418 Linden Street and 3000 East Drake Road, Fort Collins, Colorado
Present Occupant: Poudre Pre -Mix, Inc. ("Poudre")
Future Occupant: Aggregate Industries-WCR, Inc. ("Aggregate")
Gentlemen and Ms. Groll:
i am the Zoning Administrator for the City of Fort Collins and as same am familiar with
the current zoning classifications and legal uses permitted at the Poudre property located at 418
Linden Street, Fort Collins, CO 80524 (the "Linden Property"), and the Poudre property located
at 3000 East Drake Road, Fort Collins, Cc 80526 (the "Drake Property").
The Linden Property is presently classified RDR. The RDR zoning classification is
attached hereto and incorporated by reference herein. Poudre's use on the Linden Property is
classified as an "existing limited permitted use" under Division 1.6 of the Fort Collins Land Use
Code (the "Code").
In addition, the Drake Property is presently classified RC. The RC zoning classification
is attached hereto and incorporated by reference herein. Poudre's use on the Drake Property is
also classified as an "existing limited permitted use" under Division 1.6 of the Fort Collins Land
Use Code (the "Code").

I further certify that the mere change of ownership from Poudre to Aggregate and/or
usage of the Linden Property and the Drake Property by Aggregate as the purchaser of the assets
of Poudre will not affect the entitlement of these properties to continue their ready -mix
operations as they are presently engaged in in the course of such business.
Mr. Osborn, as attorney for Poudre, has asked me to verify that to the best of my
knowledge, there are no violations of any applicable zoning regulations or ordinances relating to
Poudre's operations at the two aforesaid locations, and all buildings and structures at both
locations, including but not limited to, the ready -mix plants, conform in all material respects with
all applicable Zoning regulations or requirements. I so verify.
