Felix Lee Chief Building Official Dear Mr. Lee: Upon trying to obtain a permit for finishing a bedroom and a 3/4 bathroom in my home it was brought to my attention by the zoning department that the window in the proposed bedroom was not the required height from the floor to the bottom of the window. The window is 52" from the floor and according to the code it should be no more than 48". As the window is of more than adequate size, (35" x 58,") with a opening of 29" x 35", I thought there might be some way of getting approval without replacing the window. One possible solution is to build a step in front of the window. Or maybe careful placement of furniture might be acceptable. As this is a tri-level home, the entire window is above ground level. The wall is made of concrete 41" high with the remainder of the wall wood frame. This leaves a ledge 4" wide 11" under the window which would also assist someone attempting to crawl out of the window. Any suggestions you might have would be very helpful.
