Tract J, I would like to take this opportunity to address four issues that should be resolved prior to final approval. In discussing the preliminary with the Transportation Director, I learned that it had been an assumption that the Shire Court intersection at Shields Street would be closed off and access would be gained through the Life Care site. Since this will not be possible given the site plan for Tract J, it will be nccessary to amend the Traffic Impact Analysis to assess the impacts on Shields due to keeping Shire Court open. It is very likely that the Life Care access and Rolland Moore Park access will be signalized in the near future. This signal will affect the functioning of the Shire Court intersec- tion. The amended Traffic Impact Analysis should be part of any final submittal. 2. The Life Care internal access drive is now proposed to be private. Please be aware that this private intersection with an arterial street signal will raise issues that must be resolved. It is likely that the development agreement will contain a provision that the private street design be of sufficient quality in order to allow the functioning of a sensing device to actuate the traffic signal. Further, in• the event of pavement failure, the City must reserve the right to immediately repair in order to maintain the sensing device in proper working condition. Any costs associated with maintaining poor pavement associated with the traffic signal would be charged to the owner of the private street. In general, Staff would like to point out that the decision to use a private street versus a public street may be a potential disadvantage to the dcvclnper in the long run. First, the future townhomcs on the third t�hasc of Tract J is a speculative land use at this time. Yet the access to the arterial is planned to be private. If the land use in the third phase was to change, then perhaps a private access to the arterial may not be desirable or workable and this area would be "locked in". Perhaps the project would enjoy maximum flexibility if the access drive were dedicated as a public street. Second, it is likely that employees, customers, tenants, visitors and delivery drivers will find it attractive to use Centre Avenue to access either Prospect or Drake to avoid the Prospect -Shields or the Drake -Shields intersections. This alternative will appear attractive to any driver wanting to head to the cast part of town to such destinations as the Poudre Valley Hospital or College Avenue. Third, the City would provide the maintenance of a street that would, in all likelihood, carry the traffic loads usually associated with a public street. For the reasons of flexibility, traffic loads, and maintenance, Staff is encouraging the reconsideration of the internal access drive in favor of a public street. If the strict interpretation of the minimum centerline radius of 240 feet for a local residential street and 610 feet for a collector street are unworkable, Staff would consider a variance to the standard. 4. Staff would like to remind the applicant that City participation in the Senior Service Center is subject to the review of a the Choices '95 Citizen Advisory Committee. No assumptions should be made until this committee makes it report and City Council has taken action. Staff is looking forward to working with all interested parties on the develop- ment of Tract J. As always, please feel free to call if there are any questions or concerns. Box 580 Fort Collins, Colorado 80521 RE: CENTRE VILLAGE - SHIRE COURT SIDEWALK Dear Mike: This letter is in regard to the sidewalk construction imposed on the Planning and Zoning Board on June 27th as a condition for final approval. A field :investigation reveals that if the sidewalk is constructed to city standards most, if not all the existing elm trees along the south side of Shire Court will be damaged or removed. We therefore request a meeting with, or direction from, yourself and Tim Buchanan as to how this con- struction is to be facilitated. As you are aware we are trying to gain final approval on these plans as soon as possible. We have been asked to submit original mylars for final signature by July 5. Our client wishes us to resubmit even sooner. The mylars are ready for resubmittal now, therefore this is now the only outstanding issue.
