Sherwood Street Dear Chris: As you are aware, the Landmark Preservation Commission, at its December 10 meeting, evaluated the property at 631 S. Sherwood Street for its eligibility for designation as a Fort Collins Landmark. Following deliberations, the Commission unanimously (6-0) found that this property is eligible for individual designation as a Landmark. Decisions of the Commission may be appealed to the City Council. A written notice of appeal must be filed with the City Clerk within 14 calendar days after the decision of the Commission. Please contact the City Clerk's Office, 221-6515 for more specific information on the appeals process. Any development plan affecting this property would need to comply with all applicable requirements of the Land Use Code, including Section 3.4.7 (attached), which pertains to the preservation of individually eligible properties. If the plans are denied as a result of the Development Review Process, City Code allows for an appeal of that decision on certain grounds. Again, please contact the Clerk's Office for more specific information. Once development plans have been approved, any demolition of, or alteration to the historic buildings would be reviewed under the Demolition/Alteration Review Process. This involves a Preliminary Hearing, followed, if needed, by a Final Hearing. The Preliminary Hearing is the opportunity for applicants to meet with the Commission, with the goal of identifying and solving issues that adversely affect the property's historic significance and integrity. An agreeable solution is often found, allowing for the applicant's needs and still protecting the individual eligibility of the building or structure. If the applicant and Commission are not successful in developing an acceptable solution, then the application proceeds to the Final Hearing. The Final Hearing has additional requirements: a fee of $250, to cover the costs of processing the request; property documentation, including a Colorado Architectural Inventory Form for each building and a report regarding the effect that the alteration, removal, or demolition would have on the character of the site and on adjacent properties; and the approved plan for redevelopment of the property. At the Final Hearing, the Landmark Preservation Commission reviews all evidence presented, and then may either approve the application (with or without conditions), or may postpone con- 281 Borth College Avenue • PO.
