This letter is in response to your request for evidence of zoning with regards to
the above property. According to our Official Zoning Map maintained by the City
of Fort Collins Building Inspections and Zoning Department, the current zoning
on the above referenced property is Harmony Corridor (HC).
While a movie theatre is not a permitted use in the HC zone, this theater is
permitted as its use was "authorized pursuant to a site specific development plan
that was processed and approved" by the City provided that "all of the use and
density requirements and conditions of said site specific development plan"
continue to be met (City of Ft. Collins' Land Use Code 3.21 [B][1][a]). There is no
indication suggesting that the use, requirements, and conditions of the site
specific plan are not being met.
