Best Buy P.U.D. is located on the hb zoned 2.73 acre parcel just
north of Phar•-Mor on College Avenue. At this location, the P.U.D.
allows convenient access from an existing right-in/right-out on
College or from Troutman Parkway. This site provides an excellent
link between Fountainhead P.U.D. on the North and Marketplace
P.U.D. on the South by utilizing internal pedestrian and vehicular
connections. A detached walk along College Avenue, planted with
street trees also improves pedestrian circulation between retail
sites.
The location, setbacks, landscaping, and other characteristics of
this P.U.D. will be similar to that of Market Place P.U.D. It will
utilize a variety of shade trees and ornamentals in a semi -formal
design, with generous ground cover. Best Buy will be provided with
179 parking spaces, with bicycle and handicap parking close to the
front entry.
The building will be approximately 27' high, with a parapet sign
on the front as a focal point of entry to the store, with excellent
visibility from College Ave.
Best Buy P.U.D. will help "tie together" the existing P.U.D.'s to
the North and South, while maintaining it's own identity.
Construction is scheduled to begin in August 1992 and completed by
December.

Re: George Holter/Best Buy Access Permit
Dent Dean:
This letter is intended to explain the current status of the Best Buy site in
Fort COMM, Colorado.
The Best Buy project was originally to be developed by George Holter with
the building and site improvements to be leased by Best Buy. A need for an
access permit was identified to allow for the completion of a deceleration lane
to State Highway 287. This permit was applied for by George Holter in July
of 199L
During tho approval process, the decision was made by Best Buy to purchase
tbo property from George Holter and to become the site developer. As the
site developer, Best Buy will be responsible for the con_stnlction of the
improvements as identified by the construction plans approved by the City of
Fort Collins and as defined an the approved State Highway Access Permit
issued by the State of Colorado Dcparllucut of Transportation. As you
requested the access permit will be signed by George Holter since he was the
permitme on the original permit applicdtiun. The access permit will also be
signed by Best Buy as the new owner of the property and developer of the $its
improvements.

This letter is in regard to the correspondence from Parsons & Associates dated November 2,
1992, a copy of which you FAXed to me this morning.
Upon review of said letter, I have the following comments:
1. The spoil material was not located where indicated on Sheet 4 of 7 of Parsons drawings,
because there would have been no room to stage the job during construction; because it
very quickly became evident that the area shown was going to be too small for the quantity
of spoil material actually removed from your site; and because conversations with Mr.
Couch led me to believe that this area would most probably be included in the future
permanent built-up area on Mr. Petersen's site.
2. Mr. Petersen requested a grading plan from Mr. Couch in early September. Mr. Petersen
received a very simple sketched plan on October 29, 1992 and I met with Mr. Petersen that
morning to discuss how he wanted to proceed. Mr. Petersen did not feel that placing a pad
at a final elevation of 5036' was appropriate as the Best Buy finish floor elevation is at
5033'. He therefore requested that I prepare an estimate to place a compacted pad at a
maximum elevation of 5032.5', which I am in the process of doing at this time.
3. 1 spoke to Mr. Paul Hoffman on October 22, 1992 and told him that I understood his
concerns regarding the project the Neenan Co. is doing for First Interstate and that we were
waiting for a grading plan to be submitted to Mr. Petersen before we moved any material as
Mr. Petersen was not interested in paying to have materials moved twice. Mr. Hoffman said
he would contact Parsons & Associates.
4. 1 spoke to Mr. Glen Schlueter at the City of Fort Collins Stormwater Utility this morning
and assured him that we are working to resolve this issue. He will grant a conditional
Certificate of Occupancy for Best Buy.

5. 1 have been working on having most of the spoil material removed from the site as the
opportunity has presented itself and have found a contractor that can use almost all that is
presently stored. They were scheduled to begin removal and trucking operations on
November 2, 1992, but the snow fall that started early in the morning precluded this.
Should they be able to begin removal this week the whole issue will become a moot point
very soon.
6. It is not up to Best Buy to resolve this issue.
7. We will handle the coordination of the disposition of the stockpiled spoils materials with
Mr. Petersen, the Neenan Co. and the other pertinent interested parties.
