Campus Crest, the developer, is not concerned with the two modifications which were at issue on December 21 st as they are no longer needed. (Mr. Roy and I exchanged voicemails for several days after the hearing up through last Monday, and he then referred me to you last week.) The Applicant's attorney, Ms Lilley, very near the end of the appeal, stated that the variances were "freestanding" and good for one year. I believe it is the opinion of City staff that that is not the case as they were submitted as a part of the PDP (not as freestanding variances). However, when we spoke last week, you said you would discuss this issue with Mr. Roy of the City Attorney's office, and provide written comfirmation of the status of these items. I'm sure you are very busy, but I just wanted to remind you to provide that written confirmation at your earliest convenience. I was uncertain of the status of the variances at the end of the meeting given Ms. Lilley's statements, and just want to be very clear of the status of the variances (or modificaitons of standards).
