HomeMy WebLinkAbout328 REMINGTON ST - CORRESPONDENCE - 2/7/2001C 3 5y Community Planning and Environmental Services Building and Zoning Department City of Fort Collins February 7, 2001 Michael Gaines 328 Remington Street Fort Collins, CO 80524 Dear Michael: I have reviewed the documentation that you provided to me on February 2, 2001 regarding the current and proposed use of the property at 328 Remington Street in Fort Collins. The documentation consisted of the following: 1) a letter from you to me dated February 1-, 2001-, 2)-a copy of the Business Lease listing you as the Landlord, and the Old Town School of Performing Arts as the Tenant, 3) a neighborhood map, 4) an Old Town School of Performing Arts brochure which includes the school's mission statement and a listing of training programs and courses that will be offered, 5) a copy of a State -of Colorado -certificate indicating that the School -is a Colorado nonprofit corporation, and 6) a copy of the Poudre Fire Authority's inspection notice of the property. I also have received a copy of the special events permit application that was submitted by the school to the City Clerk's office. This application lists the dates and descriptions of several events that are proposed to be conducted at 328 Remington Street in February. After reviewing the above -described materials with members of the City Attorney's Office, I have determined that the proposed events scheduled to occur this month will allow the use of the property to continue to be classified as a "place of assembly" as defined in Article 5 of the Fort Collins Land Use Code. Since 328 Remington is already considered to be a mixed -use occupancy building consisting of a single-family dwelling and a place of assembly, the scheduled events will not result in changing the use of the property. Since the use category is not changing, then the applicable zoning regulations are being satisfied and no zoning violations will be created by the holding of the February events as described in the Special Events Permit application. Please be advised though that any future events must meet certain criteria in order to avoid changing the approved use of the property. These criteria are: 1. The Old Town School of Performing Arts must be a tenant of the building. 2. The School must be the applicant on any special events permit applications. 281 North College Avenue • P.O. The events may only be for School fund-raising purposes, and not -for - profit. Any events that are considered commercial in nature will not be permitted. 4. All special events permit applications must be reviewed by the City Zoning Department prior to the permit issuance in order to determine that the proposed events are not commercial in nature. In order to make such a determination it may be necessary for the Zoning Department to require additional documentation that provides a more detailed event description than the description contained on the events application form. 5. The events should occur on only an occasional basis, rather than on a weekly basis. (The February weekly events are permitted as a one-time fund-raising emphasis period). Michael, please keep in mind that while the current tenancy of the Old Town School of Performing Arts in the building is allowed, the actual "school" use is not. In other words, before the School can actually open for business and begin conducting programs and training, the City must approve a change of use. The school will be classified as a private school for vocational education. Such a use is permitted in the NCB zone in which 328 Remington is located, but only after the use has been authorized. Since your current certificate of occupancy does not authorize a school use, it will be necessary to go through the appropriate City review process in order to obtain a new certificate of occupancy.
