Dear Mr. Zdenek,
City Staff has reviewed your submittal for Boston Chicken at Lemay and Pennock PUD- Final,
and offers the following written comments:
1. Review of these plans should not be construed as a commitment that telephone facilities
sufficient to serve this project are presently available. US West will provide telephone
service in accordance with the rates and tariffs on file with the Colorado Utilities
Commission.
2. The developer is responsible for providing conduit or trench for telephone facilities
within the project. Please refer to the US West Communications engineer for more
information (303-224-7470) Provision of all trench, street crossings, and ditch crossings
for telephone facilities within the project, and the developer pays up front construction
costs for facilities within the development.
4. Any relocation of existing telephone facilities required by these plans will be paid for by
the developer.
5. The developer may choose to provide joint trench for electric, television, and telephone
cables. In this case the developer coordinates the placing sequence of each utility.
6. You will need to coordinate a transformer location with Light and Power. Please contact
Bruce Vogel at 221-6700.
7. Relocation of streetlights is at the developer's expense and is in addition to normal Light
and Power development charges.
8. Please reword note number 6 on the Site Plan to read, "All signs must comply with the
City Sign Code. Sign permits are required for all signage and are obtained through the
City Building Department."
9. The ID sign must be a minimum of 15' from any side lot line (property line).

10. Please refer to redlined utility plans and landscape plan for comments from the City
Water and Wastewater Utility.
11. The Mapping Division of City Engineering has found some errors on the plat. The acres
in the "legal" are not correct. The 15' distance near the NW corner of the plat should
be moved down to the easement line. The plat must state the scale of 1"= 30'.
12. A soils report was not submitted. Please contact Mike Herzig or Kerrie Ashbeck for
information about the required soils report. The project can not advance to the final
Planning and Zoning Board hearing without the soils repoii.
13. Additional details are needed for the site curb, gutter, and walk installation.
14. Please submit a plan for the interior drive pattern/striping plan. Use turning templates
to establish driveway geometry. It appears that the building could be shifted to the east
and that the row of parking behind the building could function as a one-way.
15. Engineering would like to discuss the Pennock/Lemay intersection, site circulation,
stacking space for drive-thru lanes, future connection locations, etc.
16. Please refer to additional comments on the utility plans, which have been sent to your
project engineer.
17. Please include a note on the landscape plan that existing trees shall be pruned to City of
Fort Collins medium prune standards. The landscape plan does not show the location
of specific trees/shrubs. The key and plan need to be related.
18. Please provide bike racks for both restaurants. Planning would like to discuss the
pedestrian/bike circulation system with you. There should be a safe way for pedestrians
to get from the sidewalk along Lemay and from adjacent properties to the restaurants.
19. The site and landscape plans need to reflect the future curb cuts with islands. No
landscaping should be shown and the access points, on this property, should be
constructed with this development.
20. Staff would like to meet to discuss the architectural details for the two projects. The
building, roof, and awning colors should be complimentary, if not the same. The Boston
Chicken on South College is proposing a maroon, off-white, and gray awning which staff
would like to see on this building. If this is the case, the bright reds and greens of
Schlotzsky's would not be compatible. Staff would like the awning colors to be the
same tones, i.e., same reds, grays, blacks, etc. Please submit samples with your
revisions.
21. The Planning and Zoning Board has concerns about the setback from Lemay to the
parking lots, the amount of asphalt on the site, and circulation through the site.
Additional landscaped islands should be added along Lemay, as well as in the interior of
the site.
22. Drainage comments will be forwarded under separate cover. If you have questions,
please contact Basil Hamdon or Glen Schlueter at 221-6589.
23. Please include the energy conservation information in note form on the site plan,
following note #14.
This concludes staff comments at this time. In order to stay on schedule for the March 28, 1994
Planning and Zoning Board hearing, please note the following deadlines:
Plan revisions are due March 9th by noon (4 sets of plans and written
documentation responding to the above concerns).
PMTs (one PMT of each plan sheet), colored renderings, and 8 prints are due
March 21.
Final mylars and other documents are due as soon as possible following the hearing.
Please be aware that the development agreement and utility plans must be signed
prior to the Planning and Zoning Board Hearing, for all PUD's. If not, a condition
will be placed on the project giving you 30 days to finalize the plans and agreement,
after which.. time, you must submit a request for an extension, to the Planning and
Zoning Board.

The canopy for the drive thru area is within the drainage easement - this easement will
need to be vacated (if possible) prior to the canopy being built. Since this is a drainage
easement stormwater will have to agree that the easement in this area can be vacated.
Provide a drawing with dimensions of the area proposed for vacation (including
dimensions from property line. If stormwater agrees that the easement can be vacated - I
will need a legal description prepared by a licenced surveyor and a sketch showing the
area proposed for vacation. The vacation will go to the Planning and Zoning Board and
will not be taken until the meeting following the hearing for the project. (See attached

• It appears there might be a conflict between some trees and the sewer cleanout in the
island and the placement of a tree over a sewer service. r .t.
If there are modifications to the previously approved drainage plan (sheet 4 of 5) (change in
grading, change in the ponding) than this plan needs to be submitted for review and will need to
be signed as a revision. If there are significant changes to the buildings services than the overall
