Amendment Agreement No.1
THIS AGREEMENT, made and entered into this 7 t � day of
19e, by and be, the CITY OF FORT COLLINS, CO RADO, a mun c ai
corporation ("City"), and HARMONY VILLAGE JOINT VENTURE, a joint venture,
("Developer"), is an amendment to that certain Development Agreement dated
the 31st day of August, 1983, by and between the City and Bob Peterson. By
this Agreement, the aforesaid Development Agreement is hereby amended in
the following particulars:
A. The following replaces paragraph 2.C.(i):
2.C.(i). All storm drainage facilities shalt be completed by the
Developer and approved by the City prior to the release of more than
6 building permits.
B. The following replaces paragraph 2.D.:
2.D.The City agrees to repay the Developer for oversizing Seneca
Street, Regency Street to collector standards and Harmony Road to
arterial standards in lieu of local street standards in accordance
with the Code of the City of Fort Collins, Article 99-6.F. The
redesign of Harmony Road shall be completed by the developer and
approved by the City by June 30, 1985. This redesign can be included
as part of the oversizing costs to which the developer may be
entitled. The developer may be entitled to reimbursement for
construction of portions of Harmony Road, Seneca Street, Wakerobin
Lane and Regency Street in accordance with the Code Of the City of
Fort Collins, Article 99-6.B.(6).
Prior to the release of the building permit for lot 19, the developer
agrees to pay the City 150% of the costs for the removal of the
interim roadway and construction of the final design of Hilburn Drive
to the west end of this property. Prior to the release of the
building permit for lot 2, the developer agrees to pay the City 150%
of the costs for the construction of Seneca Street from the temporary
turn -around to the west end of this property.
C. The following replaces paragraph 3 of Exhibit "A".:
3. Schedule of street improvements to be installed out of sequence.
The construction of Harmony Road, including any Code required
offsite street improvements shall be completed by the developer
and approved by the City prior to the release of the building
permits for lots 2 through 4 inclusive and 7 through 13 inclusive.
IN WITNESS WHEREOF, the parties hereto have set their hands the day
and year first written.

NOTICE
Please take notice that on March 25, 1985, the Planning and Zoning Board of
the City of Fort Collins, Colorado, approved the Final Plan of the planned
unit development known as Belair P.U.O., which development was submitted and
processed in accordance with Section 118-83 of the Code of the City of Fort
Collins. The Final Plan of the subject property together with the Development
Agreement dated March 18, 1985 between the City of Fort Collins and the
developer, out of which documents accrue certain rights and obligations of the
developer and/or subsequent owners of the subject property, are on file in the
office of the Clerk of the City of Fort Collins.
The subject property is more particularly described as follows:
Bel air P.U.11. being a replat of "Villages at Harmony West P.U.O. First Filing
located in the Southeast Quarter of Section 34, Township 7 North, Range 69
West of the Sixth P.M. to the City of Fort Collins, County of Larimer, State
of Colorado.
Offsite easements required for utilities to serve this planned unit
development are recorded with the Larimer County Clerk and Recorder.
