This is in accordance with the drainage concept as approved in the initial development stages of the Col]indale Project. We are requesting a variance regarding the on -site detention for this site. This variance was granted for the Collindale Project and we are conforming to those conditions for this phase. Should there be any comments or questions concerning this, please con- tact me. Collins, CO 80525 Dear Mike: Regarding your letter dated December 9, 1982 requesting a variance in the on -site detention requirenents for Collindale 5th Filing, I have the following comments. Because the drainage policy for the Collindale Subdivision is to utilize the existing detention pond in the Southmoor Village Developmnt, I see no problem with your request. Your request is hereby granted provided the following conditions are met. The storm runoff outfall must be sized to carry the 100-year developed peak flows from the entire area including future phases. High water in the detention pond backing up into the outfall must be considered in the design. Sincerely, Philip G. Box 580 Fort Collins, Colorado 80522 Phone 484-4220 Ex 1'23 ENGINEERING SERVICES October 21, 1983 Larry Cline Bartran Homes 1136 Bent Tree Court Fort Collins, Colorado Re: Collindale, 5th Filing Dear Larry: The intent of this letter is to restate the City's position regarding the fire hydrant and a portion of the water line which appear to have been installed incorrectly on Quail Hollow in the Collindale 5th Filing. As you are aware, you were instructed by our construction inspector that the hydrant and water main would have to be lowered. The water line is to be lowered to a point where the line will have a cover depth of four (4) feet six (6) inches from the finished street surface. The hydrant shall be lowered to the bury line scriped on the hydrant stand pipe. After this work has been accomplished, the City will accept this section of water main pending normal warranty periods. Without full time inspection on private development built public improvements, the City has to assume the required improvements are built to its criteria. Therefore, the burden of compliance rests with the developers, their contractors and engineering firms. Historically this arrangement has worked well with all parties concerned. But, circumstances do arise where mistakes are made with the end result being a hardship to meet certain deadlines for the developer or his contractors. When these do occur the City's position is not to place blame but to insure that the necessary corrective measures are taken, thus reducing the potential for future maintenance costs. Therefore, the developers and their contractors are required through City Codes and agreements to construct developments which are built in compliance with the City's codes, ordinances, policies, design and construction standards. In addition, public right-of-way improvements are subject to warranty periods. Larry Cline October 21, 1983 Page Two As I assume the public improvements installed to date in the Collindale Sth Filing Subdivision have been built in compliance with the previously mentioned criteria and their inspection and acceptance pending the normal warranty periods is complete, your request for their acceptance by the City is valid. Dear Larry: In response to your letter of May 24, 1984 concerning the asphalt pavement on Quail Hollow Court, we agree in part with your proposed alternatives. The fence as it presently exists will remain until the show homes are no longer needed. However, prior to the issuance of permanent Certificates of Occupancy for 1506, 1500, 1501, 1507 and 1517 the fence will be removed and all street damage will be repaired to the most current City street repair policies. When the damaged areas have been corrected the entire cul-de-sac will receive a 11" asphaltic concrete overlay with all incurred costs the responsibility of Bartran Homes Incorporated. Immediately after the overlay has been completed the City will accept this street for full maintenance responsibilities. If your firm is in agreement with these conditions, please sign this letter and return it to me. (303) 2PI-6605 CITY OF FORT COLLINS MEMORANDUM DATE: May 31, 1984 TO: Felix Lee, Chief Building Official FROM: Dave Stringer, Chief Construction Inspector RE: Quail Hollow Court Show Homes, Collindale 5th PUD During construction of their show homes, Bartran Homes has damaged portions of the asphaltic pavement on Quail Hollow Court. The City Engineer's office and Bartran have yet to reach an agreement to insure that this damage will be repaired. However, we do not want to prohibit the builder from marketing his homes and will release the Quail Hollow Court addresses subject to the following conditions: • 1500, 1506, 1507, 1513 and 1501 Quail Hollow Court will only be issued temporary certificates of occupancy by the Building Inspection Department. The above addresses shall be subject to Engineering's approval prior to the issuance of temporary or permanent C.O.'s. A copy of this memo will be kept with the temporary C.O.'s to insure the City's requirements to the builder will be met. Box 5 Omaha, Nebraska 68101-0005 Re: Application No. CO 2SB OXT 008211 Mitigation Plan Dear Mr. Tworek: The mitigation. plan submitted by Martin Kosec, P.E. for Bartran Homes, Inc. for the above referenced application totally meets the needs and concerns of the City of Fort Collins Department of Natural Resources with the exception of one concern. That concern is the requirement for two years of maintenance of the off —site mitigation consisting of the pond and wetland located 1,000 feet north of the wetland proposed to be filled. The two year developers maintenance responsibility should begin upon the final approval of the construction and landscaping. Following that period, the City would assume the maintenance of site of mitigation. The City presently owns the mitigation site. A neighborhood meeting was held to explain the mitigation proposal to all adjoining property owners. There was unanimous consent of those present for the proposal. BRADFORD MARCH Kurt Smith Planning Department City of Fort Collins Dear Kurt: As we discussed earlier, something needs to be done regarding the notice that was filed with the County Clerk and Recorder by your office covering Collindale Fifth. The notice recorded shows a Planned Unit Development known as "Collindale V Filing, P.U.D. and describes the property more particularly as Collindale V Filing. I am not sure how the P.U.D. map read but the subdivision map which is now on file with the County Clerk and Recorder describes the subject property as "Collindale Fifth Filing, a Sub- division, located in the City of Fort Collins, State of Colorado". I need to get the notice to conform with the correct legal des- cription or five years down the line this is going to be impos- sible to untangle.
