RE: Art's Comments Concerning the Legalities of Storm Drainage
Runoff to Spring Creek
Art indicated that he felt that the liability for problems
resulting from the drainage of Brown Farm into Spring Creek would
unquestionably be the responsibility of the developer. He felt
that there was some question as to whether or not the city would
have anv responsibility for the adverse effects of this run off.
The adverse effects which were brought to life by the
the property owners along Spring Creek east of Taft Hill and
south of Drake were: 1. the increased pollutants from insecticides,
or petroleum residues from vehicles and asphalt, 2. the increased
volume of flow in Spring Creek and 3. the possible increase in
ground water which could change the type of vegetation which
might grow on the land thereby affecting its use as pastural
land and/or other agricultural usages.
Art suggested that we contact Mort Pittinger and Associates
concerning the effects of the quality of runoff and the amount of
ground water. There has been a meeting set up for next tuesday
morning (6/29/76) at 9:00 am for that purpose, runoff, streamflow
and the quality of water.

RE: Brown Farm 3rd Filing
The contractor presently working on the subject subdivision has request
ed that we submit a revised detail drawing for the underdrain to be
constructed within the sanitary sewer trench in this subdivision. The
revision is requested due to trench depths exceeding 12 feet. The
contractor feels that the trench bottom should be widened due to this
depth and we concur. We are therefore submitting a revised original of
Sheet No. 25 of 34, Sewer Details, for your approval. The revised
trench configuration will provide approximately 70% more cross -sectional
area and therefore greater drain volume. We would appreciate your
prompt attention as the contractor would like to proceed as soon as
possible.
If you should have any questions or require further information, please
advise.

Dear Mr. Tindall::
Enclosed is the `oils Report for Brown Farm, 3rd Filing. It shows the
groundwater elevations encountered at various test borings and also
recommends that certain procedures be followed regarding basements,
foundation protection, etc.
Apparently, no groundwater was encountered at the depths of borings #1 and 13
at the time the borings were taken. When I told Landmark Engineering
(who took over Hogan & Olhausen) that I thought this was odd, given the
adjacent irrigation canal, the response was that "he had seen stranger
things happen" and that the absence could be due to the sandy soils.
If seepage into your basement gets to be particularly bad, you may wish
to have a soils engineering firm advise you about what can be done -
sump pump, foundation treatment, subdrains, etc.

Third Filing and the related utility agreement between the City of Fort. Collins
and Wheeler Realty.
The plat of the Brown Farm, Third Filing was conditionally approved by
the Fort Collins City Council on April 1, 1975. The City's Engineering Office
has informed us that all conditions have been met, effective February 10, 1976.
Our office kill have the final approved plat recorded at the office of
the Larimer County Clerk and Recorder within 30 days from the date the plat
was signed by the City Clerk.
If you have any questions, please contact either my office or the
Engineering Services Department.

RE Brown Farm Subdivision
The Brown Farm Subdivision was originally developed with single family lots which
incorporated several features which were then unique in a standard subdivision.
These were: the use of limited open space areas to be used as major drainage ways,
community center_ facilities (swimming pool, clubhouse, tennis counts), and a home-
owners association to operate and maintain these facilities.
Tho type of biomes which were built in this area were generally moderate to low
priced Homes for single family units. For this type of housing there is apparently
little _interest on the part of the homeowners for pool and clubhouse type facilities
and the costs that go with them. By dropping the plans for these facilities, the
only reason for the existence of the homeowners' association is for the maintenance
of the limited open space areas within the development. This, of course, is little
reason for the continuance of the homeowners' association from the point of view of
the homeowners. There would appear to be little the City could do legally to
enforce the continuance of the association for the purpose of maintaining the limited
open areas.
We are recommending that the City accept several areas for low level maintenance
under the following conditions:
1. The drainage way which traverses the area from west to east. This was originally
intended to be BO' in width and to serve as a combination open area and drainage
way. This would he reduced to 45' in width which accomodate the larger runoff
from the development and would be maintained on a loci level basis without sprinkling.
This is consistent with maintenance the City will be performing along other
drainage ways in similar areas.
2. The bike path which was originally to follow the major drainage way was
relocated south to provide a better connection with Stuart Street east of Taft
Hill Road and to provide access to the park and junior high school. The route of
the bike path would be maintained by the City on a low level basis which is con-
sistent with other areas.
3. The grassed area adjacent to Taft Hill Road would be maintained by the City on a
low level basis. This is consistent with other areas along arterial streets and
other parts of. the City.
A number of dedication deeds have been Prepared to transfer the areas as outlined from
the homeowners' association and from Wheeler Realty to accomplish the above. Art
March and I have reviewed these dedication deeds and recommend acceptance by the City.

During the first week your contractor began cut -fill construction south of
Blevins .Junior High, Brown Farm 3rd, I called and informed you thnt topsoil
containing organic and other_ deleterious material was being used as fill in future
roadways. In turn, you notified your contractor that this practice was not
acceptable and should he stopped.
Yesterday we made a site inspection of Manchester, Ramboui_llet, and Berkshire
and found indications that this una-cceptable. material was used as fill throughout
the area. We cannot accept these roadways or any other roadways we find in
similar condition until such time as all unacceptable fill material is stripped
and removed from the site.

Brown Farm Subdivision
(third filing, Fort Collins, CO)
Dear Mr. Bingman:
This letter is to protest the development of a storm sewer
in the above named subdivision in such a manner that it will drain
into Spring Creek, a live stream, approximately 100 yards above my
property boundary. There are several points of concern, they are:
1) The natural drainage is being changed so that "run off" from the
addition will be entering Spring Creek approximately one mile above
the natural drainage pattern. 2) This change in drainage will result
in a marked increase in flow during heavy rains increasing the risk of
property damage along Spring Creek by flooding. 3) The change in water
level in Spring Creek resulting from the construction of the storm sewer
as planned, may result in increasing or decreasing the water table of
land adjacent to Spring Creek causing damage to sub -irrigated pasture
lands along the creek. 4) Contamination of Spring Creek by bacterial
and foreign substances will increase greatly as the result of the storm
sewer drainaye of an area to be occupied by several thousand people.
For the above sited reasons, I request that the developer of this
subdivision be required to provide drainage of the subdivision along the
natural drainage course to prevent damage to the property directly below
the proposed site of discharge of the storm sewer.
