Dear Mauri:
Bruce Miller of Miller Properties, Inc. has requested that we
submit this letter on the above referenced project.
As you know, M & I, Inc. and Miller Properties, Inc. have had
several meetings with the City engineering staff on this pro-
ject in an attempt to provide a safe and equitable method of
transporting the off -site storm drainage through the proposed
development. Reference is made to your memo of January 29,
1980, wherein you indicated that the utility drawings for Cedar
Village, Sixth Filing are approved subject to verification of
storm water final design calculations from the adjoining sub-
division to the south (Rossborough, Second Filing). You con-
cluded that upon satisfactory approval of Rossborough's plans,
you would prepare the subdivision agreement for Cedar Village,
Sixth Filing and submit it to Council.
On behalf of Miller Properties, Inc. we request that Cedar
Village Sixth Filing be placed on the agenda for review of
the City Council at their Marchi8, 1930 meeting. We will

take that opportunity to show the developer's willingness to
work with the City and request that the project not be delayed
further.

The following is in response to Mr. Roger Strauss' correspondence dated
January 29, 1985 regarding the acceptance of City liability for drainage
improvements downstream and in the Rossborough development.

The Rossborough development encompasses some 160 acres and is bounded by
Horsetooth Road on the south and Taft Hill Road on the west. Immediately
north and adjacent are the Cedar Village developments. These encompass
through several filings, the area between Rossborough and Drake Road.
Both developments, Rossborough and Cedar Village 6th Filing, were reviewed
in the planning process at the same time, thus the drainage improvements
were coordinated and consistent with each other. Rossborough's drainage
improvements consist of an open channel along its west and north boundaries
and a detention facility in its northeast corner. The outlet from the
detention pond surfaces in an open channel provided for on the west side
of the Cedar Village 6th development. This channel provides an outlet for
Rossborough's drainage waters. At the time of development review, it was
understood Rossborough would construct its improvements to its north
property line and Cedar Village would extend the same through its develop-
ment.
Because previous Cedar Village filings (1 thru 4) didn't provide a corridor
for off -site drainage waters, an alternate route had to be identified.
That route will be an extension of the Cedar Village open channel along the
outside west edge of constructed Cedar Village filings outletting to Spring
Creek. This improvement will be constructed as a City drainage project
financed by Storm Drainage Basin fees.

CURRENT STATUS
In both cases, the Cedar Village 6th improvements and the outlet to Spring
Creek, have not been constructed. The Cedar Village improvements have not
been constructed because the developer has not initiated construction in
this area. The City related improvements, i.e. outlet to Spring Creek,
have not started because until recently, funding for the project has not
been available. The outlet to Spring Creek is the next basin improvement
to he constructed. Currently staff is designing the outlet to Spring Creek
and should complete this task in May of this year. Right of way and
construction should take place this summer and fall. After that time the
two systems can be tied together with minor ditch grading. This will
eliminate the ponding in the Rossborough development.
SUMMARY
In recent conversations with Mr. Strauss in regard to the status of drain-
age improvements in Rossborough, we asked him to complete the improvements
for his development as identified in the utility plans approved by the
City. The City would then proceed and provide the outlet to Spring Creek.
