole #15.
Because the City was not notified when CPL Constructors lowered portions
of the water main on Redwood Street south of Conifer, the main there will have
to be exposed in several places to show that it is bedded properly and is at the
required depth. Also, the water main on Redwood north of Conifer will have to
be exposed at several locations to show that it has the required 4-1/2 feet of cover.
A valve at the intersection of Blue Spruce and Conifer inadvertently left
out during original construction must be installed.

One reason for the City's 4-1/2' minimum cover requirement on water mains
is to prevent damage during winter months due to freezing. The entire water system
in Evergreen Park will necessarily be "live" to feed the north end of the
project. In south portions of the project streets have been cut; and when they
are based and paved, there will be 4-1/2 feet of cover on the main. At present,
however, there is insufficient cover to insure that freeze damage will not occur.
It will be necessary to develop all the streets in the subdivision to the point
where this type of damage can be prevented.
3. Streets - Any portion of Evergreen Park in which building permits are
to be issued must be provided with a based access road.
4. Storm Sewers - All storm sewers must be in as shown on the utility
plan, and must be inspected and approved.
As you know the installation of sanitary sewer, storm sewer, and water
mains is essentially complete. All that remains is to correct the problems with
the water mein, to inspect for approval all the underground utilities mentioned,
and to complete the street work as outlined. If I can be of further assistance
please call.

RE: Sewer Line in Blue Spruce Drive - Evergreen Park
Dear Mr. Zakely:
This will confirm our telephone conversation with you on the above
date concerning improperly constructed grade on the above referenced
line.
We understand your position is that the sewer line must be relaid from
a point just north of the Greeley water line to manhole #20 at the
intersection of Blue Spruce Drive and Willox. Further, that you feel
that the slope on the relaid sewer line should be 0.40% as designed
at the time the Greeley water line was encountered.
Grade calculations under the above conditions indicate a cover of
approximately 3.9 feet from top of sewer line to finish street grade
will result in Blue Spruce Drive. We further understand that the
relaid sewer line to the above requirements having the indicated cover
would be acceptable to you.
At the request of the developer (Evergreen Park), we are, by copy of
this letter, requesting the contractor to correct this line accordingly.
If you have any questions, please advise.

RE: Evergreen Park Sewer Inspection
�n incident occurred February 28, 1975, that I feel should be brought to
y tir attention so you will have the facts at hand if any questions are raised
about it. On February 27, 1975, Thursday, Joe, 1Ianuel, and I began inspecting
the sanitary sewer main at Evergreen Park. After checking approximately half of
the system we informed the contractor, CPL Constructors, that the line was dirty
enough that it should he cleaned with their sewer jet before we would continue
with the inspection. This sewer jet has a self contained water tank which must
he filled periodically as water is used in flushing operations.
The morning of February 28, Friday, 9:00 A.A., I discovered CPL filling
their tank from an existing fire hydrant on N. College Avenue. They had not asked
any of the inspectors for permission to do this, so I immediately contacted Bruce
Fisher of the llater Department by phone. told him what CPL was doing, and asked
if they had been given permission from the Rater Department to draw water from
that hydrant, unmetered. Bruce told me that a 6Vater Department crew foreman, Ed
Batty, had also found CPL using the hydrant that morning and had called Ed
Hilgenherg by radio to ask if they had gotten permission from him. Bruce said
further that Ed 11ilgenberg had informed Ed. Batty on the radio that yes, they
did li�ive permission to use the hydrant, they wore drawing water to flush the sewer
main at Evergreen Park. Because of this information I received from Bruce,
I thought no more of the incident.
That same afternoon .Joe Eccher was in Ed H:ilgenberg's office to see him about
another matter. In the course of their conversation Ed asked .Joe which of the
inspectors had given CPL permission to draw water from a hydrant on N. College.
Ed also said that whoever had "was in trouble with him", or similar words to
that effect.
I have subsequently checked with Bruce Fisher, Ed Batty, and CPL Constructors.
CPL told me they had asked Ed Hi.lgenberg for permission to use the hydrant before
they did use it. Ed Battv told me that he did in fact contact Ed Hilgenberg by
radio the morning of February 28, and that Ed hi.lgenherg told him that CPL had
received permission to use the hydrant, unmetered. Bruce Fisher was at a complete
loss to explain Ed Ililgenberg's remarks to Joe.
I cannot understand tor. Hilgenberg's attitude or his reasoning when he discussed
the matter with Joe the afternoon of February 28th. 1. can only conclude that it
was a misguided attempt to confuse or to discredit the inspectors, and his remarks
were obviously unwarranted. I sincerely ]lope that further incidents of this
nature can be avoided.

I have your letter of March 5, 1975, concerning the sanitary sewer main on
Blue Spruce Drive in Evergreen Park. It states that the sewer main from a point
just north of the Greeley water line to manhole #20 will be relaid, and that
your calculations indicate that when this work is done a minimum 0.40% grade
will. he maintained with a resulting 3.9 feet of cover from the top of the pipe
to the final finished grade of the street.
City of Fort Collins Specifications for Construction of Sanitary Sewer
Mains require a minimum slope of 0.401 slope on 8" size mains, and the minimum
cover rcquireme�at from the top of the pipe to the finished street grade is
3.5 feet. Your figures fall within these limits, and the City will accept the
relaid sewer in the area specified if it is constructed in accordance with the
data you have provided. We will also require that an engineers drawing showing
the changes for this portion of the sanitary sewer be submitted to the City
Engineer's office at your earliest convenience.

The Code of the City of Fort Collins requires that the following improvements
shall be completed prior to the issuance of a building permit:
1. Survey Monuments. The subdivider shall provide survey monuments
as required by city specifications.
2. Sanitary sewers. The subdivider shall provide adequate lines and
stubs to each lot.
3. Water mains. The subdivider shall provide adequate mains and
stubs -to each lot.
4. Fire hydrants. The subdivider shall provide sufficient fire
hydrants as required according to city specifications.
S. Storm drainage. The subdivider shall provide storm sewers,
culverts, and bridges where required.
6. Streets and alleys. Streets and alleys shall be graded and
base construction completed.
In the case of the Medical Center bui di.n� n Evergreen Park, if the construc-
tion access will be Willox Lane, a footing,,permi can be issued if the following
work is complete: The water main on Willox must be repaired and pressure tested.
When this section of water main will hold pressure, the water main system in
Evergreen Park which feeds Willox, Blue Spruce, and Bristlecone must be chlorinated
to disinfect the installed pipe.
A full building permit can be issued for the medical center when the sanitary
sewer system on Blue Spruce Drive is brought to proper grade and a minor leak
repaired in the outfall line, which will allow the system to flow into existing
city lines.

Before any building permits on the Sundance Hills development in Evergreen
Park can be issued the following improvements must be completed and approved by
the City:
1. The sanitary sewer main on Blue Spruce Drive from a point just north
of the Greeley water main to manhole number 20 must be relaid to the
correct grade. In addition a minor leak in the Evergreen Park sewer
outfal.l line must be repaired so that the system can be allowed to
flow into an existing City sewer.
2. The water main on Willox Lane must be repaired and pressure tested
and the water mains serving the north end of the Evergreen Park
Development chlorinated for disinfection of the pipe.
3. The sewer and water systems indicated on the Sundance Hills utility
plan mast be constructed and approved.
4. The 21" C.M.P. must be installed under Sundance Circle North.
S. Blue Spruce Drive adjacent to the development and Sundance Circle
North must be based.
Other improvements are required in accordance with the City Code before the
buildings may be occupied.
Its we indicated to you yesterday at the site, the City will be willing to
make an acception because of your funding problem at the present time. We could
issue the building permits now if you agree in writing not to begin any building
construction until the above listed public improvements are constructed and
approved.

I am writing to request your consideration of a problem which has arisen in rela-
tionship to Sundance Hills, a condominium project located at the Evergreen Park
project.
Some misunderstanding on our part about the sequence of events concerning install-
ing certain utilities before a building permit can be issued has recently been
clarified for us by Don Parsons. I refer you to a letter dated March 21, 1975
from Don Parsons to myself. This ruling and clarification from Don places our
firm under severe hardships in completing the project. To date, we have expended
large amounts of cash in the planning and development of the project. The costs
are increasing daily until construction can begin.
It is our understanding that the construction sequence as contained in the code
for subdivisions is the code being used for our P.U.D. One of the reasons we
proceeded with the P.U.D. instead of a subdivision was to take advantage of
certain aspects of a P.U.D. in relation to our condominiums. The main advantage
is the fact that development and construction loans are combined. Lenders have
traditionally required the development to be completed before funds for construc-
tion of the units could be loaned. Since no saleable lots (as in subdivisions)
could be given as collateral lenders grew increasingly wary of such development
loans. The normal P.U.D. ordinances provide a means whereby developers can
totally plan and construct a project instead of piecemeal as described above.
Lenders are more willing to loan on an entire prrject instead of the above proce-
dure of piecemeal lending. Advantages to the developer include low loan fees,
usually lower interest charges, and considerable construction cost savings. These
costs, if not saved, have to be passed on to the consumer. It has always been
the policy of this firm to provide excellent low-cost housing and the P.U.D. prac-
tices are one way to incur cost savings to pass on to the consumer. To use subdivi-
sion construction codes for P.U.D.s defeats many of the practicalities and advan-
tages of P.U.D. ordinances. It is our opinion that a P.U.D. project includes both
land and buildinc[s. Subdivisions deal with land only.

In the planning of this project we have worked closely with your planning depart-
ment staff and have cheerfully incorporated all of their ideas and suggestions
into our project. We concur with all of your city's policies and programs. Yet,
in this instance, we find that we must ask that you consider a special variance
so as to allow us to close the loan commitments available to us. If the utilities
and roads are necessary to obtain foundation and footing permits and simultaneous
utility and foundation construction is not allowed our costs will increase by
about 160. Such a cost increase will cause our firm to reconsider the advisability
of continuing or not.
We therefore ask that we be granted footing and foundation permits on all of
Sundance Hills and be allowed to simultaneously construct said foundations and
footings and utilities and roads and curbs and gutters. We feel that a change
should be considered in that a separate code should be adopted for P.U.D.s. We
offer our assistance in exploring such a code or will assist you in any manner
you feel we could be of assistance.
Please contact us at your earliest convenience with your decision on our request.
We appreciate any help you can give us. Our intentions are not deceitful in
this request because it has been our intention to provide a worthwhile project to
the north area of Fort Collins. Our commitment to that area is total. I am an
incorporator and director of the new bank. We are building a 23,000 square foot
medical building and plan a second office building of like size. As you can see
our interest in Fort Collins is great. We appreciate the help given to us so
far and hope your considerations will be in the interest of both of us.

Pursuant to your request to redesign the above referenced
streets, WE! have made a cursory check of the proposed align-
ment shift and made a cost estimate to engineer the following
changes:
1. Calculate the new street alignment, prepare a
legal description of the old and new street
alignment, and draft both on a drawing for the
City of Fort Collins to use in vacating and
replating.
2. Redesign and draft the street plan and profile
sheets effec�cd by the changes. It should alter
only (3) sheets.
3. Revise sewer and water system and adjust any
significant quantity changes.
4. Submit the revised streets to the City of Ft.
Collins for reviei, and approval.
5. Administration and coordination necessary to
process the above.
VTN will perform the above functions for a lump sum fee of
$600.00. The work can be performed (excluding review by Ft.
Collins) ire approximately one week after receiving authorization
to proceed.
It is also my understanding that a similar alignment change will
be required on Willox Lane at College Avenue. This change would
require the same functions noted above except there is no sewer
involved and only two sheets are involved. I discussed this

In regard to drainage, we will adequately ditch and bank to carry water
away from the area of Willox Lane and Blue Spruce using the vacant field
downgrade to the southeast. If water should pond, we will tie drainage
into our existing underground drain system manhole in that area.
It is our understanding that this procedure will allow final occupancy permits
to be issued to Miller as required about year end. Evergreen Park will then
assure you of completion of streets in this loop and the storm drain system

The purpose of this letter is to bring to the attention of those parties
involved certain public improvements to be constructed prior to the release
of a Certificate of Occupancy (C.O.) for the Medical Facility presently under
construction at the southwest corner of �'dillox Lane and Blue Spruce Drive in
the City of Fort Collins.
In cider to provide adequate traffic circulation and flow, the following
street improvements are to be constructed:
1. Paving on College Avenue, to provide an adequate right -turn
condition for northbound traffic turning on Willox Lane.
2. Willox Lane shall be constructed with curb, gutter, sidewalk,
and paving, from College -.venue to Blue Spruce Drive. Blue
Spruce Drive shall have all street improvements constructed from
Willox Lane to either Bristlecone Drive or Conifer Street.
3. Depending on item #12, the street improvements for either Bristle -
cone Drive or Conifer Street shall be constructed from Blue Spruce
Drive to College Avenue.
In conjunction with the street improvements and development for the Medical
Facility site, consideration should. be given to the storm water runoff and
control. Being at the upper end of the Evergreen Park drainage system it is
apparent that the entire storm drainage system: must be constructed in order
that it be functional for the medical facility.

preliminary engineering cost that we have incurred to date for the relocation
of our facilities in Evergreen Park. We have submitted numerous billings to
Evergreen Park but have not received any response concerning payment. The
total cost incurred to date is $12,263.69, and we have applied the $10,000.00
construction advance we collected for the relocation of these facilities which
leaves $2,263.69 due. I am submitting this billing to the City of Fort Collins
under our agreement guaranteeing payment to Poudre Valley between Evergreen
Park and the City of Fort Collins.
I am also enclosing a copy of a letter we have written to the Planning and
Zoning Board requesting that the second filing of Evergreen Park be tabled
until such time arrangements have been made and easements granted by the
developer to Poudre Valley for the relocation of our facilities. The Zoning
Board approved the preliminary plat, and it appears that we possibly are going
to have the same problems in the second filing that we experienced in the first.
Because of the time required of the City's and Poudre Valley's staff, we believe
it would be in the City's and Poudre Valley's best interest that the developer
be required to work out the problems prior to platting.
If there are any questions concerning the enclosed bills, I would be more than
happy to go over this matter with you or someone from your staff.

This is written as a follow up to the meeting held in our offices concerning
Evergreen.Park Subdivision and the proposed alignment of the Fort Collins Central
Expressway.
You were concerned with the access to the property lying south of the proposed
Expressway. Enclosed please find a 'xerox''copy of the awri.al photograph on
display in our office showing the approximate alignment of the Expressway through
the Evergreen Park area.. As you will note, the Division is proposing an inter-
change at College Avenue. The southerly right-of-way line of the Expressway has
left: sufficient room for an access road to the properties which lie east of College
and south of the proposed Expressway.
The Division has no plans for providing for a crossing of Rodwood, whether
at -grade or grade separation. The Division does plan to provide for a grade
separation at I_elTay Avenue (Li ndenmeir Lake Road) and East Vine Drive (not shown) .
In either of the above, there are no plans for egress and ingress to the proposed
Expressway.
The Division had a land transaction with Mr. Lyle Carpenter, who had interests
in Evergreen Pail, to provide access to East Vine Drive via the hror�osed Redwood
Street.
In July of 1.976, this office met with representatives of Evergreen Park and
the City of Fort Collins in order to come to some agreement as to a corridor for
the Expressway. This was a result of the developers wishing to obtain the City's
approval of the plat of the Second Filing. The Division, after a series of meet-
ings, agreed to the location as shown on the enclosure. The developer, Evergreen
Park (a ,joint venture), was represented by Mr. Lyle Carpenter. He requested that
the then proposed alignment be changed and was agreeable to the enclosed. He was
also agreeable that the developer would be responsible for providing access to
the properties on either side of the revised alignment.

Dear Brian:
I have had a conference with Roy Bingman and we have
reviewed the City files in more detail in connection with
the plans for subdivision improvements on Evergreen Park.
We have located an old utility agreement dated April 19,
1973, concerning this subdivision, and I am enclosing a copy
of the same. I have reviewed this agreement and rote that
the agreement requires the subdivider to pay all costs of
street improvements. I have also reviewed the City's sub-
division ordinance, and I enclose herewith a copy of Section
99-6 of the City ordinance which pertains to the obligation
of a subdivider to install street improvements and the
situations under which the City will participate. You will
note that City participation is limited to arterial and
collector streets. The only streets in Evergreen Park which
are classified as collector streets are Willox Lane and
Redwood Street. None of the streets in Evergreen Park are
classified as arterials. Even in the case of collector
streets, the City's participation is limited to the participa-
tion provided for in Section 16-20 of the City Code relating
to installation of streets under a local improvement district.
I also -inclose that section in the form in effect in 1973
when the agreement was signed, and you will note that this
limits City participation to the cost involved in a greater
paving width than 60 feet. I understand that none of the
streets in Evergreen Park will have a pavement width greater
than 60 feat.

Submitted herewith are preliminary plans for a 24" water transmission line for
the East Larimer County Water District in the vicinity of Evergreen Park
between North College Avenue and North Lemay Avenue. It is requested that
the City review these plans for acceptance of the proposed location so as
not to delay further design of this project. The present schedule for this
project indicates that construction will not take place until late fall
or winter due to other factors. However, approval of the final location
of this water line is of timely importance.
A meeting was held with Mr. Morey Rupple on June 8 regarding the location
of this water line. He had no great concern for the location as proposed,
however, he did indicate that Mountain Bell proposes a telephone cable
south of the Conifer Street right-of-way between College Avenue and
Redwood Street, also the State Highway Department proposes a by-pass
through this area. These items will be taken into consideration during
final design of this water line.

immediately. Our contractors are being delayed now because of our

Mr.. Kost and I visited the site and agreed with 11arc Engeroen that the
best interest of all parties would be served by moving the pole from within

together the various storm drainage studies and plans which have been
submitted on the referenced subdivisions.
The Storm Drainage Engineers have also reviewed the studies which were
prepared by another developer for the proposed 4th and 5th Filings of
Evergreen Park as well as the subdivision to the northeast (Greenbrier
P.U.D.).
The Storm Drainage Engineers have concluded that the original drainage
design for the First Filing is inadequate by todays standards. Due to
the fact 1--hat the facilities for the First Filing have never been
completed,, no additional building permits within this Filing will be
permitted until adequate acilities ar-e-7esi� anconstructec Tn
Filing No,. 2, building permits and C.O.'s will be permitted at the
presently relatively slow development rate within Watershed No. 1 (the
east portion). However, due to the fact that Watershed No. 1 (the west -
portion) has no suitable storm water outlet, no building permits will
be permitted there until suitable facilities are constructed for that
portion of Filing No. 2. Building permits for lots 18 and 19 in Filing
No. 3 will be permitted when the addendum to the subdivision agreement
is signed and an arrangement is made for the completion of the detention
pond within Filing 3.
Mr. carpenter, in view of all the drainage questions within Evergreen
Park and lts drainage basins, we suggest that you arrange a meeting with
our Drainage Engineers, you and your engineer to chile all the existing
studies into one master study for your area which will meet the City's
needs.

The subject subdivision has been a difficult one to maintain
any semblance of orderly development since its inception in
the mid 70's. Conversely, it is an area which the City has
tried to encourage development to try to slow the "trend
to the south".
We are having extreme difficulties trying to get the Developer
to answer telephone calls or respond to correspondence.
He has sold lots to builders who have built homes and/or
dwelling units, some of whom we have had to withhold certificates
of occupancy due to lack of completion of improvements within
the public right-of-way. The builder is the "scapegoat" in
that he is led to believe the Developer will complete the
improvements in time for him to get a certificate of occupancy
and our building and construction inspectors are really put
"on the soot" since the only enforcement tool we have is the
building permit or certificate of occupancy.
Due to lack of completion of improvements, (listed on attached
sheet) we have shut-off certificates of occupancy in Filings
1, 2 and. 3. This has caused severe financial hardship on some
builder: and our building and construction inspection departments
are under severe criticism for "doing their job".
Can you exert any pressure to require the Developer to either
completE! his obligations or come in to negotiate revised
agreements so that our inspection departments can perform
their duties while still maintaining some semblance of order?

Dear Mr. Rupel:
As you are aware, in 1980 Evergreen Park agreed to employ
engineers to design a master drainage plan for what was called
the Evergreen Park Basin. The purpose of this private under-
taking was to prevent the long delays necessitated by the City
advertising for bids, setting improvement districts, issuing
bonds cr arranging other methods of payment before the work
could he commenced. It was our understanding that the immediate
development of such a plan assisted the City of Fort Collins in
meeting the requirements of the National Flood Plain Act.
As a part of those meetings, and the agreement to proceed with
such a plan, it was agreed that the City of Fort Collins would
develop some sort of a reimbursement plan in which surrounding
property owners would be assessed or would be required to pay
drainage fees to pay for their beneficial interest in costs of
their porportionate share of land, canals, ditches, ponds and
other structures and improvements involved in this development.
As of this date, the drainage plan has been submitted for over
one year and we have not been advised of its acceptability or
approval. We request that written approval be given. Further,
we have heard nothing regarding a reimbursement plan and would
request that a written response be made to that request.

1) The fire hydrant located at the intersection
of Blue Spruce Drive and Conifer Street has been
shifted from the NW corner to the NE corner.
Bob, Mike and I agreed this would have no critical
effect on fire hydrant spacing and VTN will reflect
the change on an as -built print.
2) VTN will submit the revised street design at Redwood
Street and Dry Creek for your review. The design
shall reflect 2-36" diameter CMP under Redwood.
Mike has requested sufficient clearance between
the existing 15" sewer and 12" water lines and
finished street grade to allow for future upgrading
of the Dry Creek ditch. This appears to be no
problem.
3) Mike McDill will confirm by letter the sub -base
requirements by the City of Fort Collins for all
streets on the Evergreen Park Project, excluding
College Avenue widening which is controlled by the
State Highway Department Permit (3" mat, 4" of 3/4"
surface, and 8" of base material.)
4) Due to the conflict of the existing 6" gasline with
the 27" Greeley waterline located in Blue Spruce

This letter is to summarize our meeting on the 18th of May between
yourself, Mauri P.upel, and myself regarding storm drainage in Evergreen
Park. In particular, two items were discussed which were:
1. Alteration of the gradation of the Rock Trickle Channel
as shown in the detail on sheet 2/9 of the plans titled
"Major Storm Drainageway for Evergreen Park."
2. The effect of leaving the �xisting power pole as exists
within the limits of Pond OA as shown on sheet 7/9 of the
plans titled "Major Storm Drainageway for Evergreen Park."
The gradation of cobbles originally specified on sheet 2/9 called for
an average size of 12" equivalent diameter stones. As shown in our
meeting, a reduction to a 6" D50 gradation of cobblestones will be ade-
quate for the velocities in the channels as designed. An approximate
gradation is as follows:

This change in gradation applies only to the Trickle Channel as an
option to the Concrete Trickle Pan Locations. Also, as shown on the
attached detail A, the channel sideslopes will be extended over the
edges of the rock pan to minimize problems due to vandalism.
It is desired by the developer not to relocate the existing power
pole within Pond #OA adjacent to Conifer Street. As shown in the attached
detail B, the pole, guy wire, and access way were left at existing grade
to determine what storage volume would be lost. A top width of 15 feet
and 4 to 1 side slopes were used as the requirements for the peninsula
into the pond. This peninsula reduces the volume of the pond below the
100 W.S. elevation of 4955.3 by 6900 C.F. In evaluating the available
volume on the pond as exists, as -built elevations taken in Conifer Street
indicate an additional 5600 C.F. of available storage at the 100 year
water surface elevation of 4955.3. The resulting loss of volume of
1300 C.F. is equal to a rise in the 100 year water surface elevation of
0.0093 feet. This information is shown in Table A. Therefore, the
power pole and access way can remain within the limits of Pond #OA with-
out any notable adverse affects to the ponds operation.

At your request I have checked into the status of the underground utilities
servicing the Evergreen Park 1st Filing Development. Through my visual
inspection of this site, I believe all of the water and sanitary sewer main
lines have been installed, and some storm sewer lines have been installed
at the southern end of the project. However, these lines have been out of
use for many years and the City reserves the right to check these systems
and require repairs which may be necessary in order for the systems to
function properly.
In response to your question regarding the issuance of building permits for
this project, there are certain City code requirements which need to be met
prior to Engineering releasing its hold on any permits. For your
information, I have enclosed a copy of the applicable code requirements.
Please be informed that a storm drainage report will need to be submitted
to Mr. Glen Schleuter of the Storm Drainage Department, for the type of
development which may occur on this site. This report should be submitted
during the planning stages of the building layouts inorder to avoid

Section 3.5.1(J)(1) states that "No areas for outdoor storage, trash collection or
compaction, loading or other such uses shall be located within twenty (20) feet of
any public street, public sidewalk or internal pedestrian way."
In order to comply with this Code requirement, the fence and the outdoor storage
area must be located at least 20 feet from the edge of the sidewalk.
Section 3.8.9(C) which specifies that chain link fencing with or without slats may
not be used as a fencing material for screening purposes. Therefore, in order
to comply with the standard, landscaped elements must be provided in conjunc-
tion with a screen panel, arbor, garden wall, privacy fence or security fence to
avoid the visual effect created by unattractive screening or security fences
(Section 3.2.1(E)(1)(d)). It is staff's opinion that the plan that was submitted
does not comply with Section 3.2.1(E)(1)(d)).
The Planning and Zoning Board of the City of Fort Collins is empowered to grant
modifications to the standards in the Land Use Code. To approve a modification
request, the Planning and Zoning Board applies specific criteria outlined in Sec-
tion 2.7.3(A-C) which is attached for your reference. Any request for a modifica-
tion should be made in writing and demonstrate how these criteria are met. The
standards for which a modification request could be made are Section
3.5.1(J)(1) and Section 3.8.9(C).

A request for alternative compliance for Section 3.2.1(E)(1)(d) may be submitted
as well. The alternative compliance request is similar to the modification re-
quest, however it is specific to the landscape requirements and how they are ap-
plied to this particular project. Any request for an alternative landscape and tree
protection plan must comply with the standards of Section 3.2.1(N) which is at-
tached. Again, this request must be made in writing as well.
