McConnell LaPorte Colorado Dear Mr. McConnell: A plat of Cotton Willow Estates has finally been presented to the City with the areas calculated. The area of the land which you have now sold to anotner developer consists of 5.4780 acres; the area you are presently developing with the four duplexes contains 5.3473 acres; Lots 1-7 of Block 4 contain 3.0151 acres and this gives a total development in Section 29 of. 13.8404 acres. I advised you when you took out the permits for Lots 9-12 for the duplexes that T would allow you five taps on Lots 3-7 of Block 4. The combined area of these lots is 1.8404, leaving you a net area of 12.000 acres. At the present heater right rate 12.000 acres would require a payment of $6,000.00. You have paid on the permits for Lots 9-12 for the duplexes $494.11, which then would leave you a balance due for raw water on that portion of the First Filing in Section 29 and served by the City system of $5,505.89. 51y most recent conversation with Jack Vaihrenwald, the representative of the LaPorte Water and Sanitation District, indicated that you had not settled win trim for the sealer taps for Lots 9-12 and I have not, as yet, contacted him relative to the proposed extension of their sewer system. Box 467 Fort Collins, Colorado 80521 Dear Mr. Lybarger: Section 21-43.67 of the Code of Ordinances of the City of Fort Collins, 1.958, as amended, requres that all premises requesting original water service from the City of Fort Collins shall furnish to the City Water Rights acceptable in the amount of 2 acre feet per acre of land to be served or cash in lieu of said Water Rights. The City Lases "Big T" water as the basis of its requirement and where Water Rights are not available on the land being served, a value of $250.00 per acre foot or unit has been established by the City. We have been advised that your corporation has purchased 5.478 acres of land in Cotton Willow Estates, First Filing and the cash in lieu of Water Rights to satisfy your obligation to the City would be $2,739.00 for the entire tract.
