PLANNING OBJECTIVES
Located at the center of a rapidly urbanizing Fort Collins, Creger Plaza
is afforded exceptionally good access to the region. Direct proximity to
Harmony Road, Horsetooth Road, and College Avenue provides optimum accessi-
bility to and from major roads and activity centers.
This proposal is for an 80,000 square foot neighborhood shopping center
including, as a major tenant, an Albertson's Food Market. Also planned
are retail, restaurant and office uses. The proposed 41,384 square foot
Albertson's store will be the largest shopping facility in the city of Fort
Collins with special features that will equal or exceed the competition in
town, and the added drawing power of Target and LaBelles under construction
one half mile south, should help the proposed Albertson's serve the area
better.
The extension of Mason Street and McClelland Drive and a possible crossing
of the C & S Railroad provide direct access to a number of new residential
market areas. These include: the Woodlands, Larkborough, Chism, Park South,
and Foothills Park. It is estimated that 50% of the market for this center
will be from the south and west of the site, thereby minimizing the traffic
impact on College Avenue. The property zoning at present permits freestanding
commercia'; uses. Consolidating the _ises into a neighborhood shopping center
planned unit development, as proposed, will reduce the traffic volume generation
on the adjacent streets, and thereby, minimize traffic conflicts and the impact
on traffic operations.
Precedent is important both in terms of understanding the natural market forces
which caused existing development and in anticipating requests for future uses
of the land. Land use planning must. take into consideration the level and
timing of market support for the various types of real estate developments.
All the current competition within the primary trade area is located on Colleye
Avenue, causing market shares to decline rapidly north of the proposed site.
Currently, there are an estimated 8,850 people per store, thus showing that the
trade area is capable of supporting another retail shopping facility.
ENGINF.MDC SERVICES
1. d. Prepare preliminary layouts, sketches and reports,
where needed and make appropriate recommendations.
e. Prepare preliminary cost estimates.
2. Design Phase
To include conferences with the client, approval
and regulatory authorities, as well as necessary
basic data required to design the project, the
preparations of specifications, contract documents,
and estimates. All the necessary construction
drawings and required approvals are also included.
TERMS AND CCNDITIONS
The following terms and conditions apply to this proposal
as submitted.
1. The Engineer does not guarantee estimated construction
costs. These costs will be determined by bidding
procedures.
2. This proposal and related fees are limited to the
Preliminary Phase; however the Design Phase is included
under Engineering Services to help in the continuity
of the work effort. The Client then may proceed beyond
the Preliminary Phase with the Engineer by extension of
the initial agreement at the pleasure of the Client.
3. Fees as quoted are for calendar year 1978. Should the
work extend into another year, the Engineer reserves the
right to renegotiate these fees.
4. Work done by others, such as reconnaissance surveys, will
be billed as special services and are not included in
our estimate of fees.
5. Any item of work not specifically included under Engineering
Services will be billed as Additional Services of the Engineer
at our normal hourly rate.

Gentlemen:
This is to confirm a meeting held in Dr. Collopy's office Tuesday,
April 18, 1978. The subject of this meeting was to discuss the
extension of Mason Street South of Horsetooth Road, which includes
crossing an existing pond. This pond area represents some drainage
problems, which are the subject of a proposal prepared by our office.
The resulting study would address the alternatives for providing
drainage through the properties to the South of the pond.
The proposed location of Mason Street was discussed, and it was
agreed that the 200 feet to 250 feet depth to the rail road right
of way is optimal.
Dr..Collopy indicated the possible relocation of the New Mercer
Ditch to the West side of the rail road. This is being studied.
Emphasis was placed on the advantages of working as a group to
achieve individual objectives. It was brought out that particularly
in the fringe near the city limits,this may be the key to gaining
cooperation with the city and county.
Harry Cornell is to discuss the ditch relocation and drainage
conditions with the engineers at M & I. In addition, a subsequent
meeting with all affected property owners was believed to be desireable.

This will confirm a meeting held at our office Friday, April 14, 1978
concerning the pond which is common to each of your properties on
south College Avenue.
We have prepared a proposal which addresses the problem of extending
Mason Street and reclaiming the pond. This proposal was the primary
subject of discussion.
Those present discussed the following during the course of the meeting:
1. :Property o mers to the south should be contacted relative
to participation in the study, and any resulting construction.
;Peid Rosenthal agreed to make these contacts.
2. The group considered the need for an agreement expressed by
Reid Rosenthal for the Creger Plaza Project. Those property
a,mers adjacent to the pond would in effect agree to accept
storm water in the pond from the Creger Plaza Project until
such time outfall drainage can be provided. It was pointed
out that the project will not be developed until the year
1980 - - This agreement is necessary for city approval.

plans. Although we signed the plans, we need these corrections before

(1) In alkases, change Reid Lane to McClelland Drive.
(2) SHEET 2:: Radii at Horsetooth-McClelland must be 20' rather
than 10'; add following rote at temporary cul-de-sec-
"temporary cul-de-sac to be construction with street
section identical to local street section. Install
asphalt curb with flowline to facillitate drainage and
provide rip -rap at outlet."

Several or the property owners in the NE4 of Section 35, T7N, R69W, east
of C & S Railroad, have joined together in contract with this office
to study drainage and detention alternatives for their properties which
currently contain a natural drainage depression with no surface outlet.
The property owners desire to commercially develop this area.
A feasibility report of drainage and detention was prepared for the
landowner:3. The report contained several alternatives for drainage and
detention. Based on economics and the community development
implications of the various alternatives it was the strong desire of the
larndowners to facilitate drainage via a storm sewer located immediately
west of College Avenue and discharging into 'fail Creek south of Harmony
Road. Detention would be handled by providing shallow storage areas in
parking lots. A storm sewer sized to convey the two-year natural dis-
charr;e was considered to be the most economical in terms of construction
costs and land utilization. For this 35-acre site, a 30-inch diameter
storm sewer was appropriate. See enclosure for vicinity sketch.
The location of a storm sewer along College Avenue has several advantages.
Not only was it found to be the cheapest of the methods studied, but its
location eriables utilization by adjacent developing properties. This
is seen to be a distinct advantage in order to result in facilities useful
to the community at large, rather than resulting in piecemeal facilities
which would probably be less cost-effective. I£ a multi -property storm
sewer was planned, its size should be increased accordingly and its
funding should be similarly distributed among the participants. Other
advantages are that its planned route is currently undeveloped, so no
major construction complication would exist; it does not require a
crossing of College Avenue, and it requires the least depth of cut of any
method studied.
Because of the features, it is strongly recommended that the City consider
this alternative for storm drainage in this area, not only as a single -
purpose structure but as a neighborhood -wide facility.

It was agreed that Cornell. Consulting would do the design of the

drafted, and the project put to bid.
The proposal has attempted to accomodate both traffic and pedestrians
and incorporate landscaping as an amenity to the center as well as to the
streetscape. Textured paving crosswalks have been introduced to facilitate
people crossing traffic, and to slow thru traffic. A parking to building
ratio of 5 cars per thousand square feet has been illustrated and with the
mixed uses, would appear to be adequate, especially considering the "cross -
shopping" concept of a neighborhood center. The proposed Albertson's will
be of wood, textured block and stucco construction, providing an architecturally
pleasing facade. With architectural and landscaping control on the ent-'re
project, this proposal provides an effective as well as a necessary and
desirable land use.

In order to allow immediate development of the Troutman's property,
Cornell consented to relavin(the grade and size of the tile of Troutman
P<-irk,o),ay by Y-)n(by, the 18th of September, 1978. 'I'his information will
passed to M & I Engineerina forthwith. It was also agreed that
constniction of; the line would take place from the point of beginning
outlined in th-> M & I Dlans for the Troutman Property, and will be con}-
M41L_ pleted to its exit at(?a__ Creek. The cost of this stretch of line,
less the cost of the line already proposed by the Troutman property,
��r)uld be borne by the other South College property owners. It was agreed
thaa upon acceptance of final. bids for the project, a legally drawn pro-
rata acreage agrr,:rtent woald be signed by all parties.
Mauri R-Lpel., from, City Rngineering, said that imder no circumstances
would the City permit any type of permanent lift station due to on-
going costs and maintervalnce responsibilities. He also stated his desire
regarding cooperation between all the property owners on one drainage
line. Louie swift of the New P,Iercer Ditch Company conmented that he
could see no problems with the proposed line, and that in fact, it was
Ix)ssible thaat the New Mercer Ditch Ccvpany did not exercise control_ of
that particular stretch of Creek in anv event.

The one question left unanswered at the meeting was the inclusion of
Park South :s a participant in this line. It was determined that Louie
Swift and Kauri F�uple would decide if Park South did indeed have permission
IT) dl-zq) their detention water into the New Mercer Ditch, or if in fact,
Park So::h should participate in this drainage line. It was emm)hasized
that tine was of the essence in this decision as the inclusion of Park
South would obviously necessitate a line of larger diameter and thereby
affect final engineering. -,he other alternatives discussed at the meeting, ,
including running the drainage line down the easa-ment toCreek, were
disallowed due to the (Treat expense of cut, the minimtun slope problem
in the line, and the possibility of sub -grade outfall at .N12yo Creek. It
was acrr_eed by :Al present that the property owners lying south of the

by the City that their ;approval of any plans for store detention on those
sites was contingent upon the connection of a line such as this proposed.

Enclosed please find our engineer's sketch of the proposed
location of the storm drainage line which will serve property
owners on South College between Horsetooth and Harmony Roads.
You will notice that the drain is within fifteen feet of South
College Avenue at all times with the exception of the radius of
the two corners at Harmony Road and College Avenue where the
line is placed more than fifteen feet from the road but still
within the State Highway Department right-of-way. In addition,
the:line is approximately forty feet from College Avenue on the
south side of harmony Road until it outfalls in Mayo Creek
drainage. The main reason for this location of the line in your
southern property is the great increase in depth entailed in
placement within fifteen feet of College Avenue. If you remember,
the contours of your land is such that the ground rises rather
sharply from the location of the line to College Avenue. To
place the line within fifteen feet of College Avenue at this
location would entail much extra time and expense. It was our
feelings that in all probability, because of the location of
Mayo Creek and the existing contour of land, that you would be
placing parking and fulfilling green space requirements in that
forty feet sometime in the future, be it yourself or another
developer that finally improves the property.
In addition please be advised that the cost will be divided
on a pro-rata acreage basis. It is assumed that the costs will
not be above, and may in fact, be substantially lower than $2,000
per acre. In any event, it is our group's decision that you will

be responsible for the pro-rata acreage share for your property
to the north of Harmony Road upon the tap in to the line or in
four years, which ever is sooner. Your property line to the
south of Harmony Road, because it has natural drainage to Mayo
Creek, will. not be asked to participate in the cost of this
drain line.
I would appreciate a phone call from you no later than Friday
of this week as work has already begun on the LaBelles and Target
sites and time is of the essence to all the property owners within
the mile.
As I stated to you on the phone, Paul, it is my feeling that
cooperation between the property owners within this mile can only
serve to heighten the values of all property within the section.
I might point out, too, that the City will issue no final approvals
on any development plans for any property located within this mile
of ground unless they have indicated their willingness to join in
a collective effort for this one drainage line which is, unfortunately,
a necessary item to us all.
In addition, I think that over the long run every property served
by this drainage line will be saving a great deal of time and expense
through lessened detention pond requirements and far less overlot
grading and', drainage plans.

SUBJECT: McClelland Drive Interceptor Storrs Sewer
The Storm Drainage Engineer and the Development Engineer have
reviewed plans and drainage calculations for the subject project.
We are unanimous in our opinions that the subject design is the
best solution for the removal of storm waters from Creager Plaza,
Fossil Creek Conmercial Plaza and those unplated and plated areas
lying between Horsetooth and Harmony Roads east of Colorado and
Southern Railroad. This means of disposal of these storm waters
provides the most direct route to the eventual natural drainage
(Mail Creek) and disrupts the least number of developable sites
as well as eliminates the need of crossing the extremely busy
highway of South College Avenue.
We would' rend that the various property owners within the
area mentioned above proceed to construct this interceptor
storm sewer with utmost speed and further recommend that the
City offer its assistance by the formation of a special Improve-ent
District. to achieve this end if the owners are unable to provide
the financing through their own means.

On your September 10, 1979 agenda appears the above -captioned
application. Neither the developer nor anyone on its behalf
has contacted any officers of The Larimer County Canal No. 2
Irrigating Company or The New Mercer Ditch Company.
At first glance, it would appear that any substantial development
on this land, particularly a large parking area with impermeable
surface, would have potentially disastrous effects on the ditches
of one or both of these companies.
We urge that no approvals be given for this particular project
until ditch company approval is obtained by the developer from
both companies.
This letter would tend to contradict in some ways a recent policy -
type letter sent to you by The New Mercer Ditch Company and, to
a certain extent, another letter of policy sent to you by The
Larimer County Canal No. 2 Irrigating Company.
However, in view of the potential grave danger such development
might cause, with irreparable injury, I believe the ditch companies
should have direct input in this matter, and their approval required.

Dear Mr. Yacovetta:
It has come to my attention through a myriad of round -about sources that
the Commercial Division of Moore Realty has purchased from Albertson's the
nine acres+, site plan, etc., located on the southwest corner of Horsetooth
and College, and is planning a build and lease operation.with Albertson's
as the anchor.
I don't know, and 1 am not interested in, the terms or conditions of the
Albertson's sale to your Division; however, since my name and that of m
company are on the site plan currently established at the City, and because
representations were made to the City by myself concerning the evolvement
of that site plan in the approval process, I must request that I be kept
informed of any attempted changes whatsoever in the format of the site plan,
the location of the buildings, or in materials and aesthetic appearance of
the exterior of the buildings.
As you know, that ground was sold to Albertson's under a set of architectural
controls and restrictions. These controls or restrictions will be strictly
enforced by myself and by Creger Plaza, Ltd., which controls the balance of
the ground on the twenty-two acre site and which. of course, was the selling
entity in the Albertson's deal.
These covenants are recorded against the entire project of which your parcel
is a portion. I would suggest that you obtain a copy from the Larimer County
Court House and read it thoroughly.

PLANNING OBJECTIVES - CREGER PLAZA
A primary obective of the plan for Creger Plaza is to provide safe, ef-
ficient access for vehicles. The short leg of Mason.Street north of
Horsetooth Road has been aligned and continues through Creger Plaza bi-
secting the property. One point of ingress and egress has been provided
on US 287 approximately 730 feet from the intersection of Horsetooth and
US 287. A frontage road has been recommended paralleling US 287. A
single curb cut on Horsetooth Road is recommended approximately 270 feet
from the center line of Horsetooth and US 287.
The parcels fronting onto US 287 have been sized in excess of two acres to
allow a P.U.D. approach to their final development. The parcels west of
the proposed Mason Street are sized to provide more flexibility, however,
if combined into multiples of three, they would also satisy the two acre
requirement for P.U.D. development. The parcels fronting onto the Colo-
rado and Southern Railroad have a minimum of 200 feet of depth.
It is anticipated that the land use of Creger Plaza will be a combination of
office and commercial uses. The existing adjacent users include Horsetooth
Lanes (bowling alley) and College Motors (car dealer). Surrounding zoning
within the city is HB (highway business). Surrounding zoning within Larimer
County is as follows:
West - M (Multi family), C (Commercial)
North -I (Industrial) C (Commercial)
South - C (Commercial)
East - T (Tourist), C (Commercial)

Please be advised that we represent Creger Plaza, Ltd.,
the developer of Creger Plaza and predecessor in interest to
the lots you now own in that PUD. They have advised us that
contrary to the terms of the protective covenants recorded
regarding said property and also in violation of the terms
of the original agreement between Creger Plaza and Albertsons
wherein Albertsons purchased said lots, you have made a
number of changes in.the original plans for the development
of said lots which were presented to Creger Plaza, Ltd.
Had Creger Plaza, Ltd. been notified of some of these changes,
they would not have approved the same. As a result of your
failure to notify them, additional expenses will have to be
incurred to complete the off -site improvements, they have
experienced numerous problems with the City of Fort Collins
because the City has not been Kept advised of the various
changes in the plans and quite possibly, some of the remaining
properties .in the subdivision will be diminished in value
unless some of the improvements constructed on your property
are removed. Obviously, these are very serious problems and
ones to which Creger Plaza must give their immediate attention.
Therefore, this is to advise you that unless representatives
from your Company immediately meet with representatives of
Creger Plaza, Ltd. and resolve the various problems which
have arisen, I have been instructed to commence legal action
to enjoin any further activity on the property until these
matters are resolved. This is a drastic remedy, but is one
which must be taken in order for Creger Plaza, Ltd. to
protect their interest in the remaining lots.

they will be requesting a certificate of occupancy. The Public Works
Deparinent foresees that the improva7ents will not be carpleted when the
request for a C.O. is made. I have made up the following list of require-

I am in receipt of your letter of October 27, 1980. I understand your
concerns regarding the Albertsons development underway by Moore and
Company. I have listed below the improvements outlined in your letter
of the 27th of October, with their current and projected completion
dates:
1. Bridge on Horsetooth Road: Moore and Company and Creger
Plaza, Ltd., are now discussing whose responsibility this
will wind up to be. With a little luck and with the weather
holding, the bridge work from date of start to time of
completion should last about six weeks.
2. Curb and Gutter: It is installed on Creger Drive,
Mason Street and College Avenue. Horsetooth is under dis-
cussion between Moore and Creger Plaza, Ltd., but can most
certainl,r be completed if there is not an early freeze.
3. Pavement: Will be completed on Mason Street and Creger
Drive by Creger Plaza, probably this month. College Avenue
is the responsibility of Moore and Company. Obviously,
Horsetoo-th Road cannot be paved until the bridge is completed.
4. Sidewalk on College Avenue is the responsibility of Moore
and Company.
5. Curb and gutter on the parking lot is the responsibility
of Moore and Company.

The items on which you would like to see 150 percent of responsibility
through escrow accounts, lines of credit, or other acceptable means
before releasing the C.O., include:
1. Sidewalks along Creger Drive, Mason Street and Horsetooth.
The responsibility for these is being discussed with Moore and
Company. However, the only problem area would seem to be
Horsetooth. All.should be completed by December 15, weather
permitting.
2. Final pavement of Horsetooth Road and Mason Street. This
is solved by Item 3 above.
Any problems existing with the project with other departments at the City,
primarily Planning and Traffic, is the responsibility of Moore and Company.
I would, at this time, like to mention several things:
a.
-`1. Nowhere in our utility agreement, signed by the City and
ourselves, does it mention that the specific improvements listed
within your letter are necessary for a C.O.
2. The lowering and moving of the large gas line down Horsetooth
Road is the responsibility of the City according to other
developers and the gas company. No work can proceed on the
bridge until the gas line is moved. I would suggest that you
contact either Jack Bevan or Mike Martin at Western Slope Gas
;- Company so that this can be affected and that work can commence.
3. As you know, there are several problems existing in
defining areas of responsibility between Creger Plaza and
Moore and Company. In addition, this is compounded by the
fact that the Architectural Control covenants recorded on the
property :in 1979 had been seriously breached by planning changes
by Moore and Company. It is my hope that these situations will
be resolved in time for Moore and Company and ourselves to
complete the improvements necessary to the timely opening of the
Albertsons Center. However, it is important to us that we do
not undermine the integrity of the project for a mere expediency.
a 4. I think it only proper that if escrows are recorded for
several items for the eventual release of the C.O. (if Moore
and Company and Creger Plaza iron out their differences), that
the City should chip in its share of oversizing to the escrow
account.

but, since you have designed at the minimum 0.4% already, it leaves us
no choice but: to accept the cross slope change. We wish the private
sector would keep this in mind when t^ey sulinit a design - it's not
always the most expedient principle to design to minimum allowable
standards.

Dear Tim:
On November 24, 1980 Dale Puller of Sterling Paving called to my attention
the street section details on the approved Creger Plaza utility plans.
This detail indicated 6" of base course, and 2" of asphalt pavement for
the widening of Horsetooth Road along this subdivision.
I researched the subdivision agreements at this time and found that:
1) a soils report was never submitted to the City as required in the
Street Specifications, Design of Streets, Paragraph 3., Testing,
2) in a letter dated June 8, 1978 fran Marc Engenoen of the City to Jim Dubler
of Cornell Consulting, one of the changes indicated before final City
approval of the utility plans was an arterial street section detail
for Horsetooth Road,
3) no other street section detail appears in any other approved plan for
this subdivision, including Albertson's site plan.
I concluded that the change indicated by Mr. Engemoen was overlooked during
final acceptance by the City.
On December 1, 1980 I informed Mauri Rupel of the above facts. He indicated
because there was no soils report, the street section shall be constructed to
minimum arterial street sections (eight (8") inches of base course with four
(4") inches of asphalt), as indicated in the City's new policy for asphalt
street paving, which became effective this spring while the present street
specifications are being reviewed.
As you are aware the specifications and plans are intended to supplement each
other, and together constitute one complete set of specifications and plans,
so that any work exhibited in the one and not the other, shall be executed just

as if it had been set forth in both, in order that the work shall be
completed according to the complete design or designs as decided by
the Director- of Engineering Services.
Although I do have the authority to stop construction if any
discrepancies should arise, I felt that because of the time of the
year, and weather factors that could affect the paving, along with
the City's vindication to Bill Moore in its meeting of November 19, 1980
every effort should be made to complete the widening of Horsetooth Road
this year. I therefore directed Dale Miller of Sterling Paving to
proceed with the construction of Horsetooth Road using the new arterial
street standards.

R/C Redesign
Dear Ray:
This is to confirm our discussion during a meeting held in your
office Monday, December 22, 1980. We are proceeding with R/C redesign
of the subject bridge to accommodate Horsetooth Road street widening per
the Albertson project. It is my understanding that the City of Fort
Collins will be paying for the redesign work. As we proceed I will
make an effort to keep you abreast with the status of our work. To
date we have received permission to proceed with construction of the
bridge footings from Mauri Rupel.
We intend to work on an hourly basis at the following normal
charge basis of 1) Principal $45/hour, 2) Design Engineer $30/hour,

This letter is to confirm our conversation of Decanter 30, 1980
regarding the street improvements to be ccnpleted near the Creger
AMC property.
A median in Foothills Parkway at College Avenue is scheduled to be
ocampleted by 1982. This median, with the canpletion of the frontage
road, will allow for traffic north and south bound on College to access
your property from Monroe Drive.
The City has also stated that the frontage road along College will be
improved from Foothills Parkway to Monroe Drive. No date has been
set for this construction at this time. Two processes are normally
used to finance this type of improvement. One is to have the developer
corn -Lit to making the improvements now or at some future date. The
other being an improvement district in which all affected parties
share in the cost. When the frontage road is comrpleted, it is planned
to close all curb cuts along this area.

I have received and reviewed the drawings concerning Dick's Datsun P.U.D. and
the resultant cross easement requirements for the adjacent properties to the
north of which I am a participating property owner. It is my intent to cooper-
ate with the City of Fort Collins in the implementation of this solution as
proposed by Dick's Datsun P.U.D. and shown on the enclosed sketch of this
affected area. It is also my understanding that this solution is in lieu of
the frontage road previously imposed on these properties. Subsequently, the
50' (fifty foot) right-of-way as dedicated to the City of Fort Collins by
Creger Plaza and College Motors P.U.D. for the frontage road will be nullified
in favor of a public cross easement through these properties in the parking
areas, retaining only a single curb cut on South College Avenue for the College
Motors P.U.D. property (see enclosed sketch) presently Foothills Chrysler
Plymouth, which will, via the cross easement, allow two points of access
Creger Plaza lot 5, including the access fro Creger ive.

The subject subdivision was given a temporary Certificate of Occupany on
January 27, 1981,"Subject to Engineering Ccnanents", for a period of 30 days.
To clearify this for you and and your inspectors, the following items
shown either on the Alber-tsons or Creger Plaza Utility Drawings, were
not completed at the time of issuance of the certificate:
1. Sidewalk and pedestrian bridge over Larimer County Canal No. 2 along
west side of College Avenue.
2. Sidewalk and paving along Horsetooth Road.
3. Sidewalk along East side of Mason Street, North side of Creger Drive, and
South side of Horsetooth Road.
The above items are covered by either cash or certified letter of credit escrow.
Upon completion of these items, the escrow will be returned to the respective
developers and a letter of acceptance from our Chief Inspector will be forwarded
to your office.

has instructed me to address a letter to the City concerning
tree drainage situation at the net,,: Albertson's grocc ry store
location.
There is a previously recorded agreement taking care of a part.
of this situaticn, a xerox copy of which I am enclosing,.
The additional City requirement of an extended curb cut does
increase thE� drainage into the No. 2 Ditch, and the matter
was discussed in detail with Dennis Donovan of Osprey t-tomes
by the Poarcl, and the company is agreeable to accepting the
additional run-off created by the wi(len.ed curb c-ut and tf)e
widened bridge primarily, because some historic lands on the
southwest part of the; tract now divert southwest-erl- xiath(,r.-
than into the No. 2 Ditch.

Subject: Request for permission (permit) for construction
of a Fotomat kiosk, South College Avenue and
Horsetooth Road (SWC)
The subject shopping center, now known as Cottonwood Corners,
is located on the South West corner of South College Avenue
and Horsetooth Road in the city of Fort Collins. The center
presently contains an Albertson's market and several other
retail stores.
Fotomat proposes to construct a Fotomat kiosk and to operate
a retail business. The proposed kiosk is a double drive-thru.
The proposed site for the kiosk (on the North side of the
parking area) was selected for a number of reasons:
;. The proposed site is out of the main traffic lanes, thus
not causing any traffic problems.
2. The area selected has the lowest parking use, and;
site was agreed to by Landlord, since it will not
.nterfere with parking of other tenants, their customers
a;;„i employees in the shopping center.
The double drive-thru is proposed to avoid any stacking
probieps. The double drive-thru allows for two (2) cars on
ea,:;: side of' the kiosk, or four(4) total. This is more than
adequate for Fotomat's operation. Our business is very fast;
,:astomers hand in their film for processing, or pick-up their
finished photos and leave. If the customer is paying for
photos, the price is already computed and printed on their
en,-elop; the Fotomate (our retail clerks) merely ring the
re,�,ster and returns the customer's correct change.

For some reason, and I guess that it is because people are in
such a hurry these days, when there are two cars waiting at
one of our kiosks, the next person parks and walks up to the
window or drives to one of the other shops in the center to
shop and returns to us when there is no one waiting,. Though
most drive-t:hrus require five (5) stacking, we believe that
four (4) stacking in this case is more than adequate.
As a matter of information, Fotomates normal hours of
business are 10:00 AM to 7:00 PM on Monday through Friday,
10:00 AM to 4:00 PM on Saturday and closed on Sunday. We
train all of our Fotomates locally, and set up working hours
for part-time work; many of our employees are college
students and senior citizens. The Fotomates are in constant
contact with their supervisor (both in person and by telephone).
Each store is routed once each day for pick-up and delivery of
merchandise and inspection and maintenance of the kiosk.
We hope that this will answer your questions. Fotomat
brochures are enclosed for your inspection; and hopefully
wish that this proposed kiosk will meet with your approval.

As we discussed on the telephone the other day_, the
extension of lot lines in the(Creger Plaza Subdivision'-
to the center of the street has -created some problems in
regard to City setback requirements as specified in the
Code of Ordinances which might apply to the subject property.
Upon your recommendation that you would prefer to leave
the lot lines as they presently exist (to the center of
the street), I had suggested that we ought to enter into
a short agreement specifying that these setback require-
ments would be applicable to the boundary of the right
of way, and you concurred in that suggestion. Accordingly,
i have prepared a very short agreement for your execution
and subsequent return to this office. Upon return to this
office, I will arrange for execution of the agreement by
the City Manager and the recordation of the document with
the County Clerk and Recorder. Thank you for your cooper-

Dear Jim,
Along the South College Avenue frontage of Furr's Cafeteria,
there is a curb cut in the existing vertical curb and gutter.
This existing_ curb cut is not indicated on the approved utility
plans (dated 12-15-81) and will not be used for access in the future.
I do not know why this existing curb cut was omitted from the
approved drawings, apparently it was overlooked by the developer's
engineer. Hcmever, according to Chapter 95-53 of the Code of the
City of Fort Collins, abandoned driveways should be removed and
replaced by new curb and gutter. I would like to request that
this work be completed in conjunction with the other public right-
of-way improvements, in order to minimize any delays in the release
of the Engineering clearance for this site.

As you are aware, the building permit for this address
was released before the approved engineering plan was
signed. It appears that the general contractor began
building according to the site plan, and has never received
an engineering plan from his office. Although this is not
our concern, it became evident to me after an inspection
on February 19, 1982 that the site plan and engineering plan
for the parking lot curb are not the same along College Avenue.
I see this as a potential problem, in that the engineering
drawing of the painted "access lane" is inaccurate, according
to what is being constructed now. I feel that I do not have
the authority to resolve the problem.

Your letter of December 28, 1979, concerning the above subject location,
has been reviewed by the Department of Public Works and the following
comments are offered.
1. Host direct access to College Avenue has been prohibited by Council
policy for sometime. Only at major arterial intersections has the City
modified this rule. The Albertsons project was given direct access to
College Avenue under this criteria and the traffic circulation consider-
ations. Dur'ng the hearings for the above project, discussion was held
regarding the installation of a median on College Avenue between
Horsetooth and Harmony. The City indicated this probably would not happen
within the next, three to five years. However, should funding become
available, the City will be obligated to construct the island. Albertsons
with their current circulation patters, will have excellent access to all
points in the City even if a median island is installed.
2. Albertsons fee for the development parcel would be $18,000 as indicated
in your letter. ftiever, the expenditures associated with the turnout
lanes would not be the City's responsibility.

Albertson's, Inc. recently received PUD approval for property
located at the southwest corner_ of Horsetooth Road and South
College Avenue from the Fort Collins City Council. This letter
should serve to clarify certain understandings in connection
with that approval.
1. The City of Fort Collins, including but not limited to
departments and agencies; agrees that until such time as Mason
Street is extended south to a major arterial street which has a
signalized intersection. with South College avenue, unlimited left

intersection of Creegor Drive.
2. Albertson's, Inc. agrees to pay to the City of Fort. Collins
the sum of $18,000 ($2,000 per acre of the property subject to the
PUD approval) as its contribution to the City's fund for the over-'
sizing of street improvements. Said monies are to be paid on or
before the time that Albertson's obtains a building permit for any
improvements located on the property which received the PUD approval.
Albertson's understands that the above assessment is not in lieu
of any assessment which may be due as participation in the installation.

time the fill is placed for the South Fort Collins Veterinary Center P.U.D.

be graded so as to provide onsite detention and discharge stormwater into
the existing storm drain in Mason Street when it is developed. Since our
lots have no impervious surface, the runoff being blocked will be historic.

The Affected Property Owners "Client" in accepting this proposal
agrees to designate a spokesman who will be the principal contact
with the Engineer.
SUBJECT: This proposal pertains to a combined effort of five
affected property owners as The CLIENT who desire to
drain the water from and refill an existing bog with
earth so as to make the affect property usable.
LOCATION: The area of the Bog is located generally in the NE:, N h
Section 35, Township 7 North, Range 69 West of the 6th
P.M. Larimer County, Colorado. It lies between South
College Avenue and the Colorado and Southern Railroad
right of way and is approximately one quarter (J) mile
south of Horsetooth Road.
CBJBCTIVES: The principal objectives of this proposal would be as
follows:
1. Identify existing drainage patterns and define the
parameters for storm drainage from the area following
completion of the draining and filling project.
2. Define the problem and develop alternative solutions
based on input from the client, city and county
officials and others who are directly affected.
ENGINEERING SERVICFS :
The following is a definition of services we will provide
to assist the Client in their efforts to reclaim the subject
lake property.
1. Preliminary Phase
a. Attend conferences with clients to review available
material and discuss scheduling. Also, attend
conferences as required with utility companies and
various apix oving and regulatory agencies.
b. Determine the need for necessary reconnaissance
surveys and assist in procuring those services.
e. Prepare a Preliminary Engineering Report which will
include the results of studies and designs prepared
in the process of identifying existing cond it ions
and developing alternative solutions. This material
will ve reviewed with the Client and the required
approving agencies.
