Collins Assemblage, Ltd. 4212 Wellington Dr. Fort Collins, CO 80526-5231 Dear Mr. Strickfaden: Yesterday you visited the City of Fort Collins Zoning Office for the purpose of obtaining permission to sell christmas trees from the property at 4508 S. College Avenue in Fort Collins. This undeveloped lot "is located directly north of the Phillips 66 station which is on the corner of S. College and Harmony Road. The property is zoned by conditional (planned business with a PUD condition). The conditional zoning means that the only uses which are allowed on this lot are those that are specifically authorized by an approved Planned Unit Development (PUD) plan. Since no PUD plan has been approved by the City of Fort Collins for 4508 S. College, no uses are permitted on the property at this time. Christmas tree sales are considered to be a retail sales use, and since the Zoning Code requirements apply equally to uses whether they are temporary or permanent, such sales are not allowed. Permission to sell Christmas trees at this location can only be given once a PUD is approved which allows retail sales, or once the property is rezoned to a zone which allows retail sales as a use -by -right., I have conferred with members of the Planning Department and the City Attorney's office regarding this matter, and they agree that the City Code contains no provisions which would authorize permission to be given at this time to allow christmas tree sales on your property at 4508 S.
