813 E Harmony and the building west, addressed as 4700 Boardwalk, both were constructed as B
occupancy and/or the newly classified M occupancy with "unlimited" area due to sprinklers and 60' yards
per UBC 506. These buildings have undergone alterations and additions throughout the years using the
same "unlimited" provisions.
Recently it was found that the property -line between these two buildings was in fact 10' from each
occupant for a total space between buildings of 20 feet. Property -lines or centers of public right of ways
can be used to satisfy the 60' yards in order to be "unlimited" in area. For whatever reason this common
property -line of 10 feet, which does not the meet the 60' requirement for "unlimited" area, was not
addressed at the time of original construction for either building.
In order to consider current and future additions to either building, it has been determined that both
mercantile (M) Occupancy buildings should be considered as one building for the "unlimited" area
section. It is understood that these buildings are not on the same property. Additions shall be fire
sprinkled and of non-combustible construction throughout, with occupancies in the same or less relative
hazard as it relates to building heights and area as noted in the 1997 Uniform Code for Building
Conservation Table 5-A.
This memo deals with area only and all codes in effect at the time of future additions remain applicable.
