Below are just a few push -back items that might be discussed: 1.) When Thompson School District opted out of the site, did Lennar endeavor to meet the proposed use through any other means? Can they commission a commercial broker with a time -line to procure another buyer (i.e. private school, charter school or other similar use) before simply enacting the secondary use. 2.) If the market does not feasibly support other alternatives that meet the original intent, then the secondary use option should be implemented in a way that is subordinate to the current RR planning and layout. This would include such features as greenbelts, pathways, cluster -box mail drops,..etc. None of these are present in Lennars proposed replat. 3.) The density of any proposed subdivision should not be greater than that of the adjacent areas. I feel that this is very important, as it would decrease the real property values in that area rather than compliment them as a school and park combination would have done. 4.) Lastly, any final determination by the City should be pursued through some sort of Lennar guarantee or holdback escrow agreement (between Lennar and Buyer). This would ensure Lennars commitment to compliance, and prevent them from a dump and run strategy which clearly suits their best interest; not ours. As a developer myself, I fully understand Lennar's position. However, they have an obligation to the residents of RR & to the City of Fort Collins that is no different than any other development in any other community: When Plan A breaks down, the developer coordinates and cooperates with the community to come up with a Plan B that is in good keeping with the original "spirit of the deal". I have printed your email and it will be included in the project file as part of the public record. You are more than welcome to stop by my office located at 281 N. College to review the latest plans and records for this proposal. To date this project has submitted an initial set of plans for review, and City staff commented on this submittal. I should point out that the initial submittal was quite different from the plan presented at the neighborhood meeting and included greenbelts and fewer lots as requested by the HOA. Several of your concerns (pathways, clustered mailboxes) echo comments made by City staff. We are now awaiting submittal of revised plans to see how those comments have been addressed. In our next review, City staff will also include looking at the density of the project in relation to the entire neighborhood and must comply with all code requirements. I spoke with Thompson School District after the neighborhood meeting about their plans for a school on this site and unfortunately they are not interested in building a school at this location. Furthermore, the City simply cannot force anyone (including a private school) to purchase the property. I regret that the homebuyers in the area feel like the information about this area may have been misrepresented by the developer and try to urge everyone to rely on recorded plans (available to the public) as your basis for information in the future. Finally, once the City has recorded plans on file, any new owner of the property is subject to the same approved and recorded plans and even the most minor changes are subject to the Development Review Process. As a member of the current Registry Ridge (RR) HOA, I'd like to offer some comments regarding Lennars intent to move forward with Tract C's secondary use option. I think it is important that all parties revisit "the spirit of the deal" as is was originally presented to Planning and subsequently sold to the residents of RR. For my wife and I, the Master Plan displayed by Lennar (then US Homes) was a key factor in our desire to build here in 2002. Likewise, for many other residents and City Planning, the school, the park and the commercially zoned corner at Shields and Bon Homme Richard were specific elements that complimented the Master Plan being proposed at that time.
