Specifically, Paragraph 2.B.i, provides as follows: When payment is requested by the Developer, the City's obligation for payment shall be limited to those funds then budgeted, appropriated and available by the City for the development or work then completed. You should be advised that, at the present time, City funds are not presently available for repayment of oversizing costs under this provision. This fact should be taken into consideration by you in determining whether to proceed with your development at this time. The unavailability of such funds wil not, however, affect the continuing review of your proposed development by the Planning and Zoning Board according to the standards and criteria contained within the Land Development Guidance System. Efforts to address this problem have been undertaken. Alternative solutions will be proposed to the City Council as soon as possible. The City will make every effort to arrive at a resolution of the problem which will enable the City to continue to cooperate with the development community in promoting responsible land use and development. Jim: This letter, is in regards to our conversation yesterday concerning the property located at 800 Lemay. At the north lot line of the above property there is a discrepancy of 2.61 feet between the center line of Lemay and the true section line. The true section is 2.61 feet west of the center line of Lemay. The legal description for the 12' utility easement which parrallels Lemay on the east side is written of the center line of Lemay. In order for us to construct the proposed building and meet the parking requirements as set by Peter Barnes we need to utilize our full east west lot dimension. Because of the above discrepancey our building will protude 1.61 feet into the existing utility easement. We respectfully request that the east 2 feet of this utility easement be vacated. The following is the legal description of this utility easement that we request vacated. Commencing at the West quarter corner of said Section 18; thence along the centerline of Lemay Avenue, North 00000100" East 899.94 feet; thence South 90000100" East 60.00 feet to the true point of begining of this description, thence along North 00000100" East line, South 71.00 feet; thence along South 9000010011 East line, East 2.0 feet; thence along North 00000100" East line, North 71.00 feet; thence along South 90 00'00" line, West 2.0 feet to the true point of begining. Containing 142 square feet or 0.003 acres. You will find enclosed 10 copies of visual aids showing this 2 feet of vacated easement. Please call me if you have any questions.
