We are in receipt of your sheets 2, 3 & 4 of 6, plan and profile sheets
for the above referenced project.
We ask that these be resubmitted with the following suggestions:
1. Wherever designs include or are affected by existing roadways
it is the policy of this office to receive core boring reports
of the existing roadbase to determine adequacy of existing
conditions. If the present base is inadequate, the following
suggestions would appear in order.
2. Your design follows the profile of the centerline of the existing
surface. Apparently no consideration has been given to the
elimination of the numerous vertical curves in the existing road.
We would suggest that the two low points be held and that you hold
the elevation of Lockwood Drive as you have shown.
3. We suggest you eliminate the vertical curves at stations 3+00,
14+50, 17+50, 20+00 and 25+25.
4. We suggest you increase the length of the vertical curve at
station 30+87 to 200 feet holding your low point at 30+60 as shown.
5. Holding the elevation of the railroad crossing we feel the vertical
curve here can be lengthened to 150 feet improving the sight distance
and eliminating the + 20 grade at the approach to the railroad crossing.
If you have any questions or comments relating to these suggested changes,
please feel free to discuss them with us.

RE: Drainage ditch on north side of Collindale

Dear Bob,
I talked to Mick Mercer several days ago regarding the erosion taking place in
the Strom drainage ditch along our north property line. He indicated that the
city was aware of the problem and that the improvements were a part of the five
year storm drainage plan. I indicated that we had been in contact with you and
Maurie Rupel about a year ago. At that time the problem of improvement of the
area was a concern of ours because of our development. The ability to work in
this area is becoming increasingly more difficult. We did offer to do the
improvements and be reimbursed by the City upon completion. At that time you
indicated that no funds were available but that we could do the work. The City
then would pay us back when they had money to do so.
Mick was at the ditch the next day taking pictures of the area. He indicated
that he was gathering data to present to the Strom Board to build a case to
move this project up on the list of priorities.
Please advise Bartran Homes as soon as possible regarding the City's course of
action concerning this matter. We will cooperate, as usual, in any way possible
to correct the problem. The situation is serious, as you will agree, to the
extent that is has affected our ability to sell our homes that back up to this
area.

Thank you for your letter dated Sept. 30, 1983, regarding
ground water at the Collindale PUD, 2nd filing.
Your letter indicates to iie twc pr:,blems, oile of them mis-
information, and one of them miscommuncation.
I have been in contact with Neil Sherrod at Empire Labs here
in Fort Collins. Test drillings done for Bartran developers
on March 14, 1978 indicated ground water encountered at several
locations Tess tF_a n 12' deep. Your letter indicated no ground
water encountered July 19, 1978 at this same location, I would
like to delve into this further with the city engineers as you
have invited me to.

Secondly, my contention was not that water from Warren Park Pond
is flooding the basements at Collindale. My contention is that
since the time the city started to water Warren Park with water
from Warren Park Pod, approximately three years ago, the water
level at Collindale have come up enough to cause the basements to
flood. My conversations with Dave Frick from Resource Consultants
have revealed that Dave spoke. with Verg Taylor during the summer of
1982, and Verg informed Dave that the amount of water being put
into the grass at Warren Park was about twice as much as was required
for that rea:----Verg also indicated to Dave that he was goin- �o —

do test drillings in the area to prove or disapprove the theory that
the Warren Park Pond is leaking.
I cannot address the contention that Warren Lake is more likely the
cause of ground water than Warren Park Pond -s--iffine I am not familiar
with the soil type nor the slope of the sub-terrainian strata.
I am looking forward to hearing from a city staff member as to a
date on which we can meet to go or this problem.

A soils test conducted July 19, 1978, indicated that no groundwater was
encount?red during drillings on Horsetooth Road between Rolling Green Drive
and Lochwood Drive. However, areas of Horsetooth towards the Union Pacific
railroad tracks did show some groundwater. This land, like Collindale PUD,
2nd Filing, is further down in the drainage flow, so there may have been
groundwater present on this property as far back as 1978.
As for your contention that basement flooding is due to a rise in the water
level of the ',Darren Park Pond just south of Horsetooth Road, City Engineers
have pointed out that '.Darren Lake, which is owned by the ',Darren Lake
Reservoir Company, has a water level which is ten feet higher than the
level of the City's pond. This, combined with the fact that the volume and
water pressure of 'Warren Lake are greater than the pond, would suggest that
if any nearby body of water could cause such basement floodings, it would
be Warren Lake, and not the City's park pond.
I appreciate your concern in this matter, but the facts lead us to believe
that there is no way the !Darren Park Pond could possibly cause the basement
flooding problem at Collindale. Nor do we believe that any of the improve-
ments to Warren Park could have affected the amount of groundwater north of
Horsetooth Road. I welcome you to meet with members of the City staff to
go over engineering records regarding this situation. Please contact me if
you would like to discuss this further.

Our office represents Bartran Homes, Inc., the developer
of the Collindale Subdivision. As you know, the subdivision
contains single-family homes as well as a condominium project.
Bartran Homes had two complete sets of soil tests run
on the property; one at the time of the purchase of the
property and the second at the time of development. The
condominium units were constructed based upon the elevations
established from the soil tests. There has never been a
water level problem in the condominium area until the City
of Fort Collins built a lake directly across the street from
the condominiums in Warren Park. Water level problems have
now cropped up in two of the condominium units. The obvious
conclusion is that the water problem has been created by
seepage from the newly built lake. One possible resolution
of the problem may be to line the lake to prevent such
seepage.
I know that Bill Bartran discussed these matters with
you and that late on the afternoon of August 10 you invited
him to a staff meeting to be held on August 11 for the
purpose of further discussing this problem. Bill has
requested that I advise you that he regrets not being able
to attend that meeting. However, he already had plans to be
out of town for a week commencing on the llth.
The primary purpose of this letter is simply to put the
City of Fort Collins on notice that we believe the water

level problem in the Collindale condominium units is a
direct result of seepage from the newly constructed lake
in Warren Park. We hope that you will make your own
investigation and keep us advised of the results thereof.

Dear Bill:
Thank you for meeting with myself and other members of the City staff
on August 17 to discuss the ground water problem in Collindale PUD,
2nd filing.
As we stated, at the meeting, the movement of water underground is very
complex. The City cannot assume or confess to any liability or respon-
sibility for the basenent water problems without much stronger evidence
than the prestmiptions which were stated at the meeting.
In a spirit of cooperation; however, we are willing to perform certain
tests which may possibly give indications as to factors involved in the
problem. Those tests include lowering the level of the Warren Park Lake
and monitoring of underground water levels.
We are proceeding with these tests in the next few days and will be in
oontact with you.

Re: Flooded basement, Collindale 2nd Filing
On August 17, 1982, Tom Hays, John Huisjen, H.R. Phillips and myself
met with Bill Bartran and Larry Klien of Bartran Homes regarding the
ground water flooding of two basements in the Collindale 2nd Filing
in the southwest corner.
Mr. Bartran assertained the rise in the water table in his development
has caused two basements to be flooded and is being caused by the
Parks & Recreation department raising the water level in their
irrigation pond in Warren Park.
It was agreed at this time there are many unknown factors regarding
the causes of the water problems.
It was agreed the Parks Department would lower the pond level by about
2-feet. And Mr. Bartran or his staff will monitor the water in the
basements in question. This lowering of the lake would take place for
about 1-2 weeks. All other factors or conditions would remain the
same i.e. lawn watering in Warren Park and in the Collindale development.
If this showed no results, further stages would be taken of which
have not been addressed at this time.
Each entity agreed to keep the other abreast of the situation.

Dear Sir:
I would :Like to inform you that the City of Fort Collins Storm
Drainage Department is planning to install an additional culvert
at the Shepardson Bikepath Bridge crossing directly adjacent to
your property within Collindale Subdivision
Please refer to the enclosed vicinity map.
At this time the existing culvert does not have enough capacity
to adequately handle the projected storm water runoff flows.
The additional culvert will increase the capacity of the crossing
underneath the bikepath thus significantly reducing the flood
hazard i -i that area.
Preliminary plans of the crossing have been completed and I would
like a chance to talk to you about any suggestions or requests
you may have regarding the improvements. Please contact me at
the City Storm Drainage Department, telephone 484-4220, extension 305
and I will be happy to set up a meeting.
No specific date has been set for the start of construction, however,
we are anticipating installing the culvert by the end of the year.
Thank you very much for your cooperation in this matter and I hope
to hear from you soon.
