The Planning & Zoning Board approved the Major Amendment on September 20, 2007, and I have seen nothing since. Technically there is no Final Plan submittal, review, and approval (from a Planning standpoint) for Major Amendments and, therefore, this item would be subject to the requirements set forth in Section 2.2.11(D)(3) Term of Vested Right in the Land Use Code. This section states: Within a maximum of 3 years following the approval of a final plan or other site specific development plan, the applicant must undertake, install and complete all engineering improvements (water, sewer, streets, curb, gutter, street lights, fire hydrants and storm drainage) in accordance with city codes, rules and regulations. The period of time shall constitute the "term of the vested property right". The foregoing term of the vested property right shall not exceed 3 years unless: (a) an extension is granted pursuant to paragraph (4) of this subsection. Based on this requirement, the Collinwood North, Major Amendment plans will expire on September 20, 2010 unless: 1) An extension granted pursuant to Section 2.2.11(D)(4) of the Land Use Code; or 2) A set of Final Plans is submitted to the City, reviewed and approved prior to September 20, 2010. At that time the applicant would have 3 years to satisfy the requirements to establish a "vested right" for the development plan, per Section 2.2.11(D)(3) of the Land Use Code. Steve >>> Marc Virata 4/23/2008 3:31 PM >>> Erika, I'm recalling that the project did get an approval at the Planning and Zoning Board several months ago, probably last fall. I have not seen it resubmitted since, so I don't know if the project is on hold, or still viable. They do have at least a couple of years left to obtain final approval. I've copied Steve Olt to see if he might have any insight on the whereabouts of the project.
