I have a MAJOR conflict with our meeting this morning at 9:OOAM. I have
already met with the engineer for this project, so he knows what we will do.
We'll tie gas mains east and west of the project together and serve these
small houses. Problems are: who will use front lot easement, where will we
go if street trees are in the way, and are gas mtrs on non -driveway side of
house going to work. That means no sewer or water on those sides. Please

This letter is in response to your request for information regarding road construction on
Bennett Road. At this time, the City Engineering Inspector for the Bennett Road
Bungalows project foresees that there should be no problem completing the
improvements by August 12`h, barring weather difficulties and assuming that the School
District's improvements to the bus drop-off area will begin promptly.
Since the project's schedule is variable, please feel free to contact Bill Nichol with
Gerrard Excavating at (970) 669-1463 for the most up-to-date information on scheduling.

I received your verbal notification to proceed this morning. Gerrard's field personnel and
representatives of Pierson Concrete have had discussions on how to proceed and the schedule for
the work. With the timing of the approvals and notification to proceed, a formal schedule will
not be submitted. We are anticipating that the project will be paved no later than the 16' of
August and hopefully prior to that with the use of high -early concrete in the pans and curb and
gutter.

Please review the attached plans for the grading changes to the storm water easement at the front
of the lots.

I would prefer to have the letter emailed or ready for me to pick-up at your earliest convenience

Citizen Complaint: 11/02/01, 10:00 a.m
Ray:
A citizen called today to express his concerns over a new development in his neighborhood. His name is
Dean, and due to prior experiences with the City of Fort Collins he would not leave a last name or contact
information. He stated on prior occasions he'd turned in a neighbor for zoning violations and was then
confronted by the neighbor resulting in the police being called for protection.
His complaint is about the Bennett Street Bungalows. According to Dean a meeting was held, which the
City denies knowledge of, and only three people attended the meeting. A second meeting was held which
was lead by the developer. Traffic, Poudre School District, and Stormwater showed for the meeting and
appeared openly concerned about the issues at hand. However, the leader of the meeting, according to
Dean, was very biased and hostile about issues, pushing forward the approval of his development project.
Dean is very concerned that issues are being brushed under the carpet and the developer is not being honest
in his pursuit for approval. Dean believes the developer's name is Steven Ault, though he is not sure.
Dean's most pressing concern is that traffic was measured, for one day only, on a day that the school was
closed for parent -teacher conferences, thus not measuring the true volume of traffic. He requests we send
the Traffic Department back out to re -measure the traffic on a normal school day.
Dean will be sending further information to unnamed parties within our government. He is considering
contacting a television news crew if his concerns are not heard and responded to. He feels the Mayor is
concerned about protecting the City we live in and has hopes the Mayor will respond quickly. He feels the
City should be run the way it used to be when developers weren't so uncontrolled.

RE: Variance Request for Bennett Road Bungalows
Northern Engineering, on behalf of the Developer for the Bennett Road Bungalows project, has
submitted a variance request to the Larimer County Urban Area Street Standards. The variance is for a
sight distance easement. The sight distance is requested to be shorter (210 feet) as opposed to the
standard sight distance of 310 feet.
Typically, the City requires that the sight distance required on a local street with a design speed of 30
miles per hour would be 310 feet measured along the flowline of the street (Figure 7-16, LCUASS).
This distance is to ensure the safety of both the motorists on the road and those entering the roadway.
The engineer believes that this variance can be supported due to the curve in the road, resulting in a
lower actual speed than the design speed. The engineer assumes a 20 mile per hour speed around the
corner which coincides with a sight distance of 210 feet measured along the flowline of the street.
It is my opinion that this variance can be supported based on the fact that the sharp curve in Bennett
Road as it turns into City Park Avenue does result in lower speeds, reducing the sight distance needed
for the safety of motorists on and entering the roadway. The assumption of 20 mph met with the
approval of Traffic Operations.

This letter is in regards to the Bennett Road Bungalows project, and in particular, to request a
variance. Our client for this project is Spanjer Construction Corporation.
The specific area of concern is the driveway location for Lot 1. During the course of the project
review, it was determined that the best location for a driveway for Lot 1 would be in the
northwest corner of the site (see attached sketch).
Bennett Road does not currently meet any current street standard width (40' flowline to flowline
in the narrow section), but has been assumed that the design speed for a local residential street
section is 30 mph. Accordingly, the minimum required sight distance triangle for a 30 mph design
speed would be 310'. The City criteria also calls for a minimum centerline radius of 165'.
The variance we are requesting is that the sight distance triangle for the driveway for
Lot 1 be reduced from 310' to 210', as shown.
The existing centerline radius in Bennett road is approximately 101.50'. Typically, one would
find a design speed of 20 mph for that tight of centerline radius. Similarly, a sight distance
triangle for a 20 mph design speed is 210'.
Therefore, we feel justified in requesting the variance. This allows the driveway to be placed as
shown, in a location that the developer, and City staff believes provides the best protection of
pedestrians, traffic, and the ultimate property owner. We do not feel that this variance will be
detrimental to the public health, safety or welfare, nor will it reduce the design life of Bennett
Road or cause the City of Fort Collins additional maintenance costs.

This letter is in regards to the Bennett Road Bungalows project, and in particular, to request a
variance. Our client for this project is Spanjer Construction Corporation.
The specific areas of concern are the driveways. During the course of design and review, the
developer, Northern Engineering, and Land Images, wanted to maintain separate driveways for
each individual lot, which would have been incompliance with the current City standards. At the
utility coordination meeting, Roger Buffington expressed his desire to minimize the number of
utility crossings, and therefore it was directed by City staff to combine driveways where possible,
and split them off to each individual lot. The developer agreed that this is a reasonable request,
and amended their design to help minimize possible additional maintenance for the City Utility
Department.
Therefore, because of the above mentioned design suggestions of City staff, we understand that
we are required to request a variance to City standards. Therefore, on behalf of our client, we are
requesting a variance from City standard 9.4.2, stating that driveways be extended straight and
perpendicular from the street back into the lot for a minimum of 25'. We request that we be
allowed to install the driveways as shown in the attached sketch.
As this was a joint decision between the developer and the City staff, we feel justified in
requesting the variance. This allows the minimum amount of utility crossings, in locations that
the developer, and City staff believes provides the best protection of pedestrians, traffic, and the
ultimate property owner. We do not feel that this variance will be detrimental to the public health,
safety or welfare, nor will it reduce the design life of Bennett Road or cause the City of Fort
Collins additional maintenance costs.

Dear Mr. Curtiss,
This letter is in response to your request for a variance to the Larimer County Urban Area Street
Standards. The variance requested was a reduction of required sight distance from 310 feet to 210 feet.
This variance has been approved by the City Engineer only at the location of the corner of Bennett Road
and City Park Avenue.
As with all variances to the street standards, this variance granted for this project is based on the particular
situation under design and the judgment that we (the designer and the City) apply to determine whether
there is a public safety concern. This variance for this project in no way sets any precedence for relaxing
these standards on other projects without complete analysis and justification.

Request for Variance — Street Cross slopes

This letter is in regards to the Bennett Road Bungalows project, and in particular, to request a
variance. Our client for this project is Spanjer Construction Corporation.
The specific areas of concern are the cross slopes of Bennett Road towards the westerly end of
the site. As you know, we are repaving Bennett Road. We are also installing new curb and gutter
along the easterly side of Bennett Road. The curb along the west side will remain as is. The City
standards for cross slopes are to maintain grades between l .5% and 4%. The existing cross slopes
from the existing; centerline to the lip of gutter, along the westerly side currently exceed 4%.
If we meet the City criteria, conditions are such that we would need to shift, or offset the crown
of the road to the west, or into the travel lane of the southbound traffic. If we maintain the crown
in the center of the street, we will exceed the maximum allowable cross slope. However, as
mentioned above, the existing cross slopes north of the site also exceed 4%.
I feel that shifting the crown of the road into the travel lane to achieve the City standards presents
more of a safety hazard than does a steeper cross slope. Therefore, we would like to request a
variance to City standards to allow a cross slope at Station 10+63.97 of 6.17%. There will be a
cross slope of 4°io by station 12+36. There is also an existing cross slope of 6.8% 30' north of
station 10+63.97. Therefore this is a transitional section, where we are flattening the cross slope
to meet City standards over approximately 200'.
Although we generally agree with the City standard of 4% maximum, this is a transitional area.
We feel justified in requesting the variance. We feel it is a better a design alternative than shifting
the crown for a short distance, than transitioning back to the centerline. We do not feel that this
variance will be detrimental to the public health, safety or welfare, nor will it reduce the design
life of Bennett Road or cause the City of Fort Collins additional maintenance costs.

SUBJECT: BENNETT ROAD CONSTRUCTION DEADLINES
This letter is concerning the road construction project on Bennett School Road. Poudre School
District is concerned that, due to the delayed start of the project, the start of school may be
compromised.
Please be aware school staff returns to the site at the beginning of August, with teachers
returning on August 12. We will need to have the road fully operational on or before this date.
Poudre School District has requested a written schedule for this project. Please keep us informed
