SUB]: Variance Request, 421 Stover St. — Occupancy Change from R-3 to B
REQUESTING PARTY: Peter Trozan dba Trozan Insurance Agency, Inc.
ACTION REQUESTED:
The Requesting Party, as stated in his letter of May 21, 2003, is seeking a variance from all
accessibility -related requirements stipulated in "Chapter I I" and "Appendix Chapter 11" of the 1997
UNIFORM BUILDING CODE, as adopted by the City of Fort Collins. Such requirements are
triggered pursuant to Sec. 3405 of the UBC when a building undergoes a change in Occupancy
Classification — in this case from "R-3"(dwelling) to "B"(office).
DECISION:
The request to waive all accessibility provisions is denied because the building is likely to be
occupied by other tenants or owners with various uses. However, based on the existing building
constraints, an accessible bathroom is not required for the proposed office use. A fully complying
accessible ramp to an accessible entrance with access to the public office spaces is required prior to
issuance of a Certificate of Occupancy.
