Dear Mr. Developer:
My office has been informed by Dick Wartenbe of the City Traffic Department
that the signs installed in the Clarendon Hills 1st Development are
substandard and do not meet the City's criteria for signs. Dick has
talked with your sign contractor, Rocky Mountain Safety Services, and was
not satisfied with their response. Therefore, as the developer of this
project, it .is your responsibility to the City that your sub -contractors
provide acceptable products and work. Please be informed that until such
time as the signs are brought up to the City standard, Certificates of
Occupancy will not be issued for any structure within this development.
If you have any questions regarding specific corrections to the signs in
this development, please contact Dick Wartenbe at 221-6815.

Dear Mr. Nordic:
Encroachment permit number 1-89 has been approved by the City with the
following conditions:
1. Use class 200 / DR 14 polyvinyl chloride pipe, not schedule 200, as the
casing pipe under the street rights -of -way.
2. Backfill the pipe trench with non -shrink fill material. This fill will
act as bedding material as well as trench backfill and will extend from
top to bottom of the trench. (specifications are attached)
3. The responsibility for maintenance of this pipe, trench and street
wearing surface rests solely with Clarendon Hills Associates who shall
hold the City harmless of any liability which should arise as a result
of this encroachment.
4. The Associates will comply within 3 working days, if the City requests
repairs to the system, pipe, trench or street surface.
5. Prior to making any repairs, changes or abandoning the system, which
are not at the request of the City, all appropriate permits are to be
obtained,.

6. All location changes, deletions or additions are to be shown on an "as
constructed" drawing submitted to the City Engineers office after the system
has been installed.
7. The City reserves the right to require the removal of this system from the
public rights -of -way at any time as outlined in Chapter 23 - 81 of the
Code of the City of Fort Collins.
8. A copy of the encroachment permit shall be recorded with the County Clerk
and Recorder.

Re: Street settlements at Clarendon Hills 1st filing
Dear Mr. Simpson:
Early this week I was called by the project manager of the Clarendon Hills
developments to investigate a street settlement on Clarendon Hills Drive.
When I arrived on site a section of street had settled, leaving a hole
adjacent to the curb and gutter. Apparently, a section of sewer trench was
inadequately compacted, causing the soil to collapse. Additionally, I
drove the streets in the 1st filing and have noted some minor settlements
at manholes, valve boxes, etc.
Following are the items of settlement which need to be repaired:
1. Water line settlement west of mid -block fire hydrant on Hinsdale.
East of 824 south side of street.
2. Sanitary sewer manhole settlement just north of Foxhills and
Clarendon Drive.
3. Irrigation pipe settlement on Clarendon Hills Drive just south of
Ashford Lane.
4. Sanitary sewer service settlement at lot number 4 on east side of
Clarendon Hills Drive.

I understand this work is still under warranty with the Fort
Collins/Lovelzu-xi Water District, and I suggest that a final walk-through
inspection be scheduled with the district and myself prior to making these
repairs. Hopefully, any warranty defects will be noted and can be
corrected at the same time.

the continued encroachment onto the backlot easement of your lot at
636 Hinsdale. You have constructed a permanent shed that
encroaches approximately one foot onto the six foot drainage and
utility easement.
Permission is hereby granted to continue this encroachment,
however, this is a drainage easement and permission is granted on
the condition that this structure shall not impede the drainage
flows nor adversely impact any adjacent properties with respect to
drainage. In addition, you shall hold the City harmless from any
liability or damages suffered by yourself or third parties arising

During the plan review of your home on Lot 47 of Clarendon
Hills 1st Filing, we found that the driveway location was
different from that anticipated when the lot was platted. The
building footprint is at the rear of the lot placing it beyond
the 150' access requirement of the Fire Code. The driveway
access in the rear is not adequate for emergency vehicle
access as shown. This combination of building location on the
lot, lack of a driveway directly on the street and slope to
the building contribute a very difficult firefighting
17d situation. In order to make this comply with the fire code,
'II'I I can offer three alternatives.
The first would be to design and construct the rear access
drive to the fire access road criteria. This would include a
width of 201, a maximum 8% grade, a surface capable of
withstanding the imposed loads of a fully loaded fire
apparatus and an 80' turnaround.
The second would be to provide some type of feature between
the building and Clarendon Hills Drive that would allow direct
access. This could be a walk, stair or some similar
combination. If you want to pursue this option, we will have
to meet with our operations personnel to design something that
will work. It is entirely possible that this could be
designed into the landscaping on this slope.
The third option would be to provide residential fire
sprinklers which would allow us to waive the normal access
requirements.

Dear Ms. Kleckner:
I own the 10 acres on the corner of South Shields and Fossil Creek directly
across from the proposed Ward Smith development on Fossil Creek and Shields.
I have been to two of the informational meetings. one attended by my wife at
the Voc-Tech Center on Shields and the other at the Applewood Owners
Association at the REA building on South College. I have many misgivings
about this development and its planned use, in particular the proposed
commercial development of Parcel L should not be entertained as a commercial
development. Living where I have in the last two years I have seen twelve to
fifteen cars during the wintertime slide off the pavement either into our
pasture or that corner of Ward Smith's property. I think even with
improvements on the road the topography of the land and the speed and
conditions that form in that hallow make it an extremely dangerous thought to
have high volume or an increased volume of traffic in and out of that corner.
whether the entrance be at Fossil Creek or Shields. We have been told that
Fossil Creek will not be widened so it appears that South Shields would be the
entry point for that commercial development. The obvious rural setting of my
property and the entire Applewood area would be greatly changed by any
commercial development on that corner. They propose to have residential lots
north of that development so it appears to be a very incongruous and
afterthought to develop this commercially.
My recommendations are that this be left as a green space or open area and no
development be allowed at all on that parcel. The development with lighting
and curbs and increased access of roads through Fossil Creek again greatly
changes our neighborhood's character. the rural atmosphere and horse acreage
development of this area.

I hope these recommendations are taken with careful study and would be happy
to discuss these further in person or by phone. I hope that if this is
allowed to be commercially developed a severe restriction on the type of
business put in this area would be in order as the descriptions read to me for
the two major divisions of commercial development have such a diverse group
within each group that the possibility for a completely unacceptable business
establishment would be very great in either one of those classifications.

P.S. I think that any planning and zoning change or alteration should address
itself to the needs and desires of the neighborhood. This project certainly
goes against the atmosphere. style of life and character of our neighborhood.

I have re-examined the proposed Clarendon Hills Subdivision and noted that
an opportunity appears to exist to provide a direct connection into the
northwest section of the Applewood Estates Subdivision. If the proposed
Saratoga Drive were continued to the existing Hilldale Drive, a second
point of access into a large portion of Applewood Estates could be
attained. This would contribute to faster emergency response times into
Applewood Estates and reduce the potential of response impairment due to
blockage of Fossil Creek Drive. For this reason, the Poudre Fire Authority
supports the City's policy of maximizing the opportunities of improving
existing transportation networks and emergency response capabilities for
all emergency agencies.

This is further information regarding the requested variance to the City
of Fort Collins maximum allowable grade for Shields Street in Clarendon
Hills.
I have researched the 1984 edition of "A Policy on Geometric Design of
Highways and Streets, 1984" by the American Association of State Highway
and Transportation Officials regarding their safety requirements.
Chapter VII, Rural and Urban Arterials has a section on grades for urban
arterials and a table for maximum grades. I am enclosing a copy of both.
You will note their maximum grade for rolling terrain and 50 mile per
hour design speed is 7%.
A safety factor that the AASHTO policy addresses is the "critical length
of grade" which determines whether a loaded truck would have an unreason-
able reduction in speed. A 10 mile per hour speed reduction is accept-
able and the Shields Street proposed grade would cause approximately a
6 mile per hour reduction. Since Shields Street will be four lanes, after
improvements are made, this criteria will be less of a factor.
I could not find any discussion of grades in relationship to lack of
traction due to icy conditions in the AASHTO policy. All the stopping
sight distance criteria are based on wet conditions however.
I still feel that the grades we have proposed are justified and that the
AASHTO policy safety requirements will be met.

In reviewing the proposed off -site street improvements for the Clarendon
Hills project, 'it is my opinion that their proposal will adequately address
their off -site street improvements. Those improvements are the widening of
Shields Street from Clarendon Hills Drive north to Harmony Road to
approximately 55 feet wide. This additional width will provide for a more
smooth cross -flow on Shields Street, given the fact that Shields Street
north of Harmony Road has already been widened by previous development.
Additionally, a right turn lane for northbound traffic will be added to
improve the capacity and operating characteristics of this intersection.
This project will also widen Shields Street along their frontage north and
south of Clarendon Hills Drive. Curb and gutter will be added on the east
side. The Transportation Division will have Shields Street restriped so
that there will be adequate turn bays and through lanes adjacent to this
new section. In addition, Shields Street will be widened at the
intersection of Saratoga. This widening will enable a southbound left turn
bay, which will provide for a safer movement for vehicles entering this
portion of the new development.

We have discussed with Jim Newell the City's desire to change the development
agreement for Clarendon Hills concerning the scope and design for the offsite
street work on Shields to come up with a more cost effective solution consis-
tent with its present and near term usage levels. This letter is to state
that Clarendon ]sills Associates, Ltd. is in complete agreement with this con-
cept and will with due diligence exert genuine efforts towards arriving at a
mutually acceptable design solution that is in both of our best interests.
We have agreed to first determine the cost of our obligation under the present
approved design and then to redesign a 36 foot wide pavement section -with
special care given to the access points, that can be achieved within the above
determined cost. This work would be paid for by the developer in complete
satisfaction of the offsite street requirement. At a later date,when full
widening is necessary,the city would be responsible for the entire cost. We
will design today with that future widening in mind so that at that time the
present improvements would be useable to the greatest extent possible.
We are in great need of getting our development agreement signed and plat re-
corded so that we can close on our financing and begin work and produce lots
by fall. Many of the lots are pre -sold and we have committments that we must
meet. Please consider this letter as our agreement to these changes as out-
lined briefly above and allow us to quickly move forward with the redesign
that is in both of our best interests.
