Melody & Company 5847 San Felipe, Suite 4400 Houston, TX 77057 Re: Oak Tech I Building 4700 McMurry Fort Collins, CO Gentlemen: Regarding the above property, please be advised of the following as of the date hereof: The land on which the above -referenced property is located is zoned HC (Harmony Corridor), and is subject only to the use restrictions generally applicable to that classification and to other applicable general development standards which are contained in the City of Fort Collins Land Use Code. The permitted uses in this zone include any land use located on a Planned Unit Development plan approved prior to March 27, 1997. The property in question was developed in accordance with the "Oak Ridge Business Park 7th Filing Planned Unit Development' plan that was approved prior to March 27, 1997, Therefore, the current use of the property is a legal and approved use and the Project is in compliance with all zoning requirements of the City of Fort Collins as to it use and its structures. In the event of casualty, the Project may be rebuilt substantially in its current form (i.e., same building footprint) upon satisfaction of the following conditions and/or limitations: 1) a building permit is obtained and any required permit and process fees are paid; 2) the building, or portion thereof, that is being rebuilt must comply with current building codes; 3) previously existing site improvements must be reconstructed; and 4) any other applicable City reconstruction regulations in effect at the time of the casualty are complied with. The required number of parking spaces is the number which is shown on the approved Planned Unit Development plan. City inspections show that the parking is in compliance with the approved plan.
