Dear Mr. Kiel:
RE: Corrected Zoning Affidavit for 825-827 East Laurel Street
The above referenced property is located in the Neighborhood Conservation Medium Density (NCM) district.
This zoning district permits single family detached dwellings (Article 4.7 [B] [1] [a], City of Fort Collins Land
Use Code). Division 4.7 of the code requires that a minimum 5,000 square foot lot is required for each single
family detached dwelling. Minimum setback requirements are as follows: 15 feet - front, 15 feet - rear, and 5
feet at the sides. In addition, a minimum 40 foot lot width is required.
The plot plan submitted would seem to indicate that the lot might be successfully split into two lots, with no
lot smaller than 5000 square feet. This could be achieved through a mets and bounds legal description,
other words, the property would not have to be replated. Zoning requirements would still apply, however.
This would require that the setbacks mentioned above be maintained between the existing buildings and the
proposed property lines. The proposed rear lot would only need to maintain a minimum building distance of
5 feet to each property line as the rear lot would have no front or rear property line, only side lot lines as it
would not front on a public street. The proposed front lot may pose a challenge in that the existing garage
may have to be moved or removed as it needs a minimum 15 foot distance from it's back wall to any
proposed rear lot line.
If the access to the rear property line is through the alley, then it will need to be upgraded to private street
standards. This would require that the alley be paved the full 200 linear feet to East Laurel Street. You
might also be responsible for improvements to the curb cut where the alley and East Laurel Street meet.
Storm water design might also enter into this. Please contact the City's Engineering Department for those
design criteria. Their phone number is 221-6605.
Finally, as briefly mentioned at our last meeting, Poudre Fire Authority (PFA) will also have some standards
to be met as redevelopment of the property would be occurring if the lot is split, regardless if there are no
changes made to the existing buildings. Access to the rear property will be of importance to them. Contact
