Dr. Charles T. Collopy, the owner of the proposed Breakwater Estates would
still like it to be annexed and developed as an R-L zoned project. It,
for all practical purposes, is a single family subdivision. After our
previous discussions, he has agreed to have a home owners association
to maintain the detention pond and to provide a landscape plan for the
detention pond and Lemay Avenue and to maintain that landscaping.
Those were two of the greater concerns of the Planning Department. It
appears to us that any other concerns of the Planning Department would
be met at the building permit stage.

Dear Steve:
This is to request a variance for the depth of Lot 6, Breakwater Estates -
First Filing. The lot backs onto Lemay Avenue which is an arterial street
and therefore should have a depth of 150 feet. After the preliminary plat
was reviewed, the plan was revised in order to have all the lots take
access from Shore Pine Court. Lot 5 originally fronted onto Breakwater
Drive and would have had rather poor sight distance for a driveway and the
driveway would have been rather close to the intersection of Lemay Avenue.
In order to provide access to Lot 5 from Shore Pine Court, the cul de sac
had to be shifted Easterly. The shifting then caused the depth of Lot 6
to be less than 150 feet. There would be a hardship if Lot 5 could not
have access from Shore Pine Court and would therefore be eliminated.
The net; effect of the revision is a positive one. The fact that Lot 5
faces Shore Pine Court, as it's adjacent lots do, is more advantageous
than having Lot 6 be 150 feet deep. Lot 6 is the only lot in the
subdivision which backs onto an arterial street. The area along Lemay
Avenue will be landscaped as a buffer from the traffic noise.
