Dear Mr. Canino:
The building permit for 613 South College has not been finaled,
therefore a Certificate of Occupancy has not been issued.
In order that a Certificate of Occupancy can be issued, the
following work must be completed:
1. South wall of the front porch must be protected.
as for 1 hour fire -resistive construction.
2. Provide additional ventilation air for compressor
that is located on the front porch.
3. Provide ramp for exiting from the main entrance door of
the main building onto the front porch.
Once the above items have been completed, inspected and approved
a Certificate of Occupancy will be issued. If you propose to do
additional work, an Unlimited Contractor will be required to take out
a permit before the work actually begins.
If we can be of further assistance to you, please feel free to
contact us.

1. The current use of the premises at 613 South College as a fraternity
house does not comply with the use prcvisicns of Ordinance Lo', 1965 s
amended becau=_e the area is zoned for General Business. The unauthoris-
ed use as a fraternity (Phi Cii Chapter, Phi Gamma Delta) apparently
began some time during the fall of 196e when Roland W. Nuckols sold the
property to the Phi Chi Chapter Rouse Corporation. Informal telep}:one
conversations with Mr. Robert Vessey, President of the fraternity (ph•;ne
h8L-oUl, or l:82-3916) indicated that an honest mistake had apmarently
been made. No evidence of misrepresentation or intent to evade the
law has been adduced. Dr. Ri-chard L. Penfold, 1025 Lemay Avenue, phone
484-3767, is Secretary of the Corporation owning the house and land.
2. Letter attached for signature of City h:anager advises Dr. Penfold that
remedial action to ccmnly with 2.cn ng ordinance is required and request. -
that Dr. Penfold advise the City of a tentative date by which compliance
can be expected. It will probably be necessary for the fraternity to
sell the premises in order to comply, therefore date is not to be con-
D sidered a deadline for compliance but rather a date upon which progress
will be reviewed.
3. Recommend that attached letter to Dr. Penfold be signed by City
Manager (courtesy copy to Mr. Robert Vessey), and dispatched.

Dear Doctor Penfold:
As you are aware from previous telephone conversations, the use
of the premises at 613 South College Avenue as a fraternity chapter
house does not comply with the use provisions of the Zoning Ordinance
of the City of Fort Collins. The area is Zoned BG (General Business)
while the current use as a chapter louse requires Residential High
Density (RE) Zoning.
All information available to us seems to indicate that the vio-
lation has cccurr.d through inadvertance. Thus, the purpose of this
letter is to request that you initiate such actions as you believe
appropriate to restore the prapexty tc an authorised (business) use.
It is our understanding that this may require the sale of the premises.'
and tPerefore it is requested that y u furni_N us an estimate of the
time you will require to make the adjustment. It is understood that
the date you establish will serve primarily as the time for review of
progress and not as a deadline. Your cooperation in eliminating the
non -complying use will assist us in maintaining the highest standard
of pr perty use.

This letter constitutes your authorization to.
occupy the premises at 613 S. College. This permission,
to occupy constitutes a temporary Certificate of "
Occupancy issued under the provision of Section
306(d) of the Fort Collins Building Code and covers
both the ground floor and the second floor. However,
the foregoing does not free you from the responsibility.

Code as Mr. Waldo has outlined during recent inspec
tions. We would appreciate your estimate of the
date when the final inspection can be completed.

Mr. Clyde sent you a letter dated January 17, 1973 granting you
authorization to occupy the premises at 613 S. College. However,
as he indicated there were still some items that needed correction
to comply with the Fort Collins Building Code and he asked that you
give this office an estimate as to the completion date.
I inspected the premises on August 9, 1974, approximately 19 months after
the aforementioned letter was sent to you. Some of the items on the
original list have not been completed. In addition, the following work
has been done without an approval:
1. South wall of front porch closed in with wood framing
2. Framed walls for front exit door
3. Large walk-in cooler installed in South end of front porch
Items one and two require a permit be taken out by an Unlimited
Contractor. Item three will require an evaluation of the load carrying
capacity of the floor system. Also, there is a problem of change in
elevation along the front exit path.
I trust you will make a dedicated effort to clear up these problems in
a timely manner.

All the work outlined by Mr. Waldo has not been completed with
the exception of changing the floors and walls of the public
bathrooms.
I am without the funds to accomplish this change.
In view of the fact that this work was done originally on the
basis of information supplied by my general contractor, Mr. Arnold
Kectner--in spiie'of the clear language of —the -building code--I----
request that this change not be required.

On August 23, 1974 I informed you by letter that there were code
violations that existed prior to the last inspection made at
613 S. College on August 9, 1974. In addition, I noted that
during this inspection I found additional work had been done without.
a permit. As a .result of the above information I asked that you make
a dedicated effort to clear: up the problems in a timely manner.
Several days later, during my absence from the office you came to
the office and visited with the Plans Examiner, at which time you told
him that you would take care of the problems in the near future.
Again, I must inform you that considerable time has elapsed since we
have had any communication with you in regard to clearing up this
matter, and strongly urge you to resolve the problem.
