A condition was offered at the Type 1 hearing in connection with Building 2 (the garage), but was not made a condition by the Hearing Officer. The offer was to slope the roof on the north fa4ade of that building from its tallest point of 48 feet in height on its east corner to a height of 37 feet, 6 inches on its west corner. I believe there was a slide of this at both the Type 1 and the appeal hearings. 2. At the Type 1 hearing, the roof of Building 1 was already shown on the PDP as stepping down from 5 stories to 4 stories on its north side. However, another condition was offered in connection with this building: that the roof be pitched, but again the HO did not make that a condition. Two new conditions were agreed to at the appeal hearing in connection with Building Three: stepping down from 5 to 4 stories the same as was shown for Building One and pitching the roof. Linda Ripley has suggested that the language for both Buildings 1 and 3 be as follows: "That the north thirty (30) feet of Buildings One and Three, as shown in the PDP for Building One, must be reduced in height from five (5) to four (4) stories, and that the fourth story must feature a pitched roof, so as to reduce the building height along the north elevation of these buildings." Note that we don't think the term "on the perimeter of the PDP site" should be used as it's too vague. Let me know if we need to talk further about these. Section 3.2.1(F) contains all the up -sizing standards. The reference to the section is perhaps too obscure but in order to comply with Sec. 3.2.1(F) all plant material must be up -sized. Otherwise, there would be failure of compliance. My Read Before will explain that.
