ANHEUSER-BUSCH PUD
While the "superblock" concept has been successfully used in other parts of
Fort Collins, the actual process and requirements for preparation and review
of this type of plan is new. The purpose of the following is to propose a form
for the plan and a process by which the plan would be reviewed and approved by
the City of Fort Collins. This report is for discussion pruposes between the
City and the applicant. The finalized form should be included as part of the
Anheuser-Busch Master Plan documents.
Procedure
Per zoning requirements, any parcel of land within the Master Plan area will
be developed as a planned unit development. Within the Master Plan area, large
tracts of property, known as "superblocks" have been designated. Before any
plat, site plan or building permit is considered for one parcel of land within
those "superbloc:ks", a "superblock plan" will need to be submitted to the City
for approval in accordance with the procedures and plan content requirements
contained herein. The level of information and detail required of a
"superblock plan" should fall between the general plan level of a Master Plan
and the specific plan level of the preliminary plan. The purpose of the
superblock plan is to define certain transportation, design and land use
parameters from which detailed preliminary plans will be developed. This
document will also assist the City in making informed decisions in its long
term transportation and capital improvement plans and programming for the area
and community. The superblock plan should be reviewed and approved by the
Planning and Zoning Board following the same review steps as required for
Master Plans (concept review; filing of application; staff review and
recommendation; public hearing; decision; if necessary, appeal to City Coun-
cil). A first phase preliminary plan should be submitted and approved concur-
rently with the submission and approval of a superblock plan. There should be
no expiration date for superblock plans. The superblock will be reviewed on
the basis of -its conformance with the Comprehensive Plan, and other sound
planning and transportation principles rather than against the specific cri-
teria of the planned unit development regulations. Minor changes to a super -
block plan may be made by the Planning Director according to the criteria for
minor amendments to Master Plans contained within the LDGS. Any major changes
may be made only by the Planning and Zoning Board.
Content of a Superblock
The following information shall be submitted for a superblock plan unless the
Planning Director determines the information is unnecessary for the purpose of
evaluating the development.
A. Application form and filing fee ($60.00).
B. Twenty (20) copies of the superblock plan at an appropriate scale with
the size of the development shall be submitted containing the following
information:

In regard to the above -referenced job, the storurwater drainage pattern and flow amounts urn
consistent with the original studies performed for the Brewery.
There will not be any significant additional net flow into the city stormwater drainage sys(CuI.
The 18'x38' (684 f6) area of the new tank enclosure will increase the flow rate due to the higl)o r
runoff coefficient of the new roof. However, this will be offset by the new truck loadout arl•u
12'x50' (600 %t) which will now drain into an existing process sewer drain.

There was a recent meeting involving the ditch company, Anheuser-Busch and the City
of Fort Collins personnel involving the developed stormwater runoff requirements from
Anheuser-Busch grounds. Although this meeting did not specifically involve the Phase I and II
plant expansion it was mentioned and briefly discussed.
I do not believe that this project was submitted to the ditch company for review and
input. We believe that any further development of the A-B grounds north of the ditch would have
some developed surface water runoff impact.
It would be appreciated very much if you would see that the portions of this project that
involve the surface water runoff issue be submitted so that we may review the same. I thank you
in advance for your help in this regard.

Dear Mr. Czarnecki:
This letter is to confirm that a drainage and erosion control report was submitted to the
Fort Collins Utilities — Stormwater that included the most recent Phase I and II plant
expansion. The review team found the proposed system to meet present stormwater
criteria. The Citv's new rainfall criteria was used on site to size facilities without
modifications to the outfall into the Larimer & Weld Irrigation Company's ditch.
The Stormwater Masterplanning staff looks forward to working with you on the
upcoming drainage masterplanning effort for the Boxelder and Cooper Slough drainage
basins. This effort will probably take a year or more to complete but there may be
opportunities for both Anheuser — Busch and the City to participate in facilities that
benefit both entities. Another key player in that study is the Larimer and Weld Irrigation
Company which has requested the City submit to them the "portions of this project"
(Phase 1 & II) "that involve the surface water runoff issue". To assist in this it would be
helpful if there is an indication on the building permit application to indicate that the
application is part of the already accepted Phase I & 11 report. Thanks for your

BE: A-B Meeting —Roads
Below is; a discussion of the responsibilities for DESIGN,
CONSIRUM'ION, and FINANCING of the perimeter roads, the interchange,
and the frontage roads as I understand the Master Agreement.
Design and Construction: Article IV, paragraph 2, states "City shall
be solely responsible for the procurement of all engineering,
architectural, survey and contracting services, easements permits,
rights -of_ -way, land acquisition, required approvals, materials and
supplies necessary for the completion of the road improvements
described in this Article."
In undertaking this obligation on the part of the City, it is my
opinion that we are required to, and should, follow existing City
policies on the selection of a consultant and advertising and awarding
of a bid for the construction work.
Financing: Article VII, paragraph l,a),(i),(2), clearly makes the
perimeter roads subject to the Supplemental User Fee. The City has
the obligation to finance the perimeter roads with the ultimate cost
being to A-B through their tax increment.
Design: The master agreement makes no mention of any party's
responsibility for design of the interchange and/or frontage roads.
Absent this mention, and in view of A-B's action in retaining the
services of UPS Engineers to undertake preliminary design studies, it
is clear that the intent has been for A-B to have responsibility for
desi n of the interchange and frontage roads.

Construction: Similarly, there is no mention of responsibility for
contracting for construction of the interchange or frontage roads in
the master agreement. It is my understanding that this was left
undetermined because of the possiblity that the State Highway
Department would be the contracting agent. It was never contemplated
that the City would have this responsibility.
Financings: The master agreement makes reference to the funding of the
interchange and frontage road in Article VII, paragraph l,a),(ii),
referencing the Supplemental User Fee "...to the extent of City's
contribution for design and construction of such improvements."
The extent of the City's contribution has not been specifically
defined except by inference. The State Highway Commission has
committed to a contribution not to exceed $1,700,000 toward the
interchange only. The County CoTwd ssioners have committed to a
contribution of 10% of the tax increment or $1,250,000 whichever is
less, including but not limited to, the interchange and frontage
roads.
Of the remaining funds required to construct the interchange and
frontage roads, it seems to me that the City is only obligated to
contribute the difference between any monies spent to meet the
contractural obligations of the City to A-B and the "Credits" due to
A-B under the Supplemental Fee formula. In some years there may not
be any monies available for this purpose.
SLAM
1. The City has a contractural obligation to design and construct the
perimeter. roads.
2. It appears that the City never contemplated a contractural
responsibility for the design and construction of the interchange and
frontage roads.
3. It was contemplated that the City would contribute to the design
and construction of the interchange and frontage road.
4. The extent of the City's obligation to contribute may be limited
by the language of the master agreement referencing the Supplemental
User Fee„

In response to the meeting with Curt Smith, Mauri Rupel, Bonni
Tripoli, Jim Harmon, and yourself, I have put together my
understanding of the points that were discussed at that meeting.
ROADS
Engineering Services is responsible for the design of the perimeter
roads on the north, west, and south sides of section 33 which includes
the plant site. This design cannot commence until the City receives
notice to proceed from AB under the terms of the master agreement.
The master agreement specifies that the perimeter roads shall be 44
feet wide. The roads shall consist of two 12 foot travel lanes and
two 10 foot shoulders. The roads can be widened to full arterial
standards as adjacent developement takes place.
Although the design of the frontage road on the east side of the plant
was originally conceived of as being done with the Interchange, the
agreement with the State Highway Department includes only the
Interchange. Therefore, the design and construction of the frontage
road will be integrated with the perimeter roads. This will not
affect the schedule or the funding of the perimeter roads.
UTILITIES
Planning has requested that a map be prepared that would show the
general alignments of utilities to serve the site. Jim Hoff will be
preparing such a map.

DRAINAGE
We discussed the general plan for drainage from the plant site and the
other AB property. Curt requested that Roger contact Ward Fischer to
discuss making contacts with the affected ditch company. The staff_
will be reviewing further the drainage report submitted by AB..

I contacted tyke Herzig following a discussion I had with John Hathaway
of McClintock & Turk concerning approval of the water line drawings.
John had been told by Dave Stringer, City of Fort Collins, that the
size of the water line was supposed to be sixteen (16) inches.
I told Mike Herzig of my discussion with John Hathaway and indicated that
I thought the size and routing problems had all been resolved through
our dealings with Rich Shannon.
M:ke said he also thought the twelve (12) inch size was agreed upon, but
that they needed to see drawings of the routings and locations of valves,
bends, and thrust blocks. I told him that we had sent a plan drawing to
Building Inspection showing the routing. He indicated that utility
improvements were a separate entity and need to go through his department.
I explained the front end work done with Rich Shannon and Tim Sagan
regarding the routing and separations, etc. Mike indicated that he still
needed to review the design prior to approval. He also indicated that
we needed to apply for curb cut permits for the two (2) driveways. I
told him that I thought that was all included in the original permitting
and that no one ever mentioned we needed to submit drawings or additional
permits other than the arduous procedure we had already followed in
obtaining the building permits.
