Such findings help ensure that the proposed project conforms to the adopted plan of the City of Fort Collins. 3. Location/Land Use: Schools are allowed in the RL Zone District subject to Planning and Zoning Board review. Upon first glance, the location and land use appear to be appropriate; however, staff reserves the opportunity to differ, based upon the final site design and the Transportation Impact Study. 4. Character/Site Design: Staff cannot comment on this until,a complete and accurate development plan is submitted for review. a 5. Transportation: The site has right -in right -out vehicular access from Lemay Street. Full movement vehicular access to the site is provided on Stuart Street. It is not known if any transportation improvements are needed due to the lack of a Transportation Impact Study. On -site pedestrian and bike circulation as it exists today is not consistent with City Standards. The site needs pedestrian connections between the street and the building; and connections between the parking lot and the street. Bike parking is not provided. 6. Findings of Fact/Conclusion: The request is a Site Plan Advisory Review for recommendation to the Poudre School District Board of Education. At this writing, staff cannot make findings of fact due to the lack of accurate information. RECOMMENDATION: Staff has no recommendation at this time. If the applicant can provide complete and accurate information in a timely manner, a recommendation may be provided at the public hearing. If the applicant does not provide such information, staff will recommend that the Board request a hearing in front of the School Board. Background: The surrounding zoning and land uses are as follows: Existing Land Use Existing Zoning North Office/Professional Park MMN South Child Care Facility RL East Single Family Attached Dwellings (Townhomes) RL West Single Family Detached Dwellings RL 2. Right to Advisory Review: Colorado Revised Statutes provide two specific references that allow the City to review the planning and location of school sites. A. Section 22-32-124, C.R.S. — Prior to contracting for a facility, a charter school shall advise in writing the Planning and Zoning Board. The Planning and Zoning Board may request the charter school to submit a site development plan for the proposed facility. The charter school, acting on behalf of its sponsoring school board, shall submit such a site development plan. The Planning and Zoning Board may review and comment on such plan to the governing body of the charter school, but must do so within thirty days after receiving such plan. The Planning and Zoning Board, if not satisfied with the response to such comments, may request a hearing before the Board of Education regarding such plan. Such hearing shall be held within thirty days after the request of the Planning and Zoning Board. The charter school then may proceed with its site development plan unless prohibited from doing so by School Board resolution. B. Section 31-23-209, C.R.S. provides that no public building shall be constructed or authorized in a city until the "location, character and extent thereof' has been submitted for approval by the Planning and Zoning Board. In the case of disapproval, the Planning and Zoning Board shall communicate its findings to the School District. The Planning and Zoning Board may be overruled by the School Board by a vote of not less than two-thirds of its membership. ITEM NO. 8 MEETING DATE 6/21/01 STAFF Brian Grubb Citv of Fort Collins PLANNING AND ZONING BOARD STAFF REPORT PROJECT: Ridgeview Classical School Site Plan Advisory Review, #16-01 APPLICANT: Poudre School District 2407 LaPorte Avenue Fort Collins, CO 80521 OWNER: Dunamis III Limited Partnership 8354 South Holland Street, Suite 303 Littleton, Colorado PROJECT DESCRIPTION: This is a plan to convert an existing church building, located at the southeast corner of Lemay Avenue and Stuart Street, into a charter school. The development plan includes a remodel of the interior of the building, and an addition of 12,133 square feet along the Lemay Avenue frontage. During the remodel and retrofitting process, temporary classrooms will be utilized. The existing church congregation will continue to use the facility until their new church is completed in summer 2002. After the transition, the temporary facilities are to be removed. RECOMMENDATION: Staff does not have enough information to formulate a recommendation at the time of this writing. A recommendation may be ready at the worksession or at the public hearing depending upon the timely receipt of plans and information. If the applicant is not able to adequately address all outstanding issues prior to, or during the public hearing, staff will encourage the Commission to request a hearing in front of the Poudre Valley School District Board of Education. EXECUTIVE SUMMARY: The City's right to advise the Board of Education on matters relating to the Ridgeview Classical Charter school is found in Colorado Revised Statutes. These statutes allow the City to comment on issues relating to compliance with the comprehensive plan (City Plan) and the location, character and extent of the project. State law requires the Planning and Zoning Board to review and comment upon the submitted plan within 30 days. An incomplete and inaccurate site plan was submitted on May 22, 2001. Per State law, the Board is compelled to approve the plan or request a hearing in front of the School Board by June 21, 2001.
