As you are aware, during the period September 2004 through May 2005, Earth
Engineering Consultants, Inc. (EEC) personnel provided construction observation and
testing services to you for the referenced project. Those services were provided on a
part-time, on -call basis and involved observation and testing of fill placed to develop site
grades, backfill placed during utility installation and subgrade, aggregate base, asphaltic
concrete and cast -in -place concrete prepared/placed for development roadways at the
referenced project. Results of observations and testing outlined have been provided in
previous reports. The final field density test results met the project compaction
requirement and the final laboratory test results met the concrete and asphalt mix design
requirement for the referenced project.

At the contractor's request, we have reviewed our project files to determine if there
are outstanding discrepancies for construction observations and materials testing at the
subject project. CTL I Thompson performed the following quantities of observations and

Dear Whitney:
KL&A Inc. was retained to perform limited periodic observations during construction for the
above mentioned project. Our observations were made to provide Neenan and the owner with
some evidence that the construction was generally conforming to the contract documents.
During the construction representatives of KL.&A, Inc. visited the project site several times to
observe the progress of work. Based on our observations and experience, to the best of our
knowledge, the structure of the buildings were constructed in general conformance with the
structural contract documents and is, in my opinion, substantially in conformance with the
structural provisions of the Uniform Building Code.
Our firm provided written reports with our observation comments. These comments and other
correspondence include some record of the verbal field directives and telephone discussions
with you and/or Neenan field staff. These discussions typically indicated where discrepancies
existed between our observations and the intent of the contract documents, where the field
conditions did not allow for installation as originally detailed, or where an interpretation or
clarification was requested by your firm. These clarifications were provided by our firm, as
the engineer of record, typically through your office.
If we observed a condition requiring correction, we tried to re -observe and make note of the
corrected installation on a later visit. Because our services were periodic, as construction
progressed some observed items were hidden from view by collateral and finish materials so it
is possible that hidden defects exist. Our experience on this project is that the construction
services have been addressing the field concerns and issues discussed on a timely basis.
