This will confirm the discussion we had at our meeting
on February 26, 1980.
I am pleased to advise that the eight foot wide concrete
drainage pan and four foot wide concrete trickle channel for
the detention pond in Eastborough Subdivision have been
installed. Flatiron Paving will accomplish the remaining
earth work on the detention pond as soon as weather conditions
allow.
I would request that the amount being held by the City
for the drainage pan and trickle pan, being $3,066.00, be
authorized for release so the contractor can be paid.
It is my understanding that the current progress on
completion of the detention facility along with the money
still held by the City to ensure the remaining work ensure
the continued issuance of building and occupancy permits in
the subdivision.
If you would like verification from Flatiron concerning
the performance of the remaining earth work, I would be
happy to provide such.
Upon Flatiron's completion of the earth work, I will
have the small amount of required sidewalk installed and
have the detention area seeded.

Dear Mr. McCabe:
The following is in regard to the detention facility in the Eastborough
development.
The City has received numerous complaints from citizens in the neighborhood
about the state the pond is in. These neighbors are complaining about the
weeds, the stagnant water, and mosquitoes in and around the pond. Several
of these people live next to the pond itself.
Late last fall, Dave Stringer and myself met with you and discussed the
pond's completion, its repair, and the issuance of a building permit for
lot 135 at 2818 Fauborough Court. At that time you assured us you would
have the pond completed in the near future. Previous to that time, in
correspondence dated February 28, 1980 to Mr. Maurice Rupel, you again
stated the pond would be completed by Flatiron Paving Company as soon as
weather permitting. To date, no progress toward the completion of the pond
has been made.
As you aria aware, the City has acted in good faith on this matter. This is
reflected by the facts that: (1) According to the subdivision agreement,
the detention pond should have been completed by July 1, 1978; (2) The
City has issued 119 building permits and 118 certificates of occupancy for
the subdivision; and (3) Last year the City cleaned debris from the
concrete trickle pan.
Effective immediately, no additional or new building permits or certifi-
cates of occupancy will be issued until the matter is resolved. Also, in
accordance with Chapter 79, "Nuisances", of the City Code, if in thirty
(30) days after receipt of this correspondence no progress is made in

correcting the matter, the City may proceed in correcting the matter and
bill you upon completion.

RE: Special Weed Assessment - Tract "A" Eastborough Subdivision
In July of 1977 the Eastborough Subdivision was approved
for development. A part of the approval process was the
stipulation that a detention pond be constructed in Tract A
of that subdivision.
Inadvertently when the plat was recorded for the subdivision
Tract A was not dedicated to the City.
In 1982 thru the weed or sanitation program, the weeds were
mowed by a private contractor. This mowing resulted in a
special weed assessment on the parcel in the amount of
approximately $426.00.
Since the tract should have been recorded as public property,
with this correspondence I am requesting the special weed
assessment be removed from this parcel.

Concerning Tract -A, Eastborough Sub, and agreement reached at the meet-
ing with Larimer County and Fort Collins City government officials, the
following _information is presented for your review and comment. The
Larimer County Assessor has started abatement process for the years 1978
through 19.92, inclusive. However; the Larimer County Treasurer cannot
concur because of the need to satisfy tax sale certificate holders that
are involved. in the normal process of redemption, the tax payer must
reimburse the money that has been paid by the certificate holder, along
with any accrued interest and fees. These certificate holders must have
their investment returned to them before the abatement process can be
finalized. The total amount of interest and fees due to the certificate
holders is $298.13. This total has been arrived at by compiling the
following figures:
1978 Interest - $55.31 Advertising Fees - $26.91
1979 Interest - 39.89 Title Search - 35.00
1980 Interest - 69.19 Certified Letters 24.80
1981 Interest - 37.03 Recording Fees - 6.00
Treasurer's Fees - 4.00

In the normal process, the City of Fort Collins should pay the interest

On the 16th of November, 1977, we attempted for the second time to make
a final inspection of the sanitary sewer mains in your Eastborough Subdivision.
It was immediately apparent that the infiltration of goundwater into the lower
portions of this sewer was far above the acceptable limits as stated in our
Sanitary Sewer specifications.
We are currently using our weir to determine the amounts of infiltration
in these sections for our records, but we will be unable to make further inspec-
tions of the main or issue acceptance notification to the Water and Sewer
Department until this leakage has been stopped or lowered within acceptable
limits.

A recent inspection of the sanitary sewer main in the East -
borough Subdivision indicates a major infiltration problem in the
area of the intersection of Eindborough and Oxborough. Specifically
the pipeline from Manhole No. 21 into Manhole No. 26 is flowing
almost half full of groundwater.
This main was installed by your company and currently is within
the one-year guarantee period. Please take steps to make any and
all repairs necessary to the Eastborough Subdivision sewer mains
at your earliest convenience. If you will contact this office
our inspectors will help you in whatever way possible. Any delay
in making necessary repairs could jeopardize the issuance of build-
ing permits in the area.

Dear Harry:
This letter will confirm our recent discussions regarding the status
of improvements on Eastborough Subdivision. As I indicated, there
are several items associated with public health and safety which can
not be included in an escrow account. These are: (1) raising all
valve -boxes and manholes within the subdivision, and (2) providing a
temporary swale through the easement between the catch basin on Lemay
and Eastborough Drive in order to relieve the ponding on Lemay.
No additional building permits or certificates of occupancy will be
issued for structures within this subdivision prior to the completion
of these :improvements.
The remaining earthwork on the detention pond, the concrete trickle
channel and walks, and the permanent drainage facility between Lemay
and Eastborough Drive are the improvements included in the escrow
account. I have received your request for the oversizing repayments
on Centennial and Len -ay including the applicable bills. Once I have
completed a review of these requests, I will initiate a purchase order
through the Finance DepartTent for the appropriate amount withholding
an amount equal to 150 percent of the estimated cost of the remaining
improvements. These funds will be released upon completion of the
improvements subject to the approval of the City Engineer.
Finally, the detention facilities will be monitored through the coming
year in order to evaluate the groundwater conditions. It is our under-
standing that if some additional work is required to alleviate such
groundwater problems, that �,x)rk will be undertaken at your expense upon
request by the City Engineer.
