Contents: 2., Paul, an issue has come up on Creekside Estates (formerly Shoreline P.U.D.) that you should be aware of. This property is located adjacent to the Harmony Cove Reservoir and should not be confused with Creekside at the Landings although the developer, Mr. Ken Slyziuk, is developing both projects. The approved P.U.D. calls for doing a meandering, naturalistic shoreline treatment along the reservoir's edge behind lots 1 - 4. Since the approval, the surrounding lake owners have formed an association and purchased bottom of the lake and irrigation water from Larimer No. 2. The developer has filled in the back of lots 1 - 4 with dirt to do the shoreline treatment but got a little carried away and brougt in too much dirt. The extra fill now extends beyond the designated landscape and shoreline area. The association, represented by Moe Mekelberg and Sam Anderson, are upset and want the extra fill removed. The issue is that the original shoreline landscape plan that was approved on the P.U.D. called for landscape material to be placed beyond the rear platted property line of lots 1 - 4. The Planning Department did not obtain the permission of the lake owner at the time of approval who we think was Bill Albrecht. We now fear that the new Lake Association will not only bring action to remove the fill that extends beyond the designated shoreline area (which we agree with) but to also remove all the fill that extends beyond the platted property line (which we do not agree with as it will require retention walls and we lose the naturalistic features). Sam Anderson has filed a Quiet Title on lots 1 - 4. Lucia Liley has been retained by Ken Slyziuk to facilitate in hopes of preventing litigation. I have been invited to a meeting to discuss the issues with all the parties including Parson's and Associates, Slyziuk's engineer. I believe that the City may have a legal interest at stake. Did we screw up by not getting Albrecht's permission to fill a small portion of the lake for landscaping? I know he knew about it because he attended the neighborhood meetings. Is Albrecht liable because he did not disclose to the Lake Association about the P.U.D. encroachment? The meeting is scheduled for 4:30 P.M. at Sam Anderson's office in the Clock Tower Building on South College. Please advise. Thanks. End of Item 2. Box 580 Fort Collins, CO 80522 J AN 311992 RE: Certification of drainage scvale in Creekside Estates Dear Glen: The attached cross -sections were surveyed by us for the purpose of certifying the adequacy of the relocated drainage swale on the south boundary of Creekside Estates. The Section AA was take.: through the easterly portion of Lot 10 and Section BB was taken through Lot 1. As you can see in Section 3B, there is an encroachment into the drainage easement for the construction of the house and garage on Lot 1. Therefore, we propose steeper slopes: 2:1 rather than 3:1 as shown on the original design. I have discussed the 2:1 slopes with Neil Sher -rod of Empire Labs and we both feel that sodded 2:1 slopes will withstand erosion during the 100-year flows. Given the soil type at the site, a 2:1 slope with proper compaction is stable. The grass will withstand water velocities up to 6 feet per section, which is greater than anticipated in this swale. We recommend that slopes steeper than 2 1/2:1 be sodded., and flatter slopes be seeded. The capacity of the proposed swale through both of these sections substantially exceeds the needed capacity for the 100-year flows. The capacity of the existing swale is also more than adequate, but the proposed regrading will stabilize the side slopes of the channel. Once these proposed changes are made, I'll be able to certify the adequacy of this channel. Thank you for your help in releasing Lot 1 for a C.O., allowing Fairfield Companies to close on that lot. This letter does not relieve the Developer of his obligation to complete the development as approved by the City. Lots 13, 18, and 19 will not be released for building permits until such time as all of the required improvements are complete.
