A copy of the legal notices section from The Coloradoan,
advertising the sale of two parcels in Cedar Village, First
Filing, Fort Collins, Colorado.
Original executed quit claim deed conveying Tract A, Cedar
Village, First Filing, to the City of Fort Collins.
A check in the amount of $100.00. 101•53
The back taxes for Tract A amount to $75.65.. The person who
applied for the tax deed had to deposit $125.00 cost advance to
the Treasurer's Office. Therefore, t�re -amount to redeem is
$200.65. Once redemption has been made, a portion of the deposit

I am su-e that the developer and the City of Fort Collins
each intended Tract A to be conveyed to the City of Fort Collins
but such con,reyance was overlooked. We hope you will take the
deed and talk the City into paying the balance of the taxes and

RE: Cedar Village Subdivision Sanitary Sewer
The utility plans for the Cedar Village Subdivision, located on the south side
of Drake Road approximately z-mile west of Shields Street, were submitted to the
utility department staff for their review and comment.
It was requested by the utility department staff that Hanover Drive be aligned
so as to center the existing 12-inch sanitary sewer within the right-of-way,
rather than 5-feet from the fl.owline of the curb and gutter as shown on the plans.
'The reasons for such a request were the concern of storm water inflow into the
sanitary sewer system, the cost of curb and gutter replacement in the event re-
pairs on the line should actually require excavation, and uniformity of utility
locations within street rights -of -way.
Should Hanover Drive be shifted to the east, as requested, it would require a
new l-Ayout for all lots east of Hanover Drive. In addition relocation would
require that the storm sewer be located east of the sanitary sewer on Hanover
Drive. This would increase the cost of storm sewer installation by increasing
the length of catch basin laterals and the outfall line, while -not reducing any
construction costs on the sanitary sewer services.
Given the above consideration we have evaluated the utility layout to alleviate
the problems which your staff brought out. It is recommended that the manholes
subject to stormvater inflow be constructed with waterproof rings and covers.
If maintenance or construction records indicated an above average possibility
of having to excavate this existing sewer, we would consider altering the pro-
posed alignment. However, available information indicates that the sewer was
properly constructed and has not been a maintenance problem.
The standard specifications for sanitary sewers are considered as guidelines.
In the event of special circumstances, such as the one under discussion, a vari-
ance should and must be considered.
Given all considerations, we feel that the utility plan should be approved with
minor revisions.

Dear Mr. Miller:
This is to recap our conversation of April 13, 1978.
After our initial discussion of why and how the 15 inch sanitary sewer
came to be installed along the west side of Cedarwood Drive north of
Prospect Street, Pat Polifka and I requested an easement,conceding that
this request was after the fact since the line was installed.
You indicated that you had several concerns over the future ability to
further develop the west side of Cedarwood because of the constraints
imposed by a sewer easement. After discussion of those concerns, you
raised the further issue of some $15,000 that the City was holding relevant
to the development of a detention area north of Cedarwood Subdivision
on property owned by Mrs. Minatta.
Mr. Polifka indicated that he had been negotiating with Mrs. Minatta
and hoped to have the matter settled shortly. You stated your desire
to have the issue resolved quickly so that you could terminate your
involvement with that subdivision.
You indicated a willingness to grant the easement for the sewer on
Cedarwood if you could get an early resolution to the problem with the
detention area or release of your escrow amount of $15,000. I stated
I would work with Pat and that I would talk to Roy Bingman about
release of the escrow.
Later that same day, I talked to Roy and he indicated he would look
into releasing all or part of the escrow.
I hope you find this to be an accurate summary of our conversations.
Please contact me if you feel there are significant errors or ommissions.
I will continue to work with Roy and with Pat Polifka on this matter
and will keep you informed of progress.
