District has approved the construction drawings dated July 1990
prepared by Engineering Professionals, Inc. which are attached
hereto as Exhibit "A" with respect to the construction and
installation of a sewer line on the property commonly known as
Brittany Knolls.
This letter will evidence the District's consent and authority
to Brittany Knolls North, Inc. and its agents to enter upon the
real property described on Exhibit "B" for the purpose of
installing the underground sewer line in accordance with the
construction drawings attached hereto.

Dear Mr. and Mrs. Tyler:
Thank you for your letter raising a variety of issues related to
the development around Brittany Knolls. Hopefully, this letter
will help explain some of the City policies affecting your
neighborhood. I have also enclosed a letter from the City to your
neighbors, Dan and Mary Flemings, since the issues concerning
mosquitos, Lemay Avenue widening, and park and recreational
facilities that you raised are thoroughly addressed by this
previous correspondence.
1. Prairie Dogs
Unlike the Flemings, who asked about broad City policy towards
prairie dogs in general, you are asking specifically about prairie
dogs on your private property. The City has no policy about
prairie dogs on private property. As owners of private property,
you have the right to protect your investment. If, in your
opinion, prairie dogs are damaging your porch, lawn, or
landscaping, then you have full rights of property ownership to
take protective measures. Protecting your property from large
rodents is not a land development issue that comes under the
jurisdiction of the Zoning Code or the Planning Department.
The Department of Natural Resources is presently investigating the
prairie dog population on the City -owned Southside Service Center.
This parcel is a 50 acre tract that includes the City of Fort
Collins Transfort Facility. Preliminary findings suggest that
maintenance of some of the prairie dog population is needed to
provide prey :base for the birds of prey which use the area in
winter.
You are encouraged to contact Rob Wilkinson, Senior Environmental
Planner, 221-6288, for further information regarding an overall
management policy, or particular issues related to Brittany Knolls.
The next issue raised in your letter concerns mosquitos and
wetlands. Here, I will refer you to the letter from City Manager
Steve Burkett to the Flemings. This letter is enclosed.

2. Trash Bins and Portable Bathrooms
When the developer of Brittany Knolls gained City approval to begin
construction, he (and his successors, heirs, and assigns) entered
into a development agreement which regulates construction activity.
The particular agreement with Brittany Knolls states:
"The Developer shall, at all times, keep the public right-of-
way free from accumulation of waste material or rubbish caused
by the Developer's operation, shall remove such rubbish no
less than weekly and, at the completion of the work, shall
remove a:11 such waste materials, rubbish, tools, construction
equipment, machinery, and surplus materials from the public
right-of-way. The Developer further agrees to maintain the
finished street surfaces free from dirt caused by the
Developer's operation. Any excessive accumulation of dirt and
or construction materials shall be considered sufficient
cause for the City to withhold building permits and or
certificates of occupancy until the problem is corrected to
the satisfaction of the City Engineer. If the developer fails
to adequately clean such streets within two days after receipt
of written notice, the City may have the streets cleaned at
the Developer's expense and the Developer shall be responsible
for prompt payment of all such costs."
You are encouraged to call Dave Stringer, Chief Construction
Inspector, 221-6605, to report any violation of the above
requirements.
At present, their is no provision in the City Code to require
portable bathrooms on construction sites. My suggestion is to
contact Dr. Johnston, Larimer County Health Department, 498-6700,
to report any problems in this area.
3. Lemay Widening and Park and Recreation Facilities
The final two issues contained in your letter concern the widening
of Lemay Avenue and the timing of city park and recreational
improvements in the vicinity of Brittany Knolls. As with the
mosquitos and wetlands, these issues are explained in the enclosed
letter to the Flemings. I encourage you to contact any of the City
staff if any questions remain on these two items.
Please note that the letter to the Flemings contains additional
information regarding two development proposals in the general area
of Brittany Knolls. These two projects are the Redeemer Lutheran
Church and the Poudre R-1 School District Bus Barn Facility.
Since the response to the Flemings, the City of Fort Collins
Planning Department and Poudre R-1 School District have agreed to
hold a public neighborhood information meeting. This meeting will
be held on Wednesday, May 6, 1992, from 7:00 to 9:00 p.m. at the
Transfort Bus Facility, 6570 Portner Road. Representatives from
Poudre R-1, and the City Department of Natural Resources will be on
hand to explain the Bus Barn project and the prairie dog management
policy. You and your neighbors will be receiving notice of this
meeting under separate cover.

Re: Drainage System Revisions and Field Meeting -Brittany Knolls P.U.D. Filing 2
Dear Mr. Connell:
This letter is to summarize our discussions, from our meeting today, concerning the need to
revise the drainage system after seeing the results of a large storm event last Spring. It was
obvious from our tour of the area there is a lot more attention being paid to the grading of
individual lots and several areas of concern have been corrected. Also, the inlet filters on the "on
grade" inlets need to be removed. I would suggest other methods of erosion control be used that
will keep the soil on the individual lots instead of trying to catch the sediment at the inlet.
The flooding that occurred on lot 59 (6309 Buchanan Court) appears to have been corrected by a
concrete trough and a timber retaining wall. Also lots uphill are being graded to divert some of
the flow to the street so it won't flow to lot 59. Some regrading was done along the rear lot lines
of lots 55 through 60 but we didn't look at it. Since neither of these design modifications were
submitted to the City I am in no way certifying the adequacy of the design. I do feel both are
improvements and suggest they be certified by a registered professional engineer.
Our primary discussion was concerning the overflow swale between lots 8 and 9 (6360 and 6354
Buchanan Street) as well as the riprap downstream in Stone Creek near the box culverts under
Lemay. Some of the items discussed were:
- Having your civil engineers take a look at the whole situation and recommend some
revisions. One of the major changes from the original plan to be considered is that the front
of the lots along; the north side of Buchanan Street drain toward the street instead of to Stone
Creek at the rear of the lots.
- Lowering the overflow swale invert since the river rock the homeowner had placed is above
the top of the back of the sidewalk.
- Construction of a grouted riprap swale in place of the loose river rocks.
- A concrete low flow pan down the middle of Stone Creek in the area where water is ponding
as well as pans from the street culverts to direct flow to the center of the box culverts under
Lemay.
- Possibly reducing the amount of riprapped area and grouting whatever riprap is needed for
bank protection. One method discussed to reduce the riprap area was to flatten the slope

from the back of the lots and use vegetation for stabilization. This would also address some
of the standing water problem. However, it depends on the channel section needed to convey
the 100 year flow.
- Possibly regrading the south bank of Stone Creek now that all the different builders are finished.
A new issue I just noticed while putting this letter together is that one set of plans shows three sets
of inlets along Buchanan Street (six total). I only remember seeing inlets on both sides of the street
between lots 8 and 9. They are shown to be on both sides of the street between lots 13 and 14 as
well as both sides of the street between lots 17 and 18. I remember seeing them on the south side of
the street but not on. the north side. This could have a big affect on the flooding on lot 9 since that is
where all the water ends up. I believe that plan set was revised so since I don't get signed utility
drawings what is built may be correct. Even if it is correct this may be a partial solution to the
problem between lots 8 and 9.
The process to get revisions approved was also discussed. The best way is to do these as plan
revisions on the original mylars so only Stormwater and Engineering need to sign the revision
block. Along with the plan revisions there needs to be at least a letter report explaining the
revisions which would include the back up calculations. You indicated there was a chance this
work could be completed soon if the weather conditions continued to be good. Stormwater will be
able to release the holds on permits and certificates of occupancy as well as take ownership of Stone
Creek if these concerns are addressed.

RE: Brittany Knolls Subdivision - Vacation of Buchanan Street, Lots 29 and 30
Dear Ben:
On March 14, 1996 1 received an invoice through the Engineering Department from
Brittany Knolls North documenting the costs associated with the recent removal,
vacation, and reconstruction of Buchanan Street adjacent to Lots 29 and 30. As you
know, the development agreement and plat approval stipulate that no building permit
was to be issued for Lot 29 until either a temporary turnaround was provided at the end
stub of Buchanan Street (either on the Brittany Knolls property or off -site on the City's
property) or until Buchanan Street was extended to the west to connect to Portner
Road. Since the City acquired the property to the west for natural area, the extension
of Buchanan Street was precluded. However, per the development agreement and City
Code, it was necessary to provide a temporary turnaround in order to obtain a building
permit for Lot 29.
As it turned out, a building permit was issued for Lot 29 without the provision of a
temporary turnaround as stipulated in the development agreement and required by City
Code (Section 29-657 (b) and (c) attached). Therefore, the developer never had to
incur the costs of either: (1) an off -site temporary turnaround (including acquisition of an
easement from the City) or (2) the construction of a permanent cul-de-sac to City
standards (including additional right-of-way from Lots 29 and 30). By the time the
matter came to the City's attention, the City had acquired the property to the west and it
was undesirable to have the developer construct a permanent cul-de-sac to serve only
one lot. It was del -ermined that the street stub should be removed and access to Lot 29
would be via a driveway out to the intersection of Buchanan Street and Victoria Road.
The invoice received reflects the total cost of those improvements which are a result of
the City's acquisition of the property to the west; however, the invoice does not reflect
any adjustment for the costs the developer was to incur in order to receive a building
permit for Lot 29. Since the developer had an obligation that was not fulfilled, please

revise the total costs to subtract out the cost the developer would have had to incur for
providing a cul-de-sac before receiving a building permit on Lot 29. With the revised
cost estimate, please provide a cover letter addressed to my attention. I will then
forward the invoice to the City's Risk Management Division as a claim against the City.

Dear Ted:
At this time, we are requesting a variance to the Solar Orientation Ordinance for Brittany
Knolls Filing No. 2. Hopefully with this letter and the accompanying Preliminary Plat
Submittal, you will find enough documentation to grant this variance.
Brittany Knolls Filing No. 2 is the final parcel of residential area as was planned under
the Master Plan Submittal back in 1986.
2. Due to site construction imposed by the existing Brittany Knolls Filing No. 1 and the
replat to Filing No. 1, we need to connect the existing platted road R-O-W.
3. The existing grades of the site slope to the north, northeast and east make it necessary
to orient the roads and lots accordingly.
4. We are also constricted on the north and northeast side by an existing drainageway and
a designated wetland.
5. There is also an existing South Fort Collins Sanitation District Sanitary Sewer which
we are incorporating into the proposed lot and street configuration.
Due to the above listed constraints, Brittany Knolls Filing No. 2 will only be able to have
30% of the lots conforming to the Solar Orientation Ordinance.

Ted, I notice that Phase 2 of Brittany Knolls is scheduled for final
approval. There are :special assessment liens on the property that
total $300,000+. Right now the owners are delinquent in one assessment
payment and have another .due in June. If no payment is made, the land
will be offered at this year's tax sale.
In any event, the assessments will need reallocation so that each
platted lot bears an assessment. I'd like to see a copy of the
final plat so we can begin the reallocation process. Let me know
if you need any more information.

The City is currently looking into the prairie dog issue with the aim of
developing an overall management policy. For the time being, land use
regulations are being used to protect the areas when appropriate, and some
experimental techniques are being considered to offset conflicts between prairie
dog areas and developed areas. The Department of Natural Resources hopes to have
policy recommendations formulated within the next six months for consideration
by City Council. Rob Wilkinson, Environmental Planner, 221-6288, is available
to answer any further questions on this issue.
Wetlands/Mosquitos
The City is dedicated to the protection of wetlands in light of their value as
wildlife habitat. and in the role of protecting and improving water quality. Some
wetlands can serve as breeding areas for mosquitos, and this is a concern the
Department of Natural Resources is now beginning to address. The Department of
Natural Resources is attempting to understand the habitat characteristics of
local mosquito species, as well as any potential health threats.
The Larimer County Health Department is currently responsible for mosquito
control and health issue monitoring. They have been exploring the feasibility
of using integrated pest management techniques for mosquito population control.
Integrated pest management represents a departure from more traditional chemical
control techniques in that it also promotes the use of biological agents (e.g.
Gambusia fish) and habitat manipulations to control mosquito reproduction. In
so doing, integrated pest management techniques could be considered to be more
environmentally sound, as well as more preventative in orientation. Again,

3. Lemay Widenin
The City expects to widen South Lemay Avenue between Southridge Greens Boulevard
and County Road #32 (one mile south of Trilby) as development occurs. Because
of the expense of building roads, developers, not tax -payers, are asked to
construct improvements adjacent to their development. Additional right-of-way
must be dedicated to the City on the east side of the road in order to widen to
the full arterial standard. If the recent past is any indication of the rate of
development, it could be five to ten years before the volume of traffic demands
a wider roadway. Mike Herzig, Development Engineering Manager, 221-6750, can
provide further details on arterial street improvements in your area.
4. Right -Turn Lane/Stoplight - Trilby and Lema
The City Transportation Department advises that there is no schedule whereby
Lemay will be widened or a southbound right turn lane added at Brittany Street.
These improvements will only be constructed in conjunction with future
development of the general area. In addition, the nature of the future
development must be such that it generates the need for such improvements.
It is the City's policy to construct traffic signals only when "signal warrants"
are met. These warrants are a set of detailed criteria, based on national
standards, that must be met or exceeded before a traffic signal is determined to
be needed at an intersection. The intersection currently operates within
acceptable standards in terms of traffic volume and safety. It is likely that
if residential and commercial development occurs in the area at sufficient
densities, a traffic signal will be warranted, as development occurs, within the
near future. Generally, once a signal is warranted, and designated to be
constructed, there is a one to two year time frame before the signal is
operating. If you have any questions regarding transportation issues, please
call Eric Bracke, Transportation Planner, at 221-6608.
5. Recreational Facilities
There are three recreational facilities planned for your area:
A. Fossil Creek Trail
The Fossil Creek Trail will be the third major bicycle and pedestrian trail in
the city. It will connect Seven Springs Ranch on the west (west of Taft Hill
Road and south of Taft Canyon Estates) to Fossil Creek Reservoir on the east.
The Parks and Recreation Department is currently acquiring right-of-way and trail
easements as development occurs. An easement will be obtained from Brittany
Knolls, Filing Two in the north and east portions of the site. In addition, the
Planning Department is exploring a trail connection from Filing Two over to the
trail. It is likely that the trail will be constructed in increments of no less
than one mile so each link will have a recreational benefit.

B. Fossil Creek Community Park
Fossil Creek Community Park is located north of Brittany Knolls and surrounds
Portner Reservoir. It has been conceptually master planned but there are
currently no funds for construction. It is important to make the distinction
between community parks and neighborhood parks. A community park, like Rolland
Moore, City Park, Edora Park, and Martinez Park, serve as the focal point for
community -wide activities, and are funded through a bond issue or special sales
tax. Neighborhood parks are considerably smaller and are distributed around the
City, usually one per square mile section, and are funded by parkland development
fees on a per unit basis.
Fossil Creek Park was in contention for funding in the Choices 95 capital
improvement plan but was cut from the final list of projects that was presented
to the voters. This deletion was a decision made by the Choices 95 citizen
advisory committee and the City Council based on the lack of population density
in the general area. Consequently, the park will not be constructed by the funds
in the current capital improvement plan.
C. "Paragon Point" Neighborhood Park
Paragon Point P.U.D. is a residential development project located across Lemay
Avenue to the east of Brittany Knolls, between the golf course and Trilby Road.
Within this development, a neighborhood park is being planned. Under a unique
arrangement, the developer proposes to construct the park and turn it over to the
City for ownership, operation, and maintenance. If the details can be finalized,
the park would be built by November of 1994.
Leslie Bryson, Park Planner, 221-6640, is available to answer any questions on
the details of any of these three proposed projects.
6. Other Development
There are two development projects being planned for your general area:
A. Redeemer Lutheran Church
The Redeemer Lutheran Church has purchased five acres located at the southeast

B. Poudre R-1 School District Bus Barn
The School District is in the process of negotiating a purchase of six acres of
land located on the west side of Portner Road in the Southside Service Center.
This parcel is west of the existing City Transfort facility and is planned to
house 30 buses for the southern school bus routes. Ted Shepard, 221-6750, is the
City Planner assigned to this project and is also available to answer any
