Mr. Pierson,
This letter is to notify you that I recently performed an inspection of the basement apartment at
the above referenced address. The purpose of which was to verify compliance with the Fort
Collins City Code Chapter 5 Article VI Division 2, "Non -Owner -Occupied Housing Standard"
I have identified a number of areas where this unit does not comply with the Standard. First and
foremost, the basement apartment has never been approved by the City. A search of our files
finds no information that would authorize the use of the basement as a separate dwelling unit.
Please provide this office with any documentation to the contrary.
Until such time that the basement use, as a separate dwelling unit, is approved, I hereby declare
this apartment to be in violation of the Standard Sections 5-280, 5-281. Use of the basement, as a
separate dwelling shall cease upon receipt of this letter.
In order to approve the use as a separate dwelling, you will need to obtain a building permit to
make necessary alterations to the egress windows and mechanical heating systems, pay associated
fees to create a dwelling unit and obtain all final inspections and approvals. A new Certificate of
Occupancy will be issued and only then can the basement be used as a separate dwelling unit.
If I do not hear from you, I will assume, and the record will show, that this unit has been
converted back to only one single family dwelling at this address. Any future calls regarding the
basement use as a separate dwelling unit without City approval would be grounds for this office
to issue you a summons to appear in municipal court for the illegal use of the basement as a
separate dwelling unit.
