At the time this home was being laid out on the lot, apparently the wrong property pin was used and as a result the structure is encroaching approximately 618" into the south drainace and utility easement, as shown on the enclosed Improvement Certificate. As per instr-actions from Mr. Schlueter, we are writing this letter to request a "vacation of easement". Thank you for your time and effort in processing this request, we greatly appreciate any expediting of this request that is possible as we have a sale pending. Harmony Road Fort Collins, CO 80526 RE: Letter of Agreement Dear Mr. Nordick: (303) 482-1486 This letter of agreement is to confirm with Clarendon Hills Associates the engineering services requested by Dennis Donovan of Land Development Services. We have been contracted to perform a pavement investigation on a portion of South Shields Road. Limits of the investigation is from one-half mile south of Harmony Road to Fossil Creek Drive. Purpose of the investigation is to utilize nondestructive deflection tests (NDT) to evaluate the existing pavement strength. Tests will be performed at 50- foot intervals along the outside wheel path of both the north and south bound lanes. Over 110 locations will be tested. The NDT results will be evaluated and pavement remedial recommendations developed and presented in a report. Total cost of this service is $2,200. It has been agreed that Mr. Donovan will provide the following information needed for the evaluation: Average Daily Traffic, Percent heavy trucks using the road, Percent growth factor over the desired design period, Desired design period for analysis, 18-kip Equivalent Single -Axle Load (ESAL) Existing pavement structural section thicknesses, and Plan view of the project. With no delay in obtaining the needed information, the pavement evaluation report will be issued before the end of August.
