Coy Drive Fort Collins, Colorado 80521 Mr. 1 ckerdt, Please find attached letter to you dated April 30, 2015 in which I requested your assistance in correcting a concern noted at your property referenced above. The inspection performed yesterday has verified that you have taken no action to correct the issue of the open excavation. As I had indicated earlier, the International Property Maintenance Code (IPMC), as adopted by the City, is the regulation that addresses property conditions particularly in rental property, both interior and . exterior. IPMC Section 302.2 states: 30Z2 Grading and drainage. All premises shall be graded and maintained to prevent the erosion of soil and to prevent the accumulation of stagnant water thereon, or within any structure located thereon. Drainage of paned areas, yards and courts, and other open areas on the premises shall not be discharged in a manner that creates a public nuisance. Abandoned or unprotected excavations shall be considered a nuisance and shall be filled to the original or adjoining site elevation. This Notice is to inform you that I am now classifyingthe ie open excavation as a hazard and I am requiring that you remove all debris and fill in the open excavation. Corrections shall be completed within 30 days of the date of this notice. An inspector will make periodic inspections to determine if you have complied with this order. Be advised that failure on your part to comply with this Order will result in additional legal action taken and can result in a summons to appear in Municipal Court where fines of up to $1,000.00 per day per violation�can�bbe-;assessed, or even the revocation of the Certificate of Occupancy for the property. This letter is to inform you that the City has started receiving complaints about the open excavation next to the home. Open excavations tend to collect branches and debris which in turn becomes a harborage for rodents and are a concern for the City due to trip hazards or falls. With this being your first notice from the City regarding this issue, please have the open excavation cleared of debris and branches and filled in and the ground leveled, within 30 days of the date of this letter. No permit is required and a simple call to me stating that the site is leveled will activate a final inspection and the closing of the case.
