Dear Mr. Oyler:
Following the discussion in our offices on December 1 regarding the two
developments your firm is considering, I had an opportunity to review our
records of these properties. I hope the following information will be helpful.
In regard to the area north of the proposed Trend Homes development, I believe we
discussed briefly the problems associated with storm drainage on this site. In
reviewing the design information in our files for the drainage in Cedar Village
Subdivision, it appears that only the 36 acres included in the first and third
filings of the subdivision were considered in sizing the detention pond. In
addition, the pond was sized in accordance with the City's old drainage requirements,
which have now been revised. As a result, the capacity of the pond is only 1.8
acre-feet, while ny calculations for the site under the new drainage criteria
indicate approximately 4.0 acre-feet of detention storage would be required.
In view of this, it appears that any development of the area south of Cedar Village
Subdivision must provide on -site detention of storm runoff from that development.
With respect to the off -site drainage which enters this site from the Trend Homes
development, the final engineering drawings are now being prepared by James Stewart
and Associates, a local consultant. As the City probably will not have an opportunity
to review these drawings for several weeks, it might be prudent for you to direct
your questions concerning this drainage directly to the consultant. Vic Weidmann
is the engineer with Stewarts who has analyzed the storm drainage. If it would be
convenient, perhaps I could arrange a meeting between yourself, Mr. Weidmann, and
the City's storm drainage engineer to discuss this matter in more detail.
Regarding the proposed Allen Farm development, the plans for the outlet facilities
are still in the preliminary stages. We are currently looking into the possible
conflicts with other utility installations already located in Shields Street, and we
hope to proceed with the actual design very shortly. As to the extent of your
participation in this matter, I believe Mr. Bartran agreed to bear the cost of
installing the line from his detention pond to the low area immediately north of
Swallow Road, which is approximately one-fourth of the proposed line. This
participation will not include any engineering costs as the City has accepted the
responsibility for the design. Perhaps you could verify this agreement with
100% Recycled Bond

Regarding the proposed first phase of Cedar Village, Fifth Filing:
(1) we agree that the proposed location of Swallow Road is the logical
extension of that street, and that the resolution of the storm
drainage situation for this area will not alter the proposed align-
ment in either the first or second phase of this development;
(2) we are in the process of retaining a consultant to analyze the
storm drainage in this basin with respect to the City's role in
providing a by-pass channel, and will not approve any plans for
the second. phase of this development prior to receiving the
recommendation of that consultant;
(3) the first phase of this development must submit a drainage report
and drawings indicating how they intend to provide on -site detention
of storm run-off for this site; and
(4) final approval of this development requires that the developer
dedicate all necessary easements and design the necessary improve-
ments to provide for the passage of historic storm waters across
this site.

This letter is in response to the request you made in our meeting of
May 1 concerning a hydrologic analysis of the drainageway through the Cedar
Village Subdivision area. I have reviewed the information concerning the
major drainage requirements for Cedar Village Fifth Filing and the Ross -
borough Subdivision to Spring Creek. Based on this brief analysis, I have
come up with a proposed study which would include a hydrologic analysis of
the various aroblems and determine alternative solutions and cost estimates.
In recent work which we have completed for James H. Stewart & Associates,
Inc., we have performed hydrologic calculations for Rossborough Subdivision
and have made a brief analysis of the Cedar Village Fifth Filing area. Based
on this analysis it appears that this major drainage area south of Spring
Creek would :include the Cedar Village Fifth Filing and Rossborough Sub-
division, as well as areas to the south and west of Rossborough and areas
east and west of Cedar Village Fifth Filing. Based on the information that
we have developed, it would be possible to come up with design hydrographs
at the north boundary of Cedar Village Fifth Filing. These design hydro -
graphs can take into account the outflow from the Rossborough Subdivision,
as well as the drainage from the west of Rossborough which is proposed to be
diverted around the north boundary of the Rossborough Subdivision. My
initial analysis utilized a drainage area into the Cedar Village Fifth
Filing, which was somewhat larger than the subdivision itself, to take
into account offsite drainage entering the subdivision. Therefore, based
on the information I currently have, I can readily develop design hydro -
graphs from these areas for the 2-year and 100-year storms.
Based on the design hydrology, the next portion of the study would be
to determine the various improvement alternatives and to analyze the cost
of each alternative.
1. One alternative would be to not provide any drainage facilities and
to allow the drainage to proceed overland through the current Cedar Village

i development. These flow figures could be utilized in developing a damage
estimate for benefit -cost studies.
2. A second alternative would be to create a pond on the Cedar
Village Fifth Filing for detention of storm water directly from that
area. This alternative would consider carrying all drainage water from
Rossborough Subdivision and areas south and west of Rossborough along
the west side of Cedar Village Fifth Filing. This would produce similar
results to your current analysis of the major drainageway and conduit on
the west side of the Cedar Village Subdivision.
3. Another alternative would be to analyze the use of the Cedar
Village Fifth Filing detention pond for onsite drainage and also to
route some overflow from Rossborough Subdivision through this pond and
i, down Hanover Street or through a storm sewer under Hanover Street. The
remainder of the flows for this alternative would be carried down a smaller
open channel on the west side of the Cedar Village Subdivision.
4. A fourth alternative would be to take all of the flows to a concen-
tration point: near Hanover Street routing some portions of these flows
through a detention basin and releasing the major part of the flows down
Hanover Street in a manner which would create little or no damage during
the major storm. /
Based on &ese various alternatives and any additional alternatives
that might be determined during the course of the study, we could then
make preliminary cost estimates for these various improvements.
At this point in the studies I would submit to you a letter outlining
the results of our studies and containing cost information for various
improvement alternatives. Some of these improvement alternatives might
not eliminate total damage during the 100-year flood; therefore you would
have design flows that you could use to make a benefit analysis for various
improvement alternatives and to determine benefit -cost ratios for each
alternative.
From the resulting cost estimates and the benefit analysis that you
could prepare, a decision could be reaches as to the most appropriate
improvement alternative.
I would estimate that the cost of our portion of this study, based on
information we have and the information your office has developed, would be
somewhere between $1,000 and $1,500, depending upon the number of improve-
ments analyzed and the complexity of the various improvements. I would also
estimate that we could complete this study in 3 to 5 weeks after approval
of this proposal.

This letter is to inform you as to the status of the drainage
problems between the Rossborough (Trend) and Cedar Village 5th
subdivisions.
You are probably aware that during the discussions it was
proposed to separate the detention pond from the park site
in the Rossborough subdivision and combine it with the pond
in the Cedar Village 5th subdivision. To do so would have
involved a considerable time delay for the developers with
regard to replatting the property and answering the ccu Alex
problem of who actually benefitted by the revisions and who
was eligible for additional ccn pensation.
The developers felt that they could not accept the time delay
and it was finally decided that the Rossborough developers would
develcp with the understanding that they would have their
original combination detention pond and park site located
in the N.E. corner of their subdivision. Also, the Cedar Village
subdivision would accept the runoff from the Rossborough site
and they would handle their own drainage in a separate detention pond.

Dear Mr. Rupel:
We are the developer and builder of the suject subdivision at
Cedar Village, Fifth Filing and are applying for subdivision approval
through the Veterans Administration.
One of the standard VA and FHA requirements is that we obtain a
letter from the local authority regarding the acceptance of the
streets. The letter should indicate their willingness to assume
responsibility for maintenance of the streets, drainage structures
and sewer and water facilities as soon as the developer has ful-
filled his obligations.
May we have such a letter addressed to the Veterans Administration
but s-nt to our address sn that it may be included v.1ith the other
documents and exhibits that we will file with the VA.
